All three OAs have been filed on 24.04.2023 under Section 19 of the Administrative Tribunals Act, 1985 against the order passed by the respondents by which the claim of overtime allowance has been rejected. For the sake of convenience, the facts are taken from OA No. 171/2023.
2. The OA No. 171/2023 has been filed by 83 applicants who retired from service during the period from 31.12.2011 to 31.03.2023.

As per applicants' case, all applicants are the retired employees who worked as Escorting and Maintenance staff worked in AC (Air Condition) coaches in short worked as (ACCM) AC Coach Mechanics and (ACCA) AC Coach Attendants (re-designated as Assistant) of Bangalore Division, South Western Railway worked at Bangalore city (SBC) and Yeshwanthpur (YPR) Depot.
4. The applicants are seeking the overtime allowance w.e.f. the year 2005 till the date of their retirement (between the period from 31.12.2011 to 31.03.2023). In para 4, the list of all employees along with their date of superannuation is also mentioned.
5. It is again submitted by the applicant that their duties are related to AC coaches of Express, mail and passenger trains operating between Bangalore Division to various destinations all over India. The duties of the said staff being about an hour before the train is about Bangalore / Yeshwanthpur and it ends only when the said train returns to Bangalore / Yeshwanthpur, after completing the said journey. According to the applicants, ACCM and ACCA resume their duties at Bangalore / Yeshwanthpur. In between the said journey the Escorting staff i.e. ACCM and 55 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE ACCA are not relieved from their duties at any given point of time. Thus, the said staff remains on duty round the clock till they return to the starting point.
6. In para 4.2 of the OA the duties of ACCM are mentioned and in para 4.3 the duties of ACCA are also mentioned. As per applicants, their nature of work is such that they are continuously on duty till the time the train is back to Bangalore / Yeshwanthpur. The said staff is not relieved during the travelling period. The taking over of charge and handing over of charge is done only at Bangalore / Yeshwanthpur base station from where the train is schedule to start. ACCM and ACCA staff report to duty about one hour before the departure of the train to take charge of their duties and relieved of their duties only one / two hours after returning to Bangalore / Yeshwanthpur.
7. The applicants submitted that they are entitled to overtime allowance. The Mumbai bench of C.A.T also granted the same relief which was confirmed by the Hon'ble High Court and the Hon'ble Apex Court. Same relief was also granted by Secunderabad Bench and that is also confirmed by the Hon'ble High Court and the Hon'ble Apex Court. The other Benches of the 56 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE C.A.T including Bilaspur, Jabalpur, Ernakulam have also granted the same relief to the similarly situated employees. Therefore, the applicants are also entitled to the same relief as granted in other Divisions of Railways.
8. The respondents opposed the claim of the applicants and submitted that as per Rules they are not entitled to get the overtime allowance. They supported the impugned order dated 23.03.2023 passed by the respondents upon the representation of the applicants. It is also submitted by the respondents that the order Annexure - R1 which is related to the computation of duty hours of Air Conditioned Coach Attendants and in-charges dated 27.06.1985 has not been challenged by the applicants. Most of the applicants came before the Court after a long time. Any application for condonation of delay has not been filed. Therefore, the applicants who were retired more than three years back from the date of filing this petition are not entitled to get any relief. It is also submitted that the employees who filed the petition within three years are also not entitled to get the overtime allowance as per the prevailing Rules of the Railways.

9. Previously, OA No. 496/2022 was filed by 81 applicants. The Division Bench of this Tribunal passed the judgment in the aforesaid OA on 03.01.2023. In the aforesaid judgment, the Tribunal took the note of the judgment passed by the Hon'ble High Court of Mumbai and Telangana, confirmed by the Hon'ble Apex Court and thereafter the Bench gave the direction to the Respondent No.1 to consider the representation dated 18.10.2022 submitted by the applicants and to pass a reasoned and speaking order having regard to judicial orders referred in the judgment.
10. In compliance of the aforesaid order of the Tribunal, the impugned order dated 23.03.2023 has been passed and the respondents rejected the claim of the applicants. In para 4 to 10, the respondents considered the relevant Rules and stated as under:-
"(4) I have gone through the law, Subsidiary Rules and Railway Board instructions issued from time to time on the subject. The regulation of Hours of Work and Period of Rest is governed by Chapter XIV of the Railways Act, 1989.
