ORDER
Per: Hina P. Shah, Judicial Member With the consent of learned counsels for the parties OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 are taken up together for disposal as common question of law and facts is involved in all these cases.
2. For the sake of convenience, the brief facts of OA No. 291/195/2020 (Anil Kumar Sharma & Ors. vs. Union of India & Anr.) are taken up. The OA No. 46 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 291/195/2020 has been filed by the applicants under Section 19 of the Administrative Tribunals Act, 1985 for the following reliefs:-
"8.1 That by a suitable writ/order or the directions the impugned Memo No. Rectt/2-
9/2019/Con/KW-2 dated 3/4/2020 be quashed and set aside being arbitrary, illegal, unjust and contrary to the provisions of Article 14 and 16 of the Constitution of India.
8.2 That further by a suitable writ/order or the directions, the respondents be directed to declare the result of the Departmental Examination for recruitment to the cadre of Postal Assistant / Sorting Assistant from eligible Postman (Group C) / Mail Guard /Dispatch Rider and MTS (Group D) cadre held on 15/9/2019 as has been declared by the other Circles.
8.3 That by a suitable writ/order or the directions, the respondents be directed to allow the promotion of PA/SA to the candidates who will be found successful with immediate effect and all the consequential benefits be allowed to them in pursuance to the representation dated 30/4/2020 submitted by the applicants.
8.4 Any other relief which the Hon'ble bench deems fit."

The brief facts of the case, as stated by the applicants, are that as per the Notifications dated 30.07.2019 (Annexure A/2) and 05.08.2019 (Annexure A/3) issued by Ministry of Communications, Department of Posts for Limited Departmental 47 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 Competitive Examination (LDCE) from Postman (Group C) / Mail Guard, Dispatch Rider and MTS (Group D) for recruitment to the cadre of Postal Assistants/Sorting Assistants in Postal Divisions/Units, RMS and MMS for the vacancy year 2019 and in pursuance of the said Notifications, examination took place for all 23 circles. There was one more Notification dated 10.05.2019 (Annexure A/4) by which the syllabus and pattern of examinations for appointment to various posts were revised. It was further stated that the examination was divided into three papers. Paper-I was competitive in nature, while Paper-II and Paper- III were qualifying. Paper-I and Paper-II were conducted in continuity on the same day and both these papers took place on 15.09.2019. It is further stated that after Notification dated 10.05.2019, other Notifications dated 20.06.2019 (Annexure A/5), 30.07.2019 and 05.08.2019 were issued for some changes. It is stated that identical question paper was given to the said examination and only one answer key was published on 10.01.2020 and results were declared on 24.01.2020. The qualified candidates were called for Data Entry Skill Test (DEST) on 09.02.2020. After completion of 48 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 examination process, 16 circles announced the result and promotions were given to the successful candidates. As all the applicants were fulfilling all the conditions in pursuance to the Notification, they appeared in the examination. As per Annexure A/7, all the applicants were declared as qualified as per the result dated 24.01.2020. Thereafter, the applicants were also found successful in the DEST. After completion of all formalities, the applicants were waiting for the final outcome. But it is surprising that only in Rajasthan Circle, the respondents cancelled the examination held in pursuance to the Notification dated 05.08.2019 and passed the impugned order dated 03.04.2020 (Annexure A/1) without assigning any reason. Such act of the respondents is against the principles of natural justice and in violation of Articles 14 and 16 of the Constitution of India. The applicants have filed their representations, but still the same have not been decided and, therefore, being aggrieved by the arbitrary action of the respondents, the applicants have filed the present Original Application for declaration of their result and other reliefs.

