Section 1(4) in The West Bengal Preservation Of Historical Monuments And Objects And Excavation Of Archaeological Sites Act, 1957.
(4)Nothing in this Act shall apply to -(a)ancient or historical monuments or archaeological sites or remains declared by or under law made by Parliament to be of national importance; or(b)any ancient monuments or antiquities to which the ancient Monuments Preservation Act, 1904, applies on the date of the commencement of this Act or is made applicable after such date.