As per this Act, every Railway Servant has been categorized into either of four categories i.e. 'Continuous', 'Essentially Intermittent', 'Excluded' and 'Intensive'. Applicants have been categorized as 'Continuous' under 58 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE Section 130 (a) of the Railways Act, 1989. It is also laid down under Section 133(1)(a) of said Act that:
"whose employment is intensive or continuous shall, for every week commencing on a Sunday, be granted a rest of not less than thirty consecutive hours"
(5) Under the delegation made under Section 136 of the Railways Act, 1989, Railway Ministry has framed subsidiary rules to govern hours of employment and period of rest. These subsidiary rules are called 'the Railway Servants (Hours of Work and Period of Rest) Rules, 2005', which have been circulated vide RBE No.131/2005, dated 09.08.2005. As far as 'Over Time Allowance' (OTA) is concerned, as per Rule. 10(1) of these rules:
"Where a Railway servant is required to render extra hours of duty beyond the rostered hours fixed in accordance with rule 8 or beyond the limits specified for different classes of Railway servant under section 132, he shall be paid overtime for such extra hours of work, subject to the principle of averaging as specified in sub-rule (2)"
(6) In terms of aforementioned provisions quoted in Para.5, OTA is admissible only for extra hours of work, and not for the halt period, during which, you are not doing any work.

OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE (7) I have also gone through the provisions of Rules 1502 & 1503 of Indian Railway Establishment Code Volume-II. Rule 1502 clearly specifies that OTA is an allowance paid to Railway Servants for actual time worked in excess of the hours of employment prescribed by any law or rule. Moreover, Rule 1503 stipulates that the Railway servants Hours of Employment Regulations specify the classes of staff in respect of which a Railway administration is under an obligation to pay OТА when such staff are called upon to work in excess of the number of hours prescribed under the said Regulations. From your averment, it is not clear that you have been called upon to work in excess of number of hours prescribed.
(8) In the representation, you have only made a claim that you have been continuously working for more than 104 hours in 14 days roster without submitting any proof. Further, you have requested to count the 'halt period' spent out the station.
(9) In this connection, Railway Board has laid down in terms of Para.2 (ii) of RBE No.157/2005, dated 27.06.1985:
"At out station, at the end of their outward journey, they may be allowed one hour to complete the procedure for handing over the coach to the outstation maintenance staff. They will hand over the loose items under their possession, e.g. linen, 60 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE tumblers, flasks etc to the maintenance staff and take over the same when they take over charge at the commencement of train journey. They may take rest in the AC coach itself wherever rest facilities have not been made available to them in the nature of a running/rest room. They may be allowed one hour to take charge of the coach from the maintenance staff before the commencement of train journey"
Divisions have been following the above directions scrupulously, and, therefore it is seen that you have been provided adequate resting facilities.
(10) As per statutory provision under the Railways Act, 1989 and statutory subsidiary rules, you have not averred that you have done duty during halt period, rather you only affirm that the halt period to be counted for the purpose of OTA. Therefore, you are not entitled 'Over Time Allowance' as per the statutory rules for the period rest."
11. In the impugned order the respondents also took the note of judicial order passed by the Mumbai Bench and the Hon'ble High Court of Mumbai. In para 12 and 13, the concerned authority mentioned as under:-
"(12) It is seen from the orders passed by Hon'ble High Court/Mumbai in Writ Petition No.9227 of 2011, dated 17.01.2012 as under:61
OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE "The order passed by the Tribunal is a well considered order. The Tribunal has considered the provisions of Rule 1502 in paragraph 9 of its order. It has recorded a finding in paragraph 13 that when the train halts, the Respondents are actually guarding the train and also helping the subordinate staff in carrying out the maintenance operation. Therefore, it is clear that during the halt time also, the staff is working and therefore they have been rightly held entitled to over time allowance. No interference is called for in the impugned order."
(13) Since, the Hon'ble High Court/Mumbai had relied upon Para.9 of CAT's order in OA No.117/2008 of Hon'ble CAT/Mumbai, dated 07.03.2011, the same is reproduced as under:
"The respondents have, however, submitted that this letter is written by a Group-C employee but nonetheless its contents make it evident that the period of halt at destination on outbound trains is duly taken into consideration for calculating wages, TA and DA, but not counted for the purpose of overtime allowance for the said period. There is no reason/logic given by the respondents to deny this overtime claim preferred by the applicants in the facts and circumstances of the case. Para.1502 of Indian Railway Establishment Code is relevant and is reproduced herein below:62
OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE 1502 - Overtime allowance is an allowance paid to Railway servants for actual time worked in excess of the hours of employment prescribed by any law or rule.""
