JUDGMENT
All these Writ Petitions are filed by autonomous colleges/managers of autonomous colleges affiliated to Calicut University aggrieved by the refusal on the part of the University of Calicut to issue orders as directed in the judgments of this Court in the respective writ petitions filed by them in the light of the judgment of this Court in Principal Rajagiri College of Social Sciences, Kakkanad v. M.G.University & Ors. [2016 (4) KHC 489]. As common issue is involved, all these writ petitions are disposed of by this common judgment. The parties and documents referred to in this judgment are as described in W.P.(C) No.38450 of 2018.
2. W.P(c).No.38450/2018 and W.P.(C). No. 28511 of 2018 are filed in respect of St.Joseph College, Devagiri- one by the College and the other by the Manager. The St.Joseph College, Devagiri has been functioning for the last 62 years. The University Grants Commission (UGC) recognised it as a centre with potential for excellence in the year 2011. W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :6: The college was conferred autonomous status as per Ext.P1 order issued by the UGC in July, 2014. Grievance of the petitioner is that despite the amendment of the Calicut University Act by University Laws (Third amendment) Ordinance, 2014, the University is insisting that affiliation is necessary for approval for commencement of new academic programmes as provided in Chapter 23 of the Calicut University First Statutes, 1977, which, according to the petitioner, is in gross violation of the provisions contained in Chapter VIIIB of the Calicut University Act, 1975 (hereinafter referred to as `the Act' for short) as well as the provisions contained in UGC guidelines, 2017 ('guidelines' for short) and the provisions contained in UGC (Conferment of Autonomous Status upon Colleges and Measures for Maintenance of Standards of Autonomous Colleges) Regulations 2018 ('UGC Regulations 2018' for short).

After conferment of autonomous status to the college, the governing council of the college had, as per Ext.P2 proposal dated 30.04.2018, made recommendations for new academic programmes of BSc Psychiology, B.A English- Language and Literature and an additional batch of B.Com (Finance) from 2018-19 academic year, before the 1st W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :7: respondent University. As per Ext.P3 order dated 17.05.2018, the University rejected the proposal stating that the college did not submit application for affiliation of new programmes within the time frame and also that concurrence from the Government is necessary. The petitioner thereupon challenged the same in W.P(C).No.17853/2018 and as per Ext.P4 judgment dated 25.06.2018 this Court set aside Ext.P3 order and directed the University to place the recommendation before the Board of Studies to take a decision in regard to the grant of additional affiliation to the new programme, in the light of the judgment in Principal Rajagiri College of Social Sciences, Kakkanad v. M.G.University & Ors. [2016 (4) KHC 489] and to take appropriate decision within the outer limit prescribed for such application under Section 68Q (2) and (3) of Chapter VIII B of the University Laws (Third Amendment) Ordinance, 2014 (Calicut).
4. The case of the petitioner is that even though the judgment was handed over on 29.06.2018, no decision was taken or communicated to the petitioner college. It is pointed out that under the provisions contained in Section 68 Q(3) the University has to take a decision within 30 working days from the date of receipt of the proposal. W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :8: Since the decision was not taken, the Manager of the College filed W.P(C).No.28511/2018 seeking the benefit of the said deemed provision. In W.P.(C) No.38450 of 2018, petitioner seeks a declaration that the University is bound to follow the provisions in Exts.P8 and P9 guidelines issued by the UGC and Ext.P10 Regulations as well as the provisions contained in Chapter VIII B of the University Act, for the purposes of commencement of new academic programmes and that provisions under Chapter 23 of the University Act are not applicable for the same, as held in Rajagiri College's case.

