Section 32 in The Orissa Municipal Delimitation of Wards, Reservation of Seats and Conduct of Election Rules, 1994

32. Procedure after nomination.

(1)The following provisions shall apply in respect of candidates who have been duly nominated and have not withdrawn their candidature in the manner and within the time specified in Sub-rule (1) of Rule 31.
(a)If there is only one candidate duly nominated for the office of Councillor for any ward of the Municipality, the Election Officer shall declare such candidate to be duly elected.
(b)If there is no candidate duly nominated election proceedings shall be started afresh for filling up the vacancy, in all respects as if for a new election :
Provided that if in respect of a particular ward reserved for the candidate belonging to the Scheduled Castes or to the Scheduled Tribes or for Women or for Backward class of citizens no nomination is filled by any such candidate to contest the election in respect of that ward the Election Officer shall forthwith report the fact through the Election Commission to the State Government for appropriate action under Sub-section (5) of Section 11 of the Act.
(c)If the number of candidates duly nominated exceeds that of the vacancy, a poll shall be taken.
(2)The Election Officer shall forthwith report the names of all candidates declared to be elected under Sub-rule (1) [to the Election Commission.] [Substituted vide Notification No.7141, Legislative-I-26/95 H.U.D Dated 7.3.96. O.G.E. No. 248 Dated 7.3.1996.]