12. After taking into consideration, the respondents rejected the claim of the applicants and stated in para 14, 15 & 16 as under:-
"(14) From the judgments it is very apparent that it only relates to (i) payment of OTA for guarding the train at out station and also (ii) payment of OTA for the period spent on assisting the maintenance staff at out station. Moreover, the above pertains to Central Railway and cannot be a basis for grant of OTA to SWR staff. Your terms of duty are governed by RBE No.157/2005, dated 27.06.1985 as quoted in para.9 above. Hence, the question of OTA does not arise.
15) In view of the aforementioned legal provisions, administrative instructions, facts of the case and also taking into account of judicial orders, it is decidedly clear that you are not a similarly situated staff as mentioned in the orders of Hon'ble CAT/Mumbai OA No.117/2008, which was confirmed by Hon'ble High Court of Mumbai and Hon'ble Supreme Court. In view of the aforementioned law and facts, your representation for OTA is inadmissible.
(16) Your representation dated 18.10.2022 stands disposed off.63

13. The claim of the applicants is mainly based upon the judgment passed by the C.A.T Bombay Bench. The OA No. 117/2008 was filed before the C.A.T. Bombay Bench which was decided on 07.03.2011 (Annexure - A3). In the aforesaid case, the applicants were working as A.C. Coach Mechanics (ACCM) and A.C. Coach Attendants (ACCA). The fact shows that the duties are the same. In para 9 the Bench of Bombay took a note of para 1502 of the Indian Railway Establishment Code in which it is provided:-
"1502. Overtime allowance is an allowance paid to railway servants for actual time worked in excess of the hours of employment prescribed by the law or rule."
14. In para 11 of the said case, the Bench considered the judgment passed by CGIT on 02.04.1996. In the case before CGIT, it was raised by three groups of employees namely - High Scale Electric Fitters, A.C. Coach Attendants and Helper Khalasis. The Court granted the relief in their favour and CGIT passed the direction to grant the allowance for the halt period. The said judgment of CGIT dated 02.04.1996 was challenged by the Railway administration before the Hon'ble High Court by filing 64 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE the Writ Petition Nos. 1728/1998 and 1775/1998. The Single Judge of the Hon'ble High Court dismissed the Writ Petitions by order dated 12.06.2003.
15. The Railway preferred the appeal No. 338/2004 before the Division Bench of Hon'ble High Court which was also dismissed on 28.06.2004. Thereafter, the Railways filed the SLP before the Hon'ble Apex Court but the same was also dismissed on 11.04.2005.
16. In the light of the aforesaid judgments, the C.A.T Bench of Bombay granted the relief and also observed in para 13 & 14 as under:-
"13. Turning to the facts of the present case, it is noted from the pleadings and records that the applicants are not only never relieved after they take charge of the train at Mumbai Central till they return back after return journey, but they are also required to guard the AC Coach and help the secondary maintenance staff for setting right any defect which could have developed during the outward journey in order to avoid complications in return journey back to Mumbai Central. The contents of the letter dated 28.02.2002 are extremely relevant, although written by Sr. Section Engineer under whom the major operations take 65 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE place. The respondents have not brought out any material to prove that there is any handing over or taking over from the applicants at the destination where the train halts for a considerable period before returning to Mumbai. In fact, the applicants, i.e., ACCMS and ACCAs, are not allowed to leave the train unguarded and go anywhere. It amply proves that they are on duty throughout till they return to Mumbai Central and hand over the charge.
14. In view of the above facts and circumstances as revealed from the pleadings and materials placed by both the parties before the Tribunal, the applicants are held entitled to claim Overtime wages for the said halt period. However, the claim of the applicants to get actual arrears is restricted to three years prior to the filing of the present O.A. It is further directed that members of Applicant No. 1's association shall present to the respondent's relevant details of their travelling, including the halt period in question, within a period of two months from the date of passing of this order and the respondents shall calculate the overtime wages according to rules and pay the arrears to the applicants within a period of another two months thereafter, duly taking into consideration the halt period in question."