In W.P(C).No.28511/2018 the University has in their statement stated that as per the provisions contained in Chapter 23 of the Calicut University First Statutes, 1977, sanctioning of any programmes can be considered only on the submission of statutory application form within the time frame as prescribed. But the petitioner's college did not submit any application for starting any programme within the prescribed time. It is stated that concurrence from the Government is necessary for starting a new programme whether in aided or unaided stream; the petitioner college is an aided college with autonomous status. Therefore, it is stated that the University continues to have all the W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :9: powers on the autonomous colleges as in the case of other affiliated colleges except that autonomous colleges which have the right to formulate their own syllabus for an academic programme subject to the approval of the University. It is stated that the provisions contained in Section 68Q (2) to (7) of the Act do not relate to affiliation of any programme; it only relates to formulation of syllabus for an academic programme and autonomous colleges have to follow the procedures of the University for getting affiliation to a new programme. It is stated that all the programmes requested by the petitioner were already having University approved syllabus; the placing of the syllabus before the Board of Studies is required only if a different syllabus is forwarded by the college; the Board of Studies has no role in the process of granting of additional affiliation and it is empowered with the formulation of syllabus and regulation of existing academic programmes. It is further stated that on the basis of directions of this Court, the application submitted by the petitioner was placed before the Board of Studies for their decision. They discussed the matter of additional affiliation of courses in petitioner college and resolved that the matters related to W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :10: affiliation of a programme do not come under the purview of Board of studies and thereupon the Vice Chancellor ordered to place the request of the petitioner before the syndicate for considering the matter of affiliation of colleges/programmes and syndicate meeting held on 06.09.2018 considered it and deferred the matter. It is further stated that any program in any affiliated college can be sanctioned only after considering the statutory application from the college within the time frame prescribed under Chapter 23 of First Statute, 1977 and under clause 9(g) of Chapter 23, the syndicate would take a decision after considering the report of the local enquiry and after ascertaining the views of the Government and that shall be reported to the Senate. In the absence of such a statutory application from the petitioner college, there is no valid application for the Academic Year 2018-19. It is further stated that as the State Government has not implemented the UGC (Conferment of Autonomous Status Upon Colleges and Measures for Maintenance of Standards of Autonomous Colleges) Regulations, 2018, autonomous colleges under the Calicut University continue to be governed by the Calicut University Act and the University Laws (Third Amendment Act) 2014 and the applicable Statutes and W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :11: Regulations made thereunder.
6. According to the petitioner, the stand of the University is contrary to the intention of the UGC as well as the various provisions contained in Section 68 E & 68 Q. It is also their case that the regulation for the Choice based Credit Semester System for Undergraduate Curriculum 2009 passed by the Academic Chancellor of the Calicut University defines 'programme' "to mean the entire course of study and examinations (traditionally referred to as course) and 'course' to mean a segment of subject matter to be covered in a semester (traditionally refers to as paper) and 'duration of programme' to mean the period of time required for the conduct of the programme and that duration of an undergraduate programme shall be six semesters distributed in a period of 3 years. Therefore, relying on Ext.P6 Curriculum 2009 it is pointed out that 'programme' means syllabus, even after the amendment of those regulation by Ext.P7 in 2014.
7. According to the petitioner, affiliation is not required for any academic programme in an autonomous college. The Board of Studies of the University has to scrutinise the proposal forwarded by the governing council of the college and syndicate does not have any role in W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :12: respect of commencement of new academic program in autonomous colleges. It is their further case that in view of the provisions contained in Sections 2(f), 12 and 14 of the UGC Act 1956, the Universities have to comply with the recommendations, as well as the guidelines and regulation issued by the UGC from time to time. Ext.P8 guidelines for autonomous colleges during the XIIth plan period are therefore to be followed by the University. As per these guidelines autonomous college which are having permanent affiliation with the University need not apply for affiliation at the time of introduction and any new subject to be started by an autonomous college shall be covered under the autonomous scheme. Ext.P9 guidelines issued in 2017 also mandate the University to facilitate introduction of new course of studies in autonomous colleges. Over and above all these, as per Ext.P10 UGC Regulations 2018 the autonomous colleges have to reduce its existing courses/programmes and restructure, redesign and prescribe its own courses/programmes of study and syllabi and it is free to start new degree or postgraduate course/Ph.D with the approval of the academic council of the college on condition that the courses should fulfil the minimum standards prescribed by the University/UGC in terms of the W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :13: hours, curricular content and standards and University need only be informed about the commencement of the course and no affiliation is required.

It is also pointed out that Regulations 2018 do not require implementation by the Govt. of Kerala as was required for UGC (Minimum Qualifications for appointment of teachers and other academic staff in Universities and Measures for the Maintenance of Standards in Higher Education) Regulations, 2010 and UGC has as per Ext.P11 letter dt.2.4.2018 addressed all the autonomous colleges to adhere to the Regulations 2018. Therefore, it is stated that the UGC Guidelines 2017 as well as the Regulations 2018 are having statutory force which prevail over the University Act and statutes. It is also pointed out that the University Laws (Third Amendment) Ordinance, 2014 prevails over other provisions of the Calicut Universities Laws in respect of matters covered by Chapter VIIIB of the Act and therefore affiliation is not required as contended by the University. The petitioner points out that any delay in commencement of the courses for want of a decision from the University would affect it as it will lose the funding from Rashtriya Uchchatar Shiksha Abhiyan, the centrally sponsored scheme providing strategic funding to eligible W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :14: higher educational institutions.
