instructions to the Bank in respect of fourth cheque ... part fo
the complainant and therefore, on 30.01.2017, he has
issued stop payment instructions to the Banker.
24. So from these material suggestions
Further, though she claims to have taken legal action,
by issuing stop payment instruction to her banker, but,
admittedly, the cheques in question initially were ... funds insufficient twice by knowing the
same, the accused issued stop payment instruction, but,
what for she issued stop payment instruction is material
for consideration
that
much prior to this alleged loan transaction, he had issued stop
payment instructions qua the cheques, and probabalised his
defence that the real transaction ... thereafter, Mr. Radhe Shyam expired, subsequent to
which he had given stop payment instructions with respect to the cheques in question
to his banker

month of October, 2015 and she had issued stop payment instructions to

Ex. DW1/1 (OSR) Stop payment instructions dated 09.03.2013 issued to
(colly) PNB, Patel Nagar ... reason "payment
stopped by drawer", the accused can raise a probable defense by showing that the stop-
payment notice had been issued because
were making false excuses,
and therefore, the applicant had issued 'stop payment
instructions' in respect of two undated cheques. Mr. Shah,

30. Stop payment instruction was given by the
accused to his banker ... Reddy at that time also. Further he has not given any
stop payment instructions to his banker at that time. As per

instruction to his banker, hence, he is not liable claims to
be innocent ... escape from liability issued Cheque
with different signature and later issued stop payment
instruction with an intention to deceive the complainant