17. The aforesaid judgment passed by Single Bench of C.A.T Mumbai on 07.03.2011 in OA No. 117/2008 was challenged before the Hon'ble High Court of Bombay by filing the Writ 66 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE Petition No. 9227/2011 (Annexure - A4) which was dismissed by the Division Bench of the High Court on 17.01.2012 by a short order as under:-
" Heard.
2. The order passed by the Tribunal is a well considered order. The Tribunal has considered the provisions of Rule 1502 in paragraph 9 of its order. It has recorded a finding in paragraph 13 that when the train halts, the Respondents are actually guarding the train and also helping the subordinate staff in carrying out the maintenance operation. Therefore, it is clear that during the halt time also, the staff is working and therefore they have been rightly held entitled to over time allowance. No interference is called for in the impugned order. The Petition is rejected. No costs."
18. Against the judgment of Hon'ble High Court of Bombay the Railways also preferred the Special Leave to Appeal (C) No. 18333/2012 before the Hon'ble Apex Court. The Apex Court also dismissed the SLP vide Annexure - A5 in which the Court said:-
"Heard.
We see no merit in this petition.
The special leave petition is accordingly dismissed."67

19. Escorting and maintenance staff in Air conditioned coaches working between Hyderabad / Secunderabad and various destinations all over the country also filed the OA No. 631/2016 before C.A.T Hyderabad Bench. Their claim was also rejected by the Department. The C.A.T Bench of Hyderabad decided the case on 28.09.2018 and placed the reliance upon the judgment passed by C.A.T Bombay which was confirmed by the Hon'ble High Court as well as the Hon'ble Apex Court. The Court also took a note of judgment passed by the Hon'ble High Court of Chhattisgarh in Writ Petition No. 4098/2018 preferred against the judgment passed by Bilaspur Bench of C.A.T in OA No. 705/2016. In para 8 of the aforesaid judgment, the Hyderabad Bench observed as under:-
"8. The case is all about treating the halt period as on duty or otherwise. The respondents claim that the secondary maintenance staff do take over the maintenance and other allied activities at the destination station. However, it is understood from the arguments and the material submitted that the applicants are relieved from duty only when they reach the originating station after they complete the entire trip. In other words, they are on duty from the originating station till they return to the same station. The respondents also did not file any material to 68 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE prove the fact that they are being relieved at the destination station. The letter of the Sr. Section Engineer, Central Railway dated 28.08.2002 clearly indicates that the ACCM/ ACCA staff are not being relieved at the destination point. Learned counsel for the applicants has informed that unlike for the running staff, the applicants are not provided any rest rooms and hence, they have to invariably reside in the coaches only. The respondents could not produce any evidence or letter indicating that the applicants have been provided rest rooms on par with other running staff. Further, Rule 1502 of IREM provides for OTA which is described as allowance paid to railway servants for actual time worked in excess of the hours of employment prescribed by any law or rule. The claim of the learned counsel for the respondents is that the letter written by the Senior Section Engineer should not be given much credence as this is a policy decision which has to be decided by the competent authorities. Even if the Tribunal were to agree with the argument of the learned counsel for the respondents, yet it is an admitted fact that the applicants are not being relieved at the destination station, which is an indication that they are on duty during the halt hours involved. Learned counsel for the respondents stated that the applicants do get TA and DA at the destination station point. TA is given as an allowance for travel and dearness allowance for meeting the incidental expenses at the destination station. However, for extra work done, overtime allowance has to be allowed. Therefore, the 69 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE provisions of Rule 1502 of IREM applies to the applicants fully. The learned counsel for the applicants claims that for any theft of items like fans, lights, etc., responsibility is fixed on the applicants and they are proceeded against. Besides the case of the applicants is fully covered by the judgment of the Hon'ble Bombay Bench of this Tribunal in OA 117/2008 and Bilaspur Bench of this Tribunal in OA 705/2016 which dealt with the objection raised by the learned counsel for the respondents regarding the letter dt. 28.08.2002 written by the Sr. Section Engineer, Central Railway. Hon'ble High court of Judicature at Bombay in WP No.9227/2011 as well as the order of the Hon'ble Supreme Court of India in Special Leave to Appeal (C) No.18333/2012 confirmed the order of the Bombay Bench of this Tribunal favouring grant of OTA at destination station. Further, the findings of the Hon'ble Bilaspur Bench of this Tribunal in OA No. 705/2016 and also the findings of the High Court of Chhattisgarh, Bilaspur in WP (S) No. 4098/2018 come to the rescue of the applicants in depth. It is also important to note that Railways being a single entity, extending a benefit to one segment of employees under a particular zone and denying to those in another zone performing similar duties and belonging to the same category is discriminatory. Hon'ble Supreme Court has directed the respondent organization, in a similar case wherein running allowance was granted to Northern Railway staff but not to Eastern Railway staff, to extend the same to the Eastern Railway staff as well in WP 70 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE (C) No. 939 to 945 of 1983, vide judgment dated July 20th 1988. Hence, the respondents are duty bound to extend the same benefit in view of similarities of duties as discussed in the present case between those of South Central Railway and Central Railway. Thus, as seen from the above, law is well settled in regard to the issue in question. The facts discussed confirm that the applicants are on duty at the destination station."