9. The stand of the University continues to be the same as in the statement Ext.P5. According to the University the provisions relating to the affiliation apply to the autonomous College also. It was argued that an autonomous college cannot commence any course without getting affiliation. If at all it is to commense such course it has to be in separate premises without utilising the infrastructure for the aided institution. It is also their case that in order to award the degree to the students, the college has to obtain affiliation after submitting the prescribed application. It is also argued that the role of the University cannot be limited merely to stamp the decisions of the autonomous colleges. It is also pointed out that whenever a new course is started in a college it has to obtain sanction from the Government as the autonomous college continues to be an aided college, and that sanctioning of any post for the course or program can only be by Government and salary is to be paid by the Government.
10. In this case the University has not communicated any decision to any of the colleges. However petitioners collected the copy of the minutes of the meeting of the W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :15: Board of Studies of the Universities under the Right to Information Act 2005. Along with IA No.1/19 in W.P.(C) No.28511 of 2018, petitioners have produced the minutes of the Board of Studies (UG) held on 25.07.2018. From this minutes it is seen that the proposals submitted by two autonomous Colleges- St.Josephs College Devagiri and that of Christ College Irinjalakuda were placed for consideration pursuant to the directions in W.P.(C) No. 17853/2018 and 12830/2018. The Board of Studies in its meeting held on 26.07.2018, considered the matter and resolved as follows:
"The autonomous colleges should follow the procedures of University for getting affiliation to new programme. The word 'academic programme' in the University Act 1975 does not mean affiliation of a programme but refers to the syllabus of a programme. Moreover affiliation does not come under the purview of the Board of Studies so as to take resolution in the meeting. Item no.2 was: syllabus approval of complementary course of BA Criminology and Police Science, which the Board of Studies approved. In Ext P15 minutes the of the meeting of Board of Studies held on 26.07.2018 the Board of Studies examined the syllabus of B.Com (Finance) for Devagiri College and B.Com (Logistics) for Christ College. The Board of Studies resolved that it has no objection in the matter of University in sanctioning the programmes to the respective College.
11. Ext.P16 minutes produced along with the I.A No.1/2019 is with respect to the consideration of the proposal of the St.Thomas College, Trissur by the Board of Studies in its meeting convened on 27.07.2018 pursuant to W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :16: the judgment of this court. The Board of Studies resolved that the grant of additional affiliation to new programmes does not come under the purview of the Board of Studies. Pointing out this it is stated that the Board of Studies of Psychology and Commerce had as per Exts.P11 and P12 minutes in the meeting held on 25.07.2018 and 26.07.2018 resolved that the Autonomous Colleges have to get affiliation in order to start a new programme. Petitioners point out that the said decision is contrary to the judgment of this Court. In the minutes it was stated that the word 'Academic Programme' in the University Act, 1975, does not mean affiliation of a programme but refers to the syllabus of a programme and affiliation does not come under the purview of the Board of Studies so as to take resolution in the meeting.
12. Petitioners pointed out that the decision of the Board of studies is not so far communicated and hence they are not in a position to challenge those decisions. It is seen that the Board of Studies considered the proposal but they took the view that affiliation is necessary. That part of the decision cannot be correct as the matter is settled by judgment in Rajagiri's case. They have also taken the view that programme and syllabus are different. Relying on W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :17: Ext.P17-Calicut University Regulations for Choice Based Credit and Semester System for Under Graduate Curriculum- 2014, petitioners pointed out that the University has replaced the term "course" with the term "programme."
