khatals may not conform to 'thika tenancy' within the
meaning of thika tenancy under the Calcutta Thika Tenancy Act, 1949 which
is repealed ... even if such lands do not comprise thika tenancy within the
meaning of thika tenancy under the Calcutta Thika Tenancy Act also vest
under Section
Panja further submitted that under the Calcutta Thika Tenancy (Acquisition and Regulasion) Act, 1981, the Thika Controller is not vested with the power to adjudicate ... with the State under the Calcutta Thika Tenancy (Acquisition and Regulation) Act, 1981 held before the Thika Controller, Calcutta should be quashed.
21. Mr. Haque

us is the Thika Tenant and (iii) to what extent?
We have meticulously considered the order of the Thika
Controller wherefrom we find that ... Controller for fresh hearing after giving an
opportunity of being heard to all the parties before the Controller.
The order passed by the Controller, Kolkata
approached
the learned Single Judge by challenging an order of
the Controller, Kolkata Thika Tenancy, dated April 16,
2012. A challenge was also thrown ... application is filed before the Tribunal
challenging the order of the Controller,
Kolkata Thika Tenancy, dated 16th April,
2012, the interim order passed
presented, inter alia,
laying challenge against the order of the Controller,
Kolkata Thika Tenancy dated 16th April, 2012 as

On consideration of the impugned order of
Controller, Kolkata Thika Tenancy dated 16th April,
2012 it appears that the said order is required

Respondent
Kolkata 700017 has
been declared as a thika property by the Controller,
Kolkata Thika Tenancy by order dated 19 th December,

communication dated 02.06.2017 intimated the Chief
Manager Revenue (South) mentioning that the Thika
Controller accepted the persons mentioning
half, the Controller may grant him permission to erect a
pucca structure, if the Controller is satisfied that the
thika tenant—