The respondents by their reply have neither disputed dates of Notification(s) nor about eligible candidates participating in the examination and nor about qualifying candidates being permitted to appear in Paper-III. It is their case that it came into light of the Competent Authority that the papers of the examination held on 15.09.2019 were leaked through unidentified sources. Being a modal employer, the respondents are bound by the Constitutional mandate of Equality as entrusted under Articles 14 and 16 of the Constitution of India and state that in the recruitment process, fair and equal opportunity be granted to every eligible candidate for the purpose of selection on the published post. Therefore, the competent authority seriously took into account the shortcomings of the instant recruitment process more particularly about the leakage of examination papers. Therefore, vigilance investigation was carried out and it was established that large scale malpractices and unfair means were undertaken in Rajasthan Circle and it was noted that it was very difficult to identify the candidates privy to the same. Therefore, the competent authority took a decision to cancel the whole selection process in Rajasthan Circle. 50 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 Accordingly, the whole examination process was cancelled vide impugned order dated 3.04.2020. Therefore, it is not fair on the part of the applicants to complain about individual misconduct as the same is not the foundation of impugned order. It is the contention of the respondents that the applicants have challenged the impugned order primarily on the ground that after having declared the result for Paper- I and Paper-II on 24.01.2020 and Paper-III on 09.02.2020 and after lapse of 06 months, without indicating any specific reason, cancellation of the examination on "administrative grounds" is highly improper. As it was impossible to identify the candidates, who used unfair means or were privy to the question paper, therefore, in compelling circumstances as the examination process was severely compromised and thus vitiated, the competent authority was left with no option but to cancel the said examination. Then as per directions of the Postal Directorate vide its letter dated 30.04.2020 (Annexure R/1) to complete the investigation and report the same to CBI, respondents have forwarded the matter to CBI vide letter dated 07.04.2020 (Annexure R/2) to lodge an FIR and investigate the 51 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 matter. It is further stated that the primary investigations revealed that serious irregularities/malpractices at large scale have been established including leakage of question paper was found. Since the examination process was compromised and vitiated, entire examination was cancelled. The respondents further stated that as per Rule 8(1)(h) of RTI Act 2005, "Information which would impede the process of investigation or apprehension or prosecution of offenders is exempted from disclosure," thus the information could not be supplied to the applicants. Also no reply was forwarded by the respondents to applicant's representation as the entire examination stood cancelled on administrative grounds and the Postal Directorate decided to hold the examination on 06.09.2020. Therefore, the action of the respondents about cancelling the entire recruitment process is just, proper and valid. Therefore, the present Original Application is without any substance and the same is not maintainable.
5. The applicants have filed a rejoinder denying the submissions of the respondents and further stated 52 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 that if the information with regard to the leakage of papers was received prior to the DEST Test, then why the result of rest of the Circles were issued as Paper-I was identical in all the Circles and in the era of whatsapp and other media sources, one cannot neglect the possibility of circulation of leaked papers across whole of the country within few minutes, therefore, cancellation of examination only in Rajasthan Circle is an arbitrary act and against principles of Equality. The applicants further state if the contention of the respondents is that due to leakage of question papers, the examination has been cancelled in Rajasthan Circle, then it is great discrimination on the part of respondents as the same leaked papers has been published in rest of the circles of India. Therefore, as Paper-I was identical in all circles and if the same has been leaked, then the same should have been cancelled all over India. It is further stated that only after issuance of impugned order dated 03.04.2020, the investigation was in process as per information provided under RTI. Thus, it is clear that when the investigation was incomplete and pending, the action of the respondents in cancelling the examination was without any base and 53 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 without any reason. It is also stated that no case has been lodged before CBI till the date matter was finally heard. It was further stated that the persons who are behind the malpractice are well within the knowledge of the respondents but only with an ulterior motive to protect those persons, the step of cancellation of the examination in whole of Rajasthan Circle is arbitrary, illegal, unjustified and contrary to law. Therefore, the action of the respondents deserves to be quashed and set aside.

The respondents filed reply to the rejoinder reiterating the facts mentioned earlier and further stated that Paper-I was identical to all the circles but Paper-II was separate for all individual circles and Paper-II was also a qualifying paper for selection. The investigation/inquiry is still pending with the CBI, but when the matter was investigated by the Vigilance Officer of CPMG, it was concluded in the investigation report that question papers of the said examination were leaked before holding of the said examination and it was pointed out in investigation that at large scale, serious irregularities /malpractices and use of unfair means in Rajasthan Circle was detected. Thus, 54 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 the decision of the competent authority to cancel the entire selection process is just and proper.
7. The applicants have filed Misc. Application No. 291/328/2020 for early hearing of the O.A. on the ground that the action of the respondents in cancelling the examination without any reason vide impugned order dated 03.04.2020 is arbitrary and unjust and if the matter is not heard early, the very purpose of filing the O.A. will be infructuous.