20. After observing as above, the C.A.T Bench of Hyderabad placed reliance upon the Hon'ble Apex Court judgment passed in Sub-Inspector Rooplal vs. Lt. Governor, (2000) 1 SCC 644 and came to the conclusion that the same relief should be granted because the judgment of Co-ordinate Bench should be respected. In paras 10 & 11, the Court passed the following order:-
"10. To conclude, based on the facts narrated above, the OA fully succeeds. Therefore, the letter No.SCR/P- SC/OT/341 dated 04.05.2016 issued by the 2nd respondent is quashed. The respondents are directed to consider payment of OTA to the applicants treating the halt period at destination station as duty henceforth and also pay the OTA arrears to the applicants on similar terms and conditions from the date when the similarly placed staff (ACCM/ACCA) have been paid in Central Railway, within 71 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE a period of three moths from the date of receipt of copy of this order.
11. Further, respondents may also consider this order as judgment in rem and apply the same to other similarly situated ACCM/ACCA staff who are not parties to this OA and those who fulfil the terms and conditions discussed in the present case, as the same would avoid multiplicity of litigation. In fact, the Hon'ble Apex Court in Amrit Lal Berry Vs. CCE, 1975 (4) SCC 714 and Inder Pal Yadav Vs. Union of India, 1985 (2) SCC 648 held so and the V CPC in para 126.5 also emphasized such a practice."

The respondents of that case of Hyderabad Bench preferred the Writ Petition No. 7564/2019 before the Hon'ble High Court of Telangana at Hyderabad and the High Court dismissed the writ petition on 07.04.2021. The Court confirmed the judgment passed by C.A.T Bench of Hyderabad by observing as under:-
" The respondents are working as ACCMs and ACCAs in the South Central Railway, and their claim is that they assume duties on the departing trains from Hyderabad/Secunderabad to various destinations, and are relived only when they return back to Hyderabad/Secunderabad, attending to duties viz., safety, 72 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE custody and security of fittings, working of AC plant / alternators, maintaining log book, ensuring comfortable temperatures, check fuses, rectify AC faults etc. Their further claim is that they report to duty one hour before the train departs from the original station, and also at the destination station, and they are with the coaches even at the destination station, attending to maintenance and other allied activities, in keeping the coach ready for travel. As they are working beyond their schedule hours, they are entitled to OTA.
Their further case is that when a similar claim of ACCMs and ACCAs for OTA, was rejected by the Central Railways, those employees filed O.A.NO.117/2008 on the file of the Central Administrative Tribunal at Bombay Bench, and the said claim was allowed, and assailing the same, the Central Railways filed W.P.No.9227/2011 and the same was dismissed, and even the Special Leave to Appeal ( C ) No.1833 of 2012 filed by the Railway Administration, was dismissed by the Apex Court vide order dated 23.02.2015.
The applicants before the Tribunal also relied on a judgment of the Apex Court in W.P. (C) No.939 to 945 of 1983 dated 20.07.1988 and also on the judgment of High Court of Chhattisgarh, Bilsapur in W.P.(S) No.4098/2018 dated 30.07.2018, wherein similar claims were allowed. The Tribunal following the above judgments allowed the O.A., and also following the judgments of the Apex court in AMRIT LAL BERRY vs. CCE1 and INDER PAL 73 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE YADAV vs. UNION OF INDIA2 directed the petitioners herein to extend the benefit to the similar situated employees, as the same would avoid multiplicity of litigation.
