Section 11 in Telecom Regulatory Authority of India (Officers and Staff Appointment) Regulation, 2001

11. Seniority.

- (i) The relative seniority of members of the cadre appointed to any grade at the time of initial formation of the cadre shall be fixed by the Authority and unless decided otherwise on account of special reasons be governed by their relative seniority obtaining on the date of commencement of this Regulation.
(ii)All officers included in the initial formation of the cadre in any grade shall rank senior to all officers appointed to that grade subsequently unless an officer is appointed to a grade giving him specially a certain seniority in that grade [by the Authority] [Inserted by Notification No. 5-4/2000-A&P(Vol.II), (No. 4 of 2008), dated 31.12.2008.].
(iia)[ In the case of a person who is initially taken on deputation and absorbed later, his seniority in the grade in which he is absorbed will normally be counted from the date of absorption. If he has, however, been holding already (on the date of absorption) the same or equivalent grade on regular basis in his parent Department such regular service in the grade shall also be taken into account in fixation of his seniority, subject to the condition that he will be given seniority from - [Inserted by Notification No. 5-4/2000-A&P(Vol.II), (No. 4 of 2008), dated 31.12.2008.]
(A)the date he has been holding the post on Deputation; or
(B)the date from which he has been appointed on a regular basis to the same or equivalent grade in his parent Department,
whichever is earlier:Provided that the fixation of seniority of a transferee in accordance with the above principles will not, however, affect any regular promotions to the next higher grade made prior to the date of such absorption.]
(iii)The seniority of an officer not covered by the above provisions shall be determined by the Appointing Authority.