8. We have heard the learned counsels for the parties at length through Video Conferencing and examined the pleadings minutely and also perused the material available on record as well as the judgments produced by the parties.
9. The applicants have reiterated their stand taken earlier. They have relied on the following judgements:
"(a) East Coast Railway & Another vs. Mahadev Appa Rao & Others, reported in (2010) 7 SCC 678.
(b) Union of India & Others vs. Rajesh P.U., Puthuvalnikathu & Another, reported in (2003) SCC (L&S) 1048.55

(c) Monu Tomar vs. Union of India & Ors. (Civil Appeal No. 10513 of 2016) decided by the Hon'ble Supreme Court of India vide order dated 13th July, 2017."
In the case of East Coast Railway & Another vs. Mahadev Appa Rao & Others (supra), the Hon'ble Apex Court has held that though a candidate who has passed an examination or whose name appears in select list does not have an indefeasible right to be appointed, yet appointment cannot be denied arbitrarily, nor can selection test be cancelled without giving proper justification.
In the case of Union of India & Others vs. Rajesh P.U., Puthuvalnikathu & Another (supra), the Hon'ble Apex Court has held that in cases where it is possible to weed out the beneficiaries of illegalities, the selection process to that extent only be set aside leaving out the persons who had no concern with such malpractices.
In the case of Monu Tomar vs. Union of India & Ors. (supra), the Hon'ble Apex Court has held that the persons who are not suspected of having committed any malpractices and who have undergone prescribed 56 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 courses may be reinstated with all consequential benefits.
Thus, the applicants stated that in the light of the aforesaid judgments, the present Original Application deserves to be allowed.
10. The respondents have reiterated their stand taken earlier and added that the applicants have no case in the light of decision of the Hon'ble Apex Court in the case of Union of India and Others vs. Tarun K. Singh and Others, reported in (2003) 11 SCC 768. The respondents stated that the Hon'ble Apex Court in the said judgement has held that the process of selection, which stands vitiated by adoption of large scale malpractice to a public office, cannot be permitted to be sustained by a Court of Law. That apart, an individual applicant for any particular post does not get a right to be enforced by a Mandamus unless and until he is selected in the process of selection and gets the letter of appointment.
11. It is seen that as per the Notification dated 30.07.2019 and 05.08.2019 issued by the Ministry of 57 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 Communication, Department of Posts for LDCE from Postman (Group 'C') / Mail Guard, Dispatch Rider and MTS (Group 'D') for recruitment to the cadre of Postal Assistants/Sorting Assistants in Postal Divisions/Units, RMS and MMS for the vacancy year 2019, examination took place for all 23 circles. The said examination was divided into three papers. Paper-I was competitive in nature, while Paper-II and Paper-III were qualifying. Paper-I and Paper-II were conducted in continuity on the same day and both these papers took place on 15.09.2019. As all the applicants were fulfilling all the conditions in pursuance to the notification, they appeared in the examination. All the applicants were declared as qualified as per the result dated 24.01.2020. Thereafter, the applicants were also found successful in the DEST, which took place on 09.02.2020. Accordingly, the results were declared and promotions were granted to successful candidates except in Rajasthan Circle. On the other hand, the respondents instead served the applicants with impugned order dated 03.04.2020 (Annexure A/1).
12. The impugned order dated 03.04.2020 (Annexure A/1) reads as under:

From the above, it is clear that the reason mentioned by the respondents for cancellation of the examination was 'administrative grounds'. However, 59 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 in their reply, they state that the vigilance investigation clearly establishes that malpractice took place in Rajasthan Circle during examination process, which was severely and exhaustively compromised. There were also large scale malpractices by adopting /using unfair means and no exercise could possibly ascertain with certainty the identification of the candidates who did not use any unfair means or were not privy to the question paper. Thus, in such circumstances, the competent authority in its wisdom was left with no option but to cancel the examination. They also stated that the matter was referred to the CBI by letter dated 07.04.2020 to lodge an FIR in the case and investigate the matter.
