ORDER

1. The SWP No. 489/2011 & 1933/2018 & 112/2019 was transferred from the Hon'ble High Court of Jammu & Kashmir at Jammu and was registered as T.A No.6287/2021 & 8555/2020 & 920/2020 respectively by the Registry of this Tribunal.
2. The present matter was filed before the Hon'ble High Court seeking following relief: -
1. TA/6287/2021 CERTIORARI
a) Writ of Certiorari so as to set aside and quash the Advertisement Notice 01 of 2011 dated 31-01-2011 issued by respondents 1 and 2 to the extent it refers the post held by the petitioners to the SSRB for regular selection.
b) Writ of Mandamus directing the respondents to consider the cases of the petitioner for regularization in terms of Jammu and Kashmir Special Provision Act 2010 treating the post held by them as deemed to have been withdrawn and treating the petitioner as consolidated/contractual employees and submit their cases to the empowered committee in terms of Section 10 of the Jammu and Kashmir Civil Services (Special Provisions) Act 2010 for regularization with all consequential benefits treating their posts to have been withdrawn from the purview of Board by declaring Section 3 (b) of J&K Special provision Act 2010 as Illegal and violative of Article 14 of the Constitution of India.

d) Any other order, which this Hon'ble Court may deems fit and appropriate in the facts and circumstances of the case may also very kindly be passed in favour of the petitioner.
2. TA/8555/2020 Mandamus
a) Writ of Mandamus directing the respondents to allow the petitioner to continue till they complete 7 years of service and thereafter consider the cases of the petitioner for regularization in terms of Jammu and Kashmir Special Provision Act 2010 treating the post held by them as deemed to have been withdrawn and treating the petitioner consolidated/contractual employees and submit their cases to the empowered committee in terms of Section 10 of the Jammu and Kashmir Civil Services (Special Provisions) Act 2010 for regularization with all consequential benefits.