13. WP(C) No.29667/2018 is filed by the Manager of St.Thomas College (autonomous), Thrissur which was conferred autonomous status as per Ext.P1 order therein in June 2014. The governing council had as per Ext.P2 letter forwarded the recommendations of the governing council to the University on 10.05.2018 for commencing new academic programmes of BA English Literature, BA Criminology & Police Science. As per Ext.P3 letter dated 23.05.2018, the University rejected the same on the ground that application for affiliation were not submitted in the prescribed form within the time frame and concurrence from Government was not obtained for commencement of new programme. It was further stated that DLIC inspection in respect of the application for additional affiliation submitted for the academic year 2018-19 and 2019-20 has been completed and further action on the application can be proceeded only on the basis of the recommendation of the DLIC and approval of the Syndicate. It was informed that no programme can be granted by the University in an affiliated College without W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :18: undergoing the statutory requirements and without concurrence from the Government. The petitioner in WP(C) No.29667/2018 filed WP(C) No.19619/2018 which was disposed of as per Ext.P4 judgment dated 25.06.2018 setting aside Ext.P3 communication of the University and directing the University to place the application before the Board of Studies in the light of the judgment in Rajagiri College's case. The University did not communicate the decision even after the 30 days time. Writ petition was filed seeking the benefit of deemed approval.
14. WP(C) No.12830/2018 is filed by the Christ College Irinjalakuda which is also an Autonomous College. The College was conferred with autonomous status in July 2015. The 2nd petitioner forwarded the recommendation and approval of the Governing Council of the College for commencing new academic programmes of B.Sc Mathematics (Additional Batch), B.Sc Psychology (Additional Batch) and B.Com (Logistics) to the 2nd respondent for placing it before the relevant Board of Studies of the University as per Ext.P2 letter dated 26.03.2018. The College did not receive any response. The petitioners seek a direction to the University to place the proposal before the relevant Board of Studies and to consider the same in accordance with the procedure W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :19: prescribed in Section 68Q of Chapter VIIIB of the Universities Laws 3rd Amendment Ordinance 2014 (Calicut). During the pendency of the writ petition the University issued a communication Ext.P11 on 23.04.2018 informing that there is no valid application submitted by the College for the year 2018-19 for additional affiliation of any programme and that concurrence from Government also was necessary. It was therefore informed that request of the College for starting new programme for the year 2018-19 cannot be considered. It was also stated that the syllabus forwarded in respect of BCom Logistics was forwarded to the General and Academic branch for taking further necessary action on the matter as contained in section 68Q of Calicut University Act, 1975 Chapter VIII B. The petitioners are challenging Ext.P11 rejection made on 23.04.2018 on the ground that the same is in violation of Section 68Q(1) and pointing out that affiliation is not required as held in the judgment of this Court in Rajagiri College's case.
15. The petitioners also rely on the judgment in 2015 (2) KHC 551 in which it was held that the directions issued by the UGC are in exercise of its powers under the UGC Act 1956 and are hence are binding on the State Universities. Therefore, the University is bound to follow the W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :20: Regulations, 2018.
16. It is the further case of the petitioners that the Governing Body of the College includes a State Government nominee apart from nominees from UGC and University and therefore any decision passed by the Governing Body of the Autonomous Colleges is supposed to be with the concurrence and no further concurrence is required. It is pointed out that autonomous status is conferred only on aided and Government Colleges in Kerala. Petitioners seek application of the 2nd proviso to Section 68Q(3) under Chapter VIIIB of the University Act. The University has not filed any statement in this writ petition.
17. Even though the learned Standing Counsel for the University raised objections as to the fact that the colleges have not challenged the decisions taken by the University though it is produced along with I.A, the learned counsel for the petitioner points out that the decisions have been produced when it was obtained under the RTI Act and it is the statutory duty of the University to communicate the orders on it which the University has not done. The learned Standing Counsel also objected to the reliefs sought which are of general in nature.
18. The UGC has filed a statement producing the 2018 W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :21: Regulation in WP(C) No.38450/2018 in which they have stated that autonomous institutions do not require any further affiliation from the University specifically pointing out the role of the parent University provided in 2018 Regulations and pointing out the provisions contained in clause 10, according to which the autonomous institution is free to start diploma or certificate courses without prior approval of the University but with the approval of the statutory bodies of the Colleges. It also provides that the College can start new Degree or Post Graduate course/PhD with the approval of the Academic Council of the College and concerned Statutory Council(s) whenever required, provided the nomenclature of the Degree is in consonance with the UGC notification on Specification of Degrees, 2014 as amended from time to time.
19. I have heard Sri.Isaac, the learned Counsel for the petitioner, Sri.P.C.Sasidharan, the learned Standing Counsel for the University and Sri.S.Krishnamoorthy, the learned Standing Counsel for the UGC.