13. During perusal of the pleadings, it was noticed that the respondents have not enclosed a copy of the preliminary report of the Inquiry Committee although on the basis of such report, it was stated that a decision was taken. The Tribunal after hearing the matter directed the respondents to produce the original record pertaining to the decision being taken for cancellation of the examination.

14. Therefore, in order to go into details of the matter, original records were called for and on perusal of the said record, the findings of the Inquiry Report read as under:
"a) The events happened during the course of conducting the said examination Paper-I dispatched by the Postal Directorate and received at Ajmer R.O. and opened there and thereafter it was re-closed in another cover and same was sent to C.O. through special messenger and delivered to AD (Rectt) on 02.09.2019 and it did not take on file record for further action and the confidential envelope was sent through special messenger without forwarding letter, it shows that Shri Ram Bharosa the then CPMG wanted to keep the matter secret regarding opening of paper at R.O.Ajmer. On the other side, Shri. N.R. Meena the then DPS (HQ) was also aware the matter but he did not take it seriously and not bring the matter on record that the envelope was kept with unauthorised officer i.e. AD(R) till 05.09.2019. The said envelope was again opened in the chamber of the CPMG Jaipur by the then In-charge of CPMG Shri Ram Bharose on 61 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 05.09.2019 and put remarks on covering letter and no any record/note about opening of cover containing exam paper at both points was recorded / noted in file and no information was sent to Postal Directorate about opening of Exam question papers twice before date of printing and moreover, the AD(Rectt) put a note about this fact on 10.02.2020 after completion of all steps of said exam. The scenario clears that it was intellectually planned by the responsible officers.
b) During the inquiry, it has come to light that some candidates stayed at Hotel near Sindhi Camp Bus Stand Jaipur (19 persons stayed in four rooms of hotel out of them 15 were candidates) on 14.09.2019 and hand written questions with answers of Paper-I and Paper-II were provided to them. Postmen also cleared in his statement that MTS took Rs. 3,00,000/- for providing of photocopies of the papers and MTS said to him that he would give the amount to DPS Naru Ram Meena.62

15. Thus, upon close scrutiny of the records, it is clear that since the question papers were received/ prepared at senior level, malafide involvement of officers at senior level i.e. the- then CPMG, the-then DPS(HQ) and the-then AD(Rectt.) is seen. It is also seen that the guidelines of conducting departmental examination circulated by the Directorate vide file No. 34012/05/2019-DE dated 11.09.2019 have been deliberately violated by the responsible officers most likely with ulterior motive or financial gains. But, after going through the record in detail and the names of the 15 candidates who were present in Hotel as per the list annexed to the report, none of the applicants in the present cases/present OAs were present in the Hotel or no record in entire report mentions names of present applicants anywhere in the OAs. Also if some candidates have not participated in sample test, there is no material on record to show that the applicants in the present OA were the same candidates. Also only on the basis of one anonymous complaint which was also found to be bogus, the entire selection/examination cannot be cancelled. 63 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020
16. As far as the judgments relied upon by the applicants is concerned, the Hon'ble Apex Court in the case of Union of India & Others vs. Rajesh P.U., Puthuvalnikathu & Another (supra), lays down the same principle that if in case of alleged irregularities in a selection process, the tainted cases can be segregated, in that case, the entire selection process should not be cancelled. In that case, the selection process can be cancelled only in respect of the candidates against whom irregularities are proved after identifying these candidates. For the candidates with no irregularities, cancellation of their selection process will not be justified. In the said case, the Committee appointed to enquire into the process, had found irregularities only in respect of 31 candidates. Hence, it was held that the cancellation of the entire process was not necessary. As far as the judgement of the Hon'ble Supreme Court in the case of East Coast Railway & Another vs. Mahadev Appa Rao & Others (supra), relied upon by the applicants is concerned, wherein it is held that the competent authority should have applied its mind to whatever material was available to it before cancelling the examination and record reasons as to why in its 64 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 opinion, it is necessary to cancel the examination in the interest of purity of the selection process or with a view to prevent injustice or prejudice to those, who have appeared in the same. The minimum expectation is that the authority has passed the orders only after due and proper application of mind to the allegations made before it and has formulated and recorded reasons in support of the said view that the competent authority was taking. These cases cover the present issue in hand as in the present case, tainted cases can be segregated. It is further to be noted that in the present matter, competent authority has neither passed orders with proper application of mind nor any reasons are recorded for cancellation of the examination.
