Chhattisgarh Municipal (Public Disclosure Law) Rules, 2012Published vide Notification No. F-5-8/18/2011, dated 14th September, 2012Last Updated 15th October, 2019Notification No. F-5-8/18/2011 dated the 14th September, 2012. - In exercise of the powers conferred by Section 131-C read with Section 433 of the Chhattisgarh Municipal Corporation Act, 1956 (No. 23 of 1956) and Sections 122-B read with Section 355 of the Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961), the State Government, hereby, makes the following rules, namely :-

1. Short title, extent and commencement.

(1)These rules may be called the Chhattisgarh Municipal (Public Disclosure Law) Rules, 2012.
(2)They shall come into force from the date of their publication in the Official Gazette.
(3)These rules shall apply to all Municipal Corporations, Municipal Councils and Nagar Panchayats.

2. Definitions.

- In these rules, unless the context requires otherwise,(a)"Act" means in case of Municipal Corporation the Chhattisgarh Municipal Corporation Act, 1956 (No. 23 of 1956) and in case of Municipal Council and Nagar Panchayats the Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961);(b)"Competent Authority" means in relation to Municipal Corporation, the Municipal Commissioner, and in relation to Municipal Council and the Nagar Panchayat, the Chief Municipal Officer;(c)"Form" means the form appended to these rules;(d)"Information" means the information listed in column 2 of the Schedule attached to and forming part of these rules;(e)"Municipality" means Municipal Corporation, Municipal Council or Nagar Panchayat as the case may be;(f)"Public Disclosure" means the disclosure of information according to the mode listed in column 5 of the Schedule attached to and forming part of these rules;(g)"Public Information Officer" means the officer so designated in the Municipality under the Right to Information Act, 2005 (22 of 2005);(h)"Schedule" means the Schedule attached to these rules and forming part of it.
(2)Words and terms not defined here shall have the same meaning as defined in the Act.

3. Appointment of Nodal Officer.

(1)Within thirty days of coming into force of these rules, the Competent Authority in all Municipalities shall appoint the Public Information Officer as Nodal Officer for ensuring due compliance of the provisions contained in these rules.
(2)In the absence of the Public Information Officer for any reason whatsoever, the Competent Authority may appoint another officer not below the rank of Class-II as the Nodal Officer under these rules.
(3)If nobody has been appointed as Nodal Officer under sub-rule (2), the Competent Authority will be deemed to be the Nodal Officer under these rules.

4. Public Disclosure of Information.

- It shall be the duty of the Nodal Officer to ensure that information as specified in column (2) is disclosed in the mode specified in column (5) on form specified in column (4) at periodicity specified in column (3) within the time limit specified in column (6) of the Schedule.

5. Non-compliance to constitute dereliction of duty.

- Non-compliance of any of the provisions contained in these rules shall constitute dereliction of duty, punishable in accordance with the Service Rules governing the defaulting officer.