The learned counsel for the petitioners could not dispute that the issue is covered by the judgments of the Apex Court.
In view of the same, and having regard to the facts and circumstances of the case, we do not find any merit in the writ petition and the same is accordingly dismissed, confirming the impugned order of the Tribunal."
22. Special Leave to Appeal (C) No. 2498/2022 was also preferred by the respondents before the Hon'ble Apex Court but the Apex Court dismissed the aforesaid SLP on 11.03.2022 and said:-
"The special leave petition stand dismissed. Pending application(s), if any, stands disposed of."
23. Therefore, it appears that the order passed by the C.A.T. Mumbai Bench and C.A.T Hyderabad Bench were confirmed by the respective Division Benches of the High Court and the SLP preferred against the aforesaid judgments were also dismissed. 74
OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE
24. Annexure - A10 dated 22.10.2021 shows that the order was finally implemented by the Secunderabad Division.
25. The applicants also cited the judgment dated 30.07.2018 passed by the Hon'ble High Court of Chhattisgarh, Bilaspur in Writ Petition No. 4098/2018 which was preferred against the order dated 22.02.2018 passed by the C.A.T Bench of Chhattisgarh in OA No. 705/2016. In the aforesaid case, the applicants were working as AC Helper - I in the Electrical (General) Department, AC Wing in the South East Central Railway, District - Durg. The Jabalpur Bench of C.A.T (circuit sitting at Bilaspur) granted the relief in favour of the applicants on 22.02.2018. The Division Bench of High Court also took a note of circular dated 27.06.1985 issued by the Railway Board and said in paras 5, 6 & 7 as under:-
"5. Submission of the counsel for the Railways is that the Tribunal committed a serious error by not taking into consideration the distinguishing fact between the Bombay case and the Bilaspur case which is a Railway Board's Circular RBE/157/85 dated 27.6.1985. Counsel places emphasis on paragraph ii) of the said Circular, which reads as under:-
"ii) At outstation, at the end of their outward journey, they may be allowed one hour to complete 75 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE the procedure for handling over the coach to the outstation maintenance staff. They will hand over the loose items under their possession, e.g. linen, tumblers, flasks etc. to the maintenance staff and take over the same when they take over charge at the commencement of train journey. They make take rest in the AC coach itself wherever rest facilities have not been made available to them in the nature of a running/ rest room. They may be allowed one hour to take charge of the coach from the maintenance staff before the commencement of train journey."
6. From a reading of the above, Railway Board's Circular as well as the other provisions in relation to duties of ACCA's or ACCI's, entitlement of overtime allowances is not a matter of argument. Situations have been perceived where a Railway employee can be treated to be on duty after duty hours in the given condition and for which he will be suitably compensated by award of overtime allowances. We do not see much of a difference in the view so taken by CAT Benches so far as the entitlement of overtime allowances being claimed by employee is concerned. But, it will always be subject to the employee establishing before the employer that he comes within the do's and the don'ts which can justify such claims.
7. We, therefore, do not find any error in the order of the Tribunal in holding that the private Respondent could be entitled to overtime allowances, but the Tribunal itself has 76 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE observed that such calculation on a claim made has to be in terms of the Rules and payment would be required to be made thereafter within a time frame. "
26. Therefore, the Hon'ble High Court of Chhattisgarh confirmed the judgment of C.A.T Bench of which was passed upon the judgment of C.A.T Bench of Bombay.
27. The counsel for applicants also cited Abid Hussain & others vs. Union of India & others 1987 AIR SC 820 decided by the Hon'ble Apex Court on 22.01.1987. In the aforesaid case, the Hon'ble Apex Court says:-
" It is not disputed that the Air-conditioned Coach In- charges Attendants are being paid overtime allowances for extra duty hours exceeding 96 hours in two weeks in the Western Railway, Central Railway and Eastern Railway. There is no justification for denying overtime allowances on the same basis to the Air-conditioned Coach Incharges-Attendants in the Northern Railway. We accordingly direct the Union of India and the Railway Administration to pay with effect from July 1, 1984 the overtime allowance to the Air-conditioned Coach Incharges-Attendants working in the Northern Railway on the same basis on which the Air-conditioned Coach In- charges-Attendants in the other three Railways, referred to above, are paid. All arrears of such allowances upto date 77 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE shall be paid as early as possible and in any event not later than four months from today. The benefit of this order shall be extended to all such employees including those who have retired and those who have not joined as petitioners herein."