20. The question relating to the requirement of affiliation for an autonomous college is already concluded in the judgment in Rajagiri College of Social Sciences' case (supra), which is upheld in the judgment in W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :22: W.A.No.1708/2016. In that case M.G University had insisted affiliation for commencement of a new program. In the judgment in Rajagiri College's case (supra) this Court found that the intention behind grant of autonomous status by the UGC to the colleges are the following:
9. The guidelines so read would indicate that the UGC essentially is aiming at de- centralisation of the structured curriculum education, enabling higher standards in the autonomous institutions, since in the present circumstances, often, the University is unable to give individual attention to the affiliated Colleges. This de
-centralisation would also ensure the course completion in the duration prescribed for the course, publication of results within time and the grant of degrees and diplomas with expedition; which again is a problem the various Universities in the Country, currently face; by reason only of the enormity of the number of students and the varied courses conducted.
21. Regarding the contention as to requirement of application for affiliation under Chapter XXIII of the First Statutes it was held as follows:
15. Looking at the UGC guidelines and Chapter IX newly introduced into the Act, this Court is unable to countenance such a contention. That would be a retrograde measure directly in conflict with the envisioned progressive device of de -
centralisation attempted by the scheme for autonomy. A plain reading of sub-section (1) of S.118 as extracted herein above would indicate that autonomous colleges and affiliated Colleges are treated different and distinct by the Statute; as is the intention disclosed from the Guidelines of the UGC also. The words employed in the above extracted sub-section would indicate that the University would have powers over 'the autonomous colleges as are applicable to any affiliated colleges', which, on a plain interpretation, would indicate that both are treated distinct and different.
16. What is discernible is that the other provisions of the Statutes regarding control over the functioning; except on the academic aspect would be available to the University. Even with respect to the academic aspect, an autonomous institution is obliged to follow S.118 and get approval from the University. W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :23: When such approval is granted by the Board of Studies, on the basis of an examination of the course content and syllabus as approved by the Governing Council of the institution, then directing the Institution to get a further affiliation would be reintroducing the rigmarole, sought to be avoided. The interpretation can only be this; since, as noticed above, the University does not in fact give an approval with respect to the standards of the academic programme adopted by the institution, with even the certificate indicating the name of the autonomous institution in which the student has undertaken the course and from which he / she has passed out.
22. Provisions contained in Section 118 in MG University Act are in pari materia with Section 68Q of Calicut University Act , which read as follows:
"68Q(1). Subject to the provisions of this Chapter and the provisions of the Statutes, Ordinances, Regulations, Bye - laws and Rules made thereunder, the University shall have all other powers over the Autonomous Colleges as are applicable to any affiliated College of the University under this Act, the Statutes, Ordinances and the Regulations made thereunder.
23. After analysing the provisions contained in Section 118 of MG University Act it was held that when the recommendation of the Council of an autonomous college are submitted to the University, the University has to place the same before the Board of Studies of the University. Under the first proviso the University is to constitute a Board of Studies or an expert committee in case a particular academic programme proposed and recommended by a college council is not available in the University. Under the second proviso, the expert committee has to facilitate W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :24: a fair and objective assessment of the academic programme. The Board of studies or the expert committee shall within 30 days from the date of receipt of the proposal consider the same and approve, reject or return the same with remarks to the Vice Chancellor. The grounds on which rejection can be made are provided in the first proviso to sub section 3. At the same time, second proviso provides for a deemed provision which enables the autonomous colleges to consider the academic programme having been approved by the University in case the decision of the Board of Studies has not been communicated within 30 working days. It was held that even if the University does not communicate the rejection order within 30 working days, there is a definite mandate cast on the University to place the proposal before the Board of Studies and to ensure its consideration within 30 working days from the date of receipt of the proposal and if such a decision of the Board of Studies is brought on record, it should be within the specified 30 working days.
24. In this context it is relevant to note Section 68Q(2) and (3) along with the 1st proviso which read as follows:
"(2) Where the Governing Council of an autonomous college W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :25: has approved and recommeded any academic programmes to the University the Vice Chancellor shall cause the proposal to be placed before the relevant Board of Studies of the Univeristy:
Provided that where there is no Board of Studies with respect to the academic programme proposed, the University shall constitute a Board of Studies or an Expert Committee for the purpose.
Provided further that the Expert Committee so appointed shall have adequate number of members to facilitate a fair and objective assessment of the Academic programme submitted by the University.
