Section 81 in The Maharashtra Zilla Parishads and Panchayat Samitis Act, 1961

81. Election to Committees.

(1)No Councillor shall be elected on more than any [one Committee] [These words were substituted for the words 'two committees', by Maharashtra 6 of 1975, Section 24(1)(a).] (including the Standing Committee)[Provided that, where the total number of Councillors of any Zilla Parishad including the Chairman of all the Panchayat Samitis in the District is less than the number required to fill the number required to fill the number of members of all the Committees, a Councillor may be elected on two Committees, but only to the extent, necessary.] [This proviso was added by Maharashtra 6 of 1975 Section 24(1)(b).]

(3)Every election to a Committee (including the Standing Committee) shall be held in accordance with the system of proportional representation by means of the single transferable vote.
(4)[ In the event of a dispute arising as to the validity of the election of any Councillor under section 79 or section 80 (including any question arising out of the acceptance or rejection of a nomination paper on any ground, or whether or not a Councillor is a member of a Scheduled Caste, Scheduled Tribe or any [* * *] [Sub-section (4) was inserted by Maharashtra 35 of 1963, Section 33(2).] backward class of citizens) and Councillor may refer the dispute to the Commissioner, whose decision thereon shall be final :Provided that,-
(a)the dispute is referred to the Commissioner within a period of ten days from the date of the election of the Councillor;
(b)no decision shall be given against any Councillor without giving him a reasonable opportunity of being heard.]
