Appellant. The appellant urges infertility confusing the same with
impotence. Naturally there were physical relations between them
but the respondent was unable to conceive ... problems with lubrication. If the
appellant considered the respondent impotent unable to have
physical relations it was a fact especially in his knowledge. The

came to know
that her husband is impotent. The prosecutrix alleges that she
was asked by the relatives of the husband not to disclose this
presence of his friends and
relatives, that her behavior towards the relatives was not good, as she never
served water etc. to guests and lastly ... petition, that the appellant alleged him to be impotent person
in the presence of relatives. This assertion was supported by him while

home. Her relations with the husband were strained. The allegation of
impotency cannot be countenanced since at the time o death
relations. This, however, did not mean that she did not have any intercourse or that her marriage was not consummated because she was impotent ... Judge to come to the conclusion that the Appellant was impotent or was impotent qua the Respondent and that marriage had not been consummated