17. On the other hand, if the case of Union of India and Others vs. Tarun K. Singh and Others (supra), relied upon by the respondents is considered, the Hon'ble Apex Court was of the view that since the selection process was vitiated by procedural and other infirmities cancellation thereof was perfectly justified. The facts of the said case cannot be applied to the present case as in the present case, it is clear that 65 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 there were 15 candidates who could be said to be tainted according to the list annexed in the preliminary investigation/inquiry report who could be segregated from the others and Committee has found irregularities against them as they were the persons who were present in the Hotel and questions and answers were provided to them as seen from the Inquiry Report.
18. Therefore, the only question which requires consideration is as to whether as a result of the illegalities, entire selection process was required to be struck down or it was not possible to weed out the beneficiaries of the illegalities and, therefore, the quashing was to be limited to those beneficiaries only.
19. The situation when the entire selection process can be treated as vitiated has been examined at length in the case of Smt. Kiran Juneja & Ors. vs. Union of India & Ors., WP(C) No. 12130-39/2004, decided by the Hon'ble Delhi High Court on 20.12.2007 following the case laws decided by the Hon'ble Apex Court, it was held as under:- 66

Rajesh P.U. (supra), the Apex Court held that in cases where it is possible to weed out the beneficiaries of illegalities, the selection process to that extent only be set aside leaving out the persons who had no concern with such malpractices. Following observations of the Supreme Court need a quote:
On a careful consideration of the contentions on either side in the light of the relevant portions of the report said to have been submitted by the Special Committee constituted for the purpose of inquiring into the irregularities, if any, in the selection of candidates, filed on our directions- which report itself seems to have been also produced for the perusal of the High Court?
there appears to be no scope for any legitimate grievance against the decision rendered by the High Court. There seems to be no serious grievance of any malpractices as such in the process of candidates or by those who actually conducted them. If the Board itself decide to dictate the questions on a loudspeaker in English and Hindi and none of the participants had any grievance in understanding them or answering them, there is no justification to surmise at a later stage that the time lapse in dictating them in different languages left any room or scope for the candidates to discuss among them the possible answers. The posting of invigilators for every ten candidates would belie any such assumption. Even that apart, the Special Committee constituted does not appear to have condemned that part of the selection process relating to conduct of the written examination itself, except noticing only certain infirmities only in the matter of evaluation of answer-sheets with reference to correct answers and allotment of marks to answers thereto, it appears that the Special Committee has extensively scrutinized and reviewed the situation by re- evaluating the answer- sheets of all the 134 successful candidates and found to have been declared successful though they were 67 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 not really entitled to be so declared successful and selected for whatsoever in the selection of the other successful candidates than the 31 identified by the Special Committee. In the light of the above and in the absence of any specific or categorical finding supported by any concrete and relevant material that widespread infirmities of an all-pervasive nature, which could be really said to have undermined the very process itself in its entirety or as a whole and it as impossible to weed out the beneficiaries of one or the other irregularities, or illegalities, if any, there was hardly any justification in law to deny appointment to the other selected candidates whose selections were not found to be, in any manner, vitiated for any one or the other reasons. Applying a unilaterally rigid and arbitrary standard to cancel the entirety of the selections despite the firm and positive information that except 31 of such selected candidates, no infirmity could be found with reference to others, is nothing but total disregard of relevancies and allowing to be carried away by irrelevancies, giving a complete go-by to contextual considerations throwing to the winds the principle of proportionality in going farther than what was strictly and reasonably to meet the situation. In short, the competent authority completely misdirected itself in taking such an extreme and unreasonable decision of cancelling the entire selections, wholly unwarranted and unnecessary even on the factual situation found too, and totally in excess of the nature and gravity of what was at stake, threreby virtually rendering such decision to be irrational.
