12. Section 52 of Indian Easement Act defines licence as under:
"Licence defined" Where one person
held to have acquired by way of prescription, any right of easement of light

23. As per Section 56 of Indian Easement Act, 1882, unless a
different is expressed or necessary implied, a license ... servants or agents. Thus, in view of
Section 56 of Indian Easement Act, 1882, it is clear that Tehbazari
license was personal to Shri Suraj
year 2010 and
defendant remained in the possession of the suit property.
12. It is pertinent to mention that plaintiff has claimed that defendant ... mentioned
anywhere in the above mentioned clause. Sec. 52 of the Indian
Easements Act defines a licencee, which reads as follows:-
