101. Establishment and appointment of Ombudsman.
(1)There shall be an authority for the Gram Panchayats and the District Panchayats known as "Ombudsman" for conducting investigations and enquiries, in respect of any action involving corruption or maladministration or irregularities in the discharge of administrative functions by Panchayats and public servants working for them.(2)The Ombudsman shall be a single member body appointed by the Administrator by notification in the Official Gazette, on the recommendation of a Committee constituted by the Administrator from a panel of eminent persons of impeccable integrity from civil society.(3)The Committee referred to in sub-section (2) shall comprise of thefollowing:-(a)State Election Commissioner, who shall be the ex officio Chairman;(b)a retired district Judge;(c)a retired civil servant not below the rank of Additional Secretary to the Government of India;(d)two civil society members nominated by the Administrator.(4)A person appointed to be the Ombudsman shall, before he enters upon his office, make and subscribe before the Administrator or some person appointed in that behalf by him, an oath or affirmation according to the form prescribed.(5)The Ombudsman shall not be a serving Government Officer.