In the case of Jaikrishan Narayan & others (total - 62 applicants) vs. Union of India OA No. 131/2019 decided by the Ernakulam Bench of C.A.T dated 31.08.2022 also placed the reliance on the judgment passed by the Bombay Bench of C.A.T. The aforesaid case was also related to the AC Coach Attendants and AC Technicians. The C.A.T came to the conclusion that the claim raised by the applicants is acceptable. After taking into consideration the judgment of C.A.T Bench Bombay the Court allowed the OA and said in para 11:-
"11. On an evaluation of the materials on record, I have no doubt that the applicants are entitled to get a declaration that they are eligible to claim overtime allowance at the destination station for the halt period. The respondents shall reckon such halt period for payment of overtime allowance and shall pay such allowances due to the applicants as per law. However, it is made clear that such claim shall be limited to the past three years prior to date of filing of this O.A."78
OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE
29. The applicants cited the judgment passed by the Division Bench of C.A.T Kolkata Bench in OA No. 338/2018 decided on 22.06.2023. In the aforesaid case, the Bench came to the conclusion that the speaking order has not been passed. Therefore, the Bench said that the order passed by the authorities as such is bad in law and liable to be quashed. It is argued by the applicants that in the present case, the speaking order has not been passed. Therefore, it is liable to be quashed.
30. But in the view of Court, the impugned order date 23.03.2023 shows that all the points have been considered by the concerned authorities. It is a different matter that the claim has been denied. Speaking order does not mean the order should be passed in favour of the applicants only. It is submitted by the applicants that in para 11 five judgments were quoted but the concerned authority did not consider the two judgments. It appears that the judgment of C.A.T Bench Bombay has been considered. The Hyderabad Bench judgment was passed upon the basis of the judgment of Bombay Bench. Therefore, it cannot be presumed that sufficient consideration has not been given. 79

31. It appears that the applicants are the similarly situated employees who were applicants in the case of C.A.T Bench Bombay, C.A.T Bench Hyderabad and the case of Ernakulam, Chhattisgarh, etc. If the employees are similarly situated and the relief claimed is the same, then as per law same relief should be granted in favour of employees who are working in another Division of Railways. In Union of India & others vs. Munshi Ram 2022 Live Law (SC) 891, judgment dated 31.10.2022 the Hon'ble Supreme Court considered the aforesaid aspect in paras 7 & 8 and came to the conclusion that the Railway Staff working in different zones / divisions should be treated similarly and equally. In para 7 & 8, the court observed as under:-
"7. It cannot be disputed that employees working in different divisions/zones in the Railways are under the very same employer - Railway Board which is under the Ministry of Railways. There are 16 Zones and 68 Divisions in the Railways. Therefore, the employees working under the same employer - Railway Board working in different Zones/Divisions are required to be treated similarly and equally and are entitled to similar benefits and are entitled to the same treatment. As rightly submitted on behalf of the respondents, there cannot be any discrimination inter se. Under the 80 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE circumstances, on the ground of parity, the Commission Vendors/bearers working in the Northern Railway are entitled to the same benefits which are held to be entitled to all the similarly situated Commission Vendors/Bearers working under different Zones/Divisions. There cannot be different criteria/parameters with respect to similarly situated employees - Commission Vendors/bearers working in different Zones/Divisions, but working under the same employer.
8. The Railways/UOI/Railway Board cannot be permitted to repeat the same arguments which were raised before different Tribunals, High Courts and also before this Court. Under the circumstances, the respondents - Commission Vendors/bearers working in the Northern Railway shall also be entitled to the same benefits which the other Commission Vendors/bearers working in different Zones/Divisions are held to be entitled to. There cannot be discrimination among the similarly situated Commission Vendors/bearers. To deny similar benefits would tantamount to discrimination and in violation of Articles 14 and 16 of the Constitution of India."