(3)The Board of Studies or the Expert Committee as the case may be, shall within thirty working days from the date of receipt of the proposal, consider it for the Academic Programme referred to in subsection 2 and approve, reject or return the same, with remarks to the Vice Chancellor.
Provided that such rejection shall be on the ground that the proposal received from the Governing Council of an Autonomous College does not conform to the duration, number of credits, evaluation and grading system for that academic programme already prescribed by the University or where the Board of Studies or the expert committee feels, for reasons to be recorded in writing that the proposal of the Governing Council of an Autonomous College will have the effect of lowering academic standards".
25. Therefore, the only ground on which the proposal could be rejected is if the academic programme does not conform to the duration, number of credits, evaluation and grading system for that academic programme already prescribed by the University. Otherwise the Board of Studies or the expert committee should be of the opinion that it would have the effect of lowering the academic standards. The reasons to come to such a conclusion is also to be recorded. No such opinion is formed by any of these authorities. Therefore the refusal to grant approval for W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :26: want of application for affiliation is unsustainable, being contrary to the provisions contained in the proviso to S.68Q(3) of chapter VIIIB of the Calicut University Act and contrary to the direction in Rajagiri's case as well as the direction in the judgment in the writ petitions filed by the petitioners in these cases.
26. The next question to be considered is whether the view of the University with respect to "academic programme"
which according to University can only mean syllabus of a programme and not affiliation of a programme is correct and whether it can stand in the way of the statutory duty on the Board of Study to take a decision on the recommendations placed before it for commencement of new academic programmes. Ext.P7 Regulations would show that it applies to all undergraduate programmes under faculties conducted by the University of Calicut from 2014-15 including UGC programmes and programmes conducted in a college under the choice based credit and semester system.
As per Regulation 3.1 thereof, programme means 'entire course of study and examinations for award of a degree (traditionally referred to as course)'. Course is defined under regulation 3.5 to mean a segment of a subject matter to be covered in a semester(traditionally referred to as W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :27: paper). At any rate a decision is required on the proposal by the Board of Studies. That consideration has to be undertaken as provided in the provisions contained in subsection (3) of Section 68Q read with the proviso thereto.
27. Subsequent to the judgment in Rajagiri College, 2017 Guidelines and 2018 Regulations are issued by the UGC, which are also liable to be followed by the Universities. Ext.P9 UGC Guidelines for Autonomous Colleges, 2017 were issued by UGC in modification of Ext.P8 Guidelines for Autonomous Colleges during the 12th planning period. The guidelines provides for the role of the parent Universities over the autonomous colleges, under clause 2. The parent University has to promote academic freedom of the College by encouraging introduction of innovative academic programmes; to facilitate new courses of study, to depute various nominees of the University in various committees of the College, etc. Clause 10 provides for starting of new courses. Even in Ext.P8 Guidelines it was provided under clause 14 that "autonomous colleges due to their permanent affiliation with the University need not apply for affiliation for new subjects at the time of introduction. Any new subject to be started by an autonomous college W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :28: shall be covered under autonomous scheme". Clause 3 of Ext.P9 UGC Guidelines 2017 provides that the relationship of the autonomous college with parent University would be in the manner it is conducive for the development of the college with the ultimate aim of converting it into a college of Eminence. Clause 12 of Ext.P9 guidelines 2017 provides that Autonomous Colleges need not pay affiliation fees to the parent University every year. One time fees can be paid at the time of conferment of autonomous status which can be decided by the Executive Council of the parent University.
