Section 74 in Calcutta Improvement Act, 1911

74. Officers and servants of Tribunal. - (1) The President of the Tribunal shall, from time to time, prepare a statement showing -

(a)the number and grades of the clerks and other officers and servants [who] he considers should be maintained for carrying on the business of the Tribunal,(b)the amount of the salary to be paid to each such officer and servant, and(c)the contributions payable under section 146 in respect of each such officer and servant.
(2)The President of the Tribunal shall, from time to time, make rules -[(ai) prescribing the qualifications, the period of service, the age of superannuation and other conditions of service of the officers and servants of the Tribunal];
(i)for regulating the grant of leave of absence, leave allowances and acting allowances to the officers or servants of the Tribunal; and
(ii)for establishing and maintaining a provident or annuity fund, for compelling all or any of the officers of servants of the Tribunal (other than any [servant of the Government] in respect of whom a contribution is paid under section 146) to contribute to such fund, at such rates and subject to such conditions, as may be prescribed by such rules, and, with the sanction of the Board for supplementing such contributions out of the funds of the Board:
[Provided that a servant of the] [Government] employed as an officer or servant of the Tribunal shall not be entitled to leave or leave allowances otherwise than as may be prescribed by the conditions of his service under the [Government] relating to transfer to foreign service.
(3)All statements prepared under sub-section (1), and all rules made under sub-section (2), shall be subject to the previous sanction of the [State Government].
(4)Subject to any directions contained in any statement prepared under sub-section (1) and any rules made under sub-section (2), and for the time being in force, the power of appointing, promoting and granting leave to officers and servants of the Tribunal, and the power of reducing, suspending or dismissing them, shall vest in the President of the Tribunal.