32. Therefore, it appears that the observations made in the impugned order have been duly considered at different stages of the litigation before the different High Courts as well as C.A.T 81 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE Benches. Any new ground is not found for taking a different view. As per aforesaid case of Munshi Ram (supra) the same relief should be granted to the applicants before this Tribunal.
33. One more question also remains in this case which is about the limitation. The respondents strongly opposed the claim and said that most of the applicants filed their case after three years from the cause of action. Any application for condonation of delay has not been filed. Therefore, relief should not be granted. On the other side, it is submitted by the applicants that the cause of action is a recurring cause of action, therefore, the reliefs should be granted.
34. It appears from the record that any details of journey performed by the applicants have not been given. The allowance paid to one journey is absolute. Overtime allowance is not a part of pay or pension. If the amount is not paid for one complete journey then the cause of action will arise and the claim should be filed within one year from the date of arising the claim. The aforesaid cause of action cannot be treated as a "recurring" cause of action. Therefore, the applicants who retired more than three years back from the date of filing this petition i.e. 24.04.2023 are 82 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE not entitled to get any relief. It appears from the various judgments quoted above that the arrears have been granted only for the period of three years. In this regard, the judgment passed in Union of India vs. Tarsem Singh 2008 (SCC) 648 may be seen. In the aforesaid case, the claim was filed after 16 years and the Court restricted the arrears only for the period of three years.
35. It is also submitted by the learned counsel for the applicants that the representation of the applicants was decided by the impugned order dated 23.03.2023. Therefore, the cause of action had arised on the same date. But this argument cannot be accepted. The aforesaid representation was filed after a long time. In compliance with the previous order of the C.A.T Bench the aforesaid representation has been decided. In the case of Nahar Singh vs. Punjab State Power Corporation Limited and others, 2024 (3) SLR 573 (Punjab & Haryana) dated 20.02.2024, it has been said that if the Court or Tribunal directs for consideration of representation relating to a stale claim or dead grievance, it does not give rise to a fresh cause of action. It is also a settled law that making the repeated representation is not a satisfactory explanation of the delay. In the aforesaid case, the 83 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE Court considered the Hon'ble Supreme Court judgment passed in State of Uttaranchal and another vs. Sri Shiv Charan Singh Bhandari and others, 2013 (6) SLR 629, C. Jacob vs. Director of Geology and Mining and another, (2008) 10 SCC 115, Union of India and others vs. M. K. Sarkar, (2010) 2 SCC 59, Karnataka Power Corporation Ltd. vs. K. Thangappan and another, (2006) 4 SCC 322, State of Orissa vs. Pyarimohan Samantaray, (1977) 3 SCC 396, Union of India & another vs. Manpreet Singh Poonam etc., 2022 (4) SCT 550 and the other cases also. Therefore, it is clear that the deciding date of the representation or the filing date of representation cannot extend the limitation.
36. The cases of C.A.T Bombay Bench and Hyderabad Bench were related to the working employees but in the present case in OA No. 171/2023 all the employees have been retired and the applicants in OA 172/2023 are the working employees and in OA No. 173/2023 all the applicants are working employees except Applicants No. 62, 63 & 64. They did not claim the aforesaid allowance at proper time.

37. Therefore, after consideration the following order is passed:-
ORDER
(i) The applicants who retired more than three years back before filing the OA on 24.04.2023 (i.e. retired before 24.04.2020) are not entitled to any relief therefore all the three OAs are partly dismissed in respect to the aforesaid type of applicants.
(ii) All the three OAs are partly allowed in reference to the applicants who retired within three years from the date of filing of the OA, (i.e. between 24.04.2020 to 24.04.2023) and those who are still working or retired after the date of filing the O.A. i.e. 24.04.2023.
(iii) The applicants who are entitled for overtime allowance will be entitled for the arrears of only 3 years prior to the date of filing the OA and will also be entitled the arrears from the date of filing the O.A. (i.e. 24.04.2023). They shall present the relevant details of their travelling including the halt period in question before the respondents within a period of three (03) months from the date of receipt of the certified copy of this order. Thereafter, 85 OA.Nos.170/00171, 00172 & 00173/2023/CAT/BANGALORE the respondents shall verify and calculate the overtime wages according to the rules and pay the arrears to the aforesaid applicants within a period of three (03) months, duly taking into consideration the halt period in question.
(iv) Parties shall bear their own costs.