3. TA/920/2020
a) Mandamus commanding the respondents to consider the case of petitioner for regularization within a time span and consequently issue formal order of regularization in favour of petitioner as Instructor/ Computer Operator and Programming Assistant (COPA) at ITI Sunderbani District Rajouri with all pecuniary service benefits with retrospective effect from October, 2013 onwards.
b) Prohibition, restraining the respondents from disturbing the service of the petitioner in any manner;
c) Any other relief which this Hon'ble court may deem fit in the facts and circumstances of the case and in the interest of justice, equity and fairplay.
3. The facts of the case as pleaded by the petitioners in their pleadings are as follows: -
a) Some of the petitioners have been continuously serving in ITI in their respective places since 2005 till date without any break.
HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 9 ::TA 6287/2021 & 8555/2020 & 920/2020 The nature of the appointment of the petitioners is that of a consolidated employee on contractual basis who are fully covered under the provisions of J&K Civil Services (Special Provisions) Act, 2010. Section 2 (e) defines the consolidated appointee as under:-
2(e) "Consolidated appointee" means a person who has been appointed against any post under the Government on consolidated monthly salary/wage;"
Section 2 (i) defines the post as under:- "Post" means a post borne on the establishment of any Department of the Government.
Section 4 excludes from the purview of recruiting agencies- Notwithstanding anything to the contrary contained in any other law for the time being in force, the posts referred to under section 3 shall be, and shall always be, deemed to have been excluded from the purview of the recruiting agencies.
Section 5 provides regularization subject to the conditions laid down therein. It further provides completion of 7 years for such adhoc employees who may not have HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 10 ::TA 6287/2021 & 8555/2020 & 920/2020 complete seven years. Section 5 (V) proviso being relevant is being reproduced hereunder:-
Provided further that any adhoc or contractual or consolidated appointee who has not completed seven years service on the appointed day shall continue as such till completion of seven years and shall thereafter be entitled to regularized under this Act.
b) It is submitted that the petitioners have been treated as contractual/consolidated employees by the respondents since their first appointment and are fully covered under the Act.
Hence the posts occupied by the petitioners cannot be referred to as SSRB.
c) The petitioners in all the three Transfer Applications were initially engaged as Instructors in different Industrial Training Institutes (ITIs) under the Technical Education Department of the erstwhile State of Jammu and Kashmir. In TA No. 6287/2021, the petitioners were engaged pursuant to Advertisement Notices issued in the years 2005 and 2006-2007 inviting applications for engagement of Instructors on HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 11 ::TA 6287/2021 & 8555/2020 & 920/2020 consolidated basis. The advertisement dated 01.09.2005, published on 27.09.2005, and subsequent notices invited eligible candidates for engagement against various trades. The petitioners applied, were selected on the basis of merit, and were issued engagement orders by the competent authorities including the Deputy Director and the concerned Superintendents of ITIs. They were engaged on consolidated salary, initially fixed at Rs. 4,000/- per month, and continued from time to time with extensions granted by the department. Some of them were later sent for training and continued thereafter without interruption. Their engagements were extended pursuant to interim directions passed by the Hon'ble High Court in SWP No. 973/2008 and also in terms of Government Order No. 289-GAD of 2009 dated 19.02.2009 issued with reference to SRO 255 of 2003. The Director Technical Education, vide communication dated 07.12.2007, treated them as consolidated employees.
d) In the year 2010, the Jammu and Kashmir Civil Services (Special Provisions) Act, 2010 came into force, providing a HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 12 ::TA 6287/2021 & 8555/2020 & 920/2020 scheme for regularization of adhoc, contractual and consolidated employees who fulfilled the prescribed conditions. The petitioners claimed that they were covered under the said Act as consolidated/contractual appointees and were entitled to continuation till completion of seven years of service and thereafter regularization. However, instead of submitting their cases to the Empowered Committee constituted under Section 10 of the Act, the respondents referred the posts held by the petitioners to the Service Selection Recruitment Board (SSRB) and issued Advertisement Notice No. 01 of 2011 dated 31.01.2011 for regular selection against those posts. Aggrieved by the said action, the petitioners approached the Hon'ble High Court seeking quashment of the advertisement to the extent it covered the posts held by them and also seeking directions for regularization under the Act of 2010.
e) In TA No. 8555/2020, the petitioners were engaged in ITI Kathua between 2008 and 2016 under different schemes including Public Private Partnership (PPP) and Self-Finance mode in various trades such as Fitter, Plumber, Basic HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 13 ::TA 6287/2021 & 8555/2020 & 920/2020 Cosmetology, Electronics Mechanic and others. Engagement orders were issued by the Superintendent ITI Kathua with the approval of the competent authority. They were continued from time to time and some of them remained in service under interim protection granted by the Hon'ble High Court vide order dated 19.09.2018 in SWP No. 1933/2018 directing that they shall not be replaced by a similar set of employees. The petitioners asserted that though described as academic arrangement appointees, they were in substance consolidated/contractual employees engaged after advertisement and merit assessment, and therefore entitled to benefit under the Act of 2010 upon completion of seven years.
f) In TA No. 920/2020, the petitioner was appointed on 03.10.2006 as Instructor (COPA) in ITI Sunderbani after due advertisement and selection process on contractual basis against a clear vacancy. He continuously worked without break and completed seven years of service in October, 2013. He submitted representations dated 20.11.2013 and 20.01.2017 seeking regularization under the Act of 2010. His case was HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 14 ::TA 6287/2021 & 8555/2020 & 920/2020 recommended by the Superintendent and forwarded to higher authorities. It was also shown that the Empowered Committee in its 46th meeting held in April, 2015 had regularized similarly situated employees, but the petitioner's case was not placed before the Committee. Alleging discrimination and arbitrary exclusion, he sought regularization with retrospective effect from October, 2013.
4. The respondents have filed their reply statement wherein they have averred as follows:-
a) That PPP (Public Private Partnership) Scheme started in the year 2007-2008 at Government II Kathua whereby Four new trades were introduced which are as under: -
a. Fitter b. Plumber c. Basic Cosmetology d. Electronics Mechanic.
b) In order to run the training program smoothly under these trades, the candidates named below were engaged on academic arrangement basis in ITI Kathua and the Member Secretary HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 15 ::TA 6287/2021 & 8555/2020 & 920/2020 IMC/ Superintendent ITI Kathua issued engagement orders in their favor with the approval of Chairman IMC ITI Kathua/ DDJ/Director Technical Education J&K as under:-

