5. Employees of the Commission.
(1)There shall be a Secretary of the Commission who shall be appointed by the State Government from amongst the persons holding a post not below the rank of the Deputy Secretary in the Administrative or Legal Service of the State Government.[Provided that in case of non-availability of an officer, the State Government may, by order appoint a teacher or an officer of a Government college, Government-aided college or State-aided University to act as the Secretary to the Commission, on such terms and conditions and for such period as may be determined by the State Government.] [Added by West Bengal Act No. 26 of 2017, dated 30.6.2017.](2)The Secretary of the Commission shall be an ex officio Member and be designated as the Member Secretary of the Commission.