28. As per 2018 Regulation- Ext.P10, published in the gazette dated 12.02.2018, the Autonomous Colleges are to review existing courses/programmes and restructure, redesign and prescribe its own courses/programmes of study and syllabi. It shall formulate new courses/programmes within the nomenclature specified by UGC as per the Specification of Degrees 2014 with the name of the College on the degree certificate. It shall evolve methods of assessment of students performance, conduct of examinations and notification of results. It shall announce results, issue mark sheets, migration and other certificates; however, the Degree shall be awarded by the University with W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :29: the name of the College on the Degree Certificate. The courses introduced by the College after conferment of the autonomous status shall automatically come under the purview of autonomy. Clause 4.3 provides that the College on attaining autonomous status will continue to be affiliated to the affiliating University but will enjoy the privileges of autonomy. As per clause 5.2 the State Government will continue to provide the same funds to Government/Aided colleges as they had been providing before the conferment of autonomous status. Clause 10 relates to starting of new courses. As per clause 10.1 an autonomous college is free to start diploma (undergraduate and postgraduate) or certificate courses without prior approval of the University. However approval of the concerned statutory bodies of the College may be obtained, wherever required. Diploma certificates shall be issued under the seal of the College. The University should, however, be informed about such introduction of new courses. Clause 10.2 provides that an autonomous college is free to start a new degree or postgraduate course/PhD, with the approval of the Academic Council of the College and concerned Statutory Council, wherever required, provided the nomenclature of the Degree is in consonance with UGC Notification on W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :30: Specification of Degrees, 2014 as amended from time to time on condition that such courses shall fulfill the minimum standards prescribed by the University/UGC in terms of number of hours, curricular content and standards and the University shall be duly informed of such courses. Under clause 10.3 an Autonomous College may rename an existing course as per the UGC Notification on Specification of Degrees, 2014 as amended from time to time after restructuring/redesigning it with the approval of the College Academic Council as per UGC norms. The University should be duly informed of such proceedings. The UGC had as per Ext.P11 letter dated 02.04.2018 requested all the stakeholders including the Autonomous Colleges and the affiliating Universities to ensure strict compliance of the provisions mentioned in the Regulations 2018.
29. The UGC Regulations, 2018 are issued in exercise of the powers of UGC under Section 12(j) read with Section 26(1)(f) and (g)of the UGC Act,1956, which is enacted to ensure coordination and determination of standard in institutions of higher education and the regulations are issued pursuant to the directives of the Central Government on National Policy of Education. Section 12(j) provides for the functions of the UGC for advancing the cause of higher W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :31: education in India. Section 26(1)(f) confers power on UGC to make regulations defining the minimum standards of instruction for the grant of any degree by any University and under clause (g) for regulating the maintenance of standards and co-ordination of work or facilities in universities. The University as well as the autonomous colleges are bound by these guidelines and regulations issued by the UGC. Ext.P8 guidelines were issued on the basis of UGC document on the XII plan profile of higher education. It was found that the only safe and better way to improve the quality of education is to delink most of the colleges from the affiliating structure. The need for autonomy is described as follows in Ext P8.
Need for Autonomy The affiliating system of colleges was originally designed when their number in a university was small. The university could then effectively oversee the working of ) the colleges, act as an examining body and award degrees on their behalf. The system has now become unwieldy and it is becoming increasingly difficult for a university to attend to the varied needs of individual colleges. The colleges do not have the freedom to modernize their curricula or make them locally relevant. The regulations of the university and its common system, governing all colleges alike, irrespective of their characteristic strengths, weaknesses and locations, have affected the academic development of individual colleges. Colleges that have the potential for offering programmes of a higher standard do not have the freedom to offer them. The 1964- 66 Education Commission pointed out that the exercise of academic freedom by teachers is a crucial requirement for development of the intellectual climate of our country. Unless such a climate W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :32: prevails, it is difficult to achieve excellence in our higher education system. With students, teachers and management being co-partners in raising the quality of higher education, it is imperative that they share a major responsibility. Hence, the Education Commission (1964-66) recommended college autonomy, which, in essence, is the instrument for promoting academic excellence.
30. Any delay in taking a decision on the proposal will be contrary to the very purpose for which the colleges are conferred with autonomous status. The University is duty bound to encourage commencement of innovative academic programmes in such colleges. In view of these guidelines and Regulations 2018, the role of the University is as provided in Section 68(Q), according to which the proposal cannot be rejected except when the programme does not conform to that of a programme under the University or if it is lower in standard.
31. Therefore, the Board of Studies are only supposed to take a decision on the proposal relating to the academic programme strictly in tune with the proviso to Sub Section (3) of Section 68Q. Therefore these writ petitions are liable to be allowed.
The University shall place the proposals of the Governing Councils of the respective colleges again before the Board of Studies for approval of the academic W.P(C) Nos.38450 of 2018-E, 12830 of 2018-C, 28511 of 2018-L and 29667 of 2018 :33: programmes for a decision afresh in accordance with Section 68Q(3) of Chapter VIIIB of the Calicut Univeristy Act, in tune with the judgment in Rajagiri College (supra) and the University shall communicate the decision to the Colleges within the statutory period, without insisting application for affiliation.