c) The respondents, in their reply, raised preliminary objections stating that the petitioners were engaged purely on academic arrangement basis on honorarium of Rs. 4,000/- per month and not on contractual or consolidated basis. It was pleaded that the advertisement notices clearly mentioned that the engagement was for one academic session or till regular selections were received from the Service Selection Board, and that the appointees had executed undertakings that they would not claim permanent absorption. According to the respondents, the arrangement was purely temporary and automatically ceased upon regular selection.
d) It was further contended that the Jammu and Kashmir Civil Services (Special Provisions) Act, 2010 specifically excluded persons appointed on academic arrangement for a fixed term in any Government Department under Section 3(b) of the Act. Since the petitioners were engaged on academic arrangement basis, they were not covered under the Act and hence not entitled to regularization. The respondents denied that the petitioners were engaged under SRO 255 of 2003 as contractual HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 18 ::TA 6287/2021 & 8555/2020 & 920/2020 appointees and asserted that SRO 255 stood repealed by Section 15 of the Act of 2010. In respect of the PPP and Self-Finance engagements in TA No. 8555/2020, it was stated that some petitioners had already left the job and others were continuing only under court directions. It was also submitted that their engagement was scheme-based or session-based and not against regular sanctioned posts.
e) The respondents further relied upon the judgment of the Hon'ble Supreme Court in State of Karnataka v. Uma Devi to contend that temporary, academic arrangement or contractual employees have no fundamental right to claim regularization or absorption unless appointed in accordance with the recruitment rules. It was submitted that the petitioners were attempting to avoid regular recruitment through open competition and were seeking continuation without competing with other eligible candidates.
f) Thus, while the petitioners assert that they were engaged against clear vacancies through due process and treated as consolidated/contractual employees entitled to protection and HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 19 ::TA 6287/2021 & 8555/2020 & 920/2020 regularization under the Act of 2010 upon completion of seven years, the respondents maintain that the engagements were purely academic arrangements for fixed terms, expressly excluded from the purview of the Act, and that no enforceable right to regularization has accrued in their favour.
5. Heard learned counsel for the parties and perused the material available on record.
6. This batch of Transfer Applications raises a common issue. The petitioners were engaged as Instructors in different ITIs under the Technical Education Department. They were engaged after issuance of advertisement notices, consideration of merit and issuance of formal engagement orders. Though the department describes their engagement as "academic arrangement", the record shows that they were appointed against clear working posts, were paid monthly honorarium, their services were extended from time to time and they have continued for several years. Some of them have completed more than seven years of continuous service. Their work and conduct has not been shown to be unsatisfactory. They were permitted to continue HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 20 ::TA 6287/2021 & 8555/2020 & 920/2020 even under interim orders of the Hon'ble High Court and have been discharging the same duties as regular Instructors.
7. The main stand of the respondents is that the petitioners were engaged purely on academic arrangement for a fixed term and had executed undertakings that they would not claim regular appointment. It is further contended that Section 3(b) of the J&K Civil Services (Special Provisions) Act, 2010 excludes persons appointed on academic arrangement and therefore they are not entitled to regularization. The respondents also rely upon the judgment of the Hon'ble Supreme Court in Uma Devi to contend that temporary or contractual employees have no right to claim absorption.
8. Having considered the pleadings and record, this Tribunal is of the view that certain principles are well settled. First, a temporary or contractual employee does not have an automatic right to regularization unless covered by a statutory scheme. Secondly, the State cannot regularize appointments made in violation of Articles 14 and 16 of the Constitution. Thirdly, however, it is equally settled that a contractual employee cannot be replaced by another set of contractual employees. If the post continues and the work continues, HARSHIT Digitally signed by YADAV HARSHIT YADAV :: 21 ::TA 6287/2021 & 8555/2020 & 920/2020 the employer cannot remove one contractual employee and bring another similarly placed contractual employee in his place. Such action is arbitrary and violative of Article 14 of the Constitution.
9. In the present cases, the petitioners were not appointed through backdoor entry. Advertisements were issued, eligibility was examined and engagement orders were passed. Their services were continued year after year. The department cannot now say that they were merely casual hands without any recognition. The very fact that they were allowed to work for several years, and in some cases protected by court orders, shows that the need for the posts is continuing.

If the respondents intend to fill the posts through regular recruitment in accordance with rules by referring the vacancies to the recruiting agency and completing the selection process, they are fully competent to do so. The petitioners cannot insist that regular recruitment should not take place. However, till such regular selection is completed and regular appointees join, the petitioners cannot be replaced by another set of persons engaged on academic arrangement, self-finance or PPP mode. Replacing one contractual employee with another contractual employee is impermissible in law.

11. As regards regularization under the J&K Civil Services (Special Provisions) Act, 2010, it is true that Section 3(b) excludes persons appointed on academic arrangement for a fixed term. However, the Tribunal cannot ignore the substance of the engagement. If the petitioners were in fact engaged against clear vacancies, continued for more than seven years, and were treated as consolidated/contractual employees in departmental communications, their cases cannot be rejected merely by labeling them as academic arrangement without examining the factual position.

Therefore, the appropriate course is not to straightaway direct regularization, but to direct the respondents to examine each case individually in the light of the Act of 2010, the nature of appointment, the existence of clear vacancies and the length of service rendered. If any of the petitioners fulfills the conditions prescribed under the Act and is not hit by the exclusion clause in its true spirit, his or her case shall be placed before the Empowered Committee for consideration in accordance with law. Such consideration shall be completed within a period of four months from the date of receipt of this order.

13. Till regular selection is finalized and regular appointees join, the services of the petitioners shall not be terminated and they shall not be replaced by another set of similarly situated academic arrangement or contractual employees. However, this protection shall not prevent the respondents from filling the posts through proper regular recruitment process in accordance with rules.
14. The petitioners shall also be entitled to continuity of service for all service purposes during the period they have actually worked, but monetary benefits, if any, arising out of regularization shall depend upon the final decision taken by the competent authority.
15. With these directions, all the Transfer Applications are disposed of.
No order as to costs.