16. In Umesh Chandra Shukla v. Union of India (supra) selection to Delhi Judicial Service was in challenge. As per the Rules, every candidate was required to obtain a minimum of 50% marks in each paper and overall 60% marks to qualify for interview. The High Court, which conducted the examination, granted 2 marks to 68 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 every candidate in every paper thereby rendering many candidates qualified for interview. The Supreme Court held that grant of grace marks was illegal. Therefore, the selections of the candidates who were given grace marks was held to be bad in law. However, those candidates who were selected without any grace marks and in whose case no illegalities were found were declared successful. Likewise, in the case of Harshendia Choubisa v. State of Rajasthan (supra), the Supreme Court held, where the awarding of grace marks by the Government of Rajasthan on the basis of locality was found to be irrational, unreasonable and illegal. However, the Supreme Court directed that selection already made on the basis of erroneous interpretation cannot be disturbed and the subsequent interpretation will be given prospective effect. Moreover, even from the list of selected candidates who could not join were allowed to do the same and the relief to the appellant was limited only to their case only in the situation of their having better marks than the selected candidates.
21. The Bench consisting of Hon'ble Mr. Justice S.B. Sinha and Hon'ble Mr. Justice Dalveer Bhandari gave separate judgments, though with same conclusion. It was held that if an appointment is made in violation of Articles 14 and 16 of the Constitution of India, same would be void and nullity. In view of the law laid down by the Constitution Bench of the Supreme Court in the case of Secretary, State of Karnataka v. Umadevi , the Court further held that when the services were not terminated in terms of Rules, but on the ground that various irregularities were committed in the selection process involved, the applicability of the relevant provisions of the statutes and the effect of provisions of Article 311 of the Constitution was not required to be considered. However, before terminating the appointments on this ground, the appointing authority must take into consideration the foundational facts. Only when such foundational facts are established, the legal principles can be applied. The authority taking decision to cancel 69 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 the process or terminate the appointment, if already appointed, had to establish that the process was tainted; that the entire selection process was liable to be cancelled and the question, which requires consideration in such matters, is as to whether due to misdeeds of some candidates, honest and meritorious candidates should also suffer. The Court opined that a distinction exists between a proven case of mass cheating for a board examination and an unproven imputed charge of corruption where the appointment of a civil servant is involved. Only in the event it is found to be impossible or highly improbable that the tainted case can be separated from the non-tainted cases could en masse orders of termination be issued. Both the State Government as also the High Court in that view of the matter should have made all endeavors to segregate the tainted from the non- tainted candidates.
22. The Supreme Court also delineated the cases where selection process could be perceived to be tainted by categorising them as under:
(i) Cases where the'event' has been
investigated.
(ii) Cases where CBI inquiry took place and was completed or a preliminary investigation was concluded.
(iii) Cases where the selection was made but appointment was not made.
(iv) Cases where the candidates were also ineligible and the appointments were found to be contrary to law or rules.
30. No doubt, there have been discrepancies in the selection process, as found by Prof. Vaid Prakash Committee on the basis of which he recommended cancellation of the results. However, the foregoing discussion would make it clear that the discrepancies were found in other cases and not in the case of the petitioners and it was also possible to separate the cases of the petitioners from those who were the beneficiaries 70 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 of the irregularities. Prof. Vaid Prakash obviously did not examine the matter from this angle while suggesting cancellation. In view of the principles laid down by the Supreme Court in the judgments noted above, in particular the case of Inderpreet Singh Kahlon (supra) wherein the Supreme Court re-stated the legal principles after scanning through the entire case law, the situation where the cases of those who were the bona fide and innocent persons can be saggregated, the selection in respect of those persons is not to be cancelled."

Therefore, applying the same ratio as discussed and as per the principles laid down by the Hon'ble Apex Court, before cancelling the entire selection process, the facts are required to be examined carefully to see whether the tainted cases can be separated from the cases when there is no evidence of any irregularity or malpractice so that the tainted cases can be cancelled. In case if the facts are such that it is not possible to separate the tainted cases, then cancellation of the entire selection process can be considered.
21. Thus, the question which also requires consideration is whether on the basis of anonymous complaint, entire examination process was required to be cancelled.

As seen, the norms in examination process in conducting the examination are said to have been violated by senior officials, then in that case, responsibility should be fixed and appropriate action to be taken against those erring officers, but the respondents instead have cancelled the examination though there is no material on record to show that the applicants of these OAs were any where involved or were party to such involvement. As seen from the original record, it has also come to light that the anonymous complaint was not made by any such person, but merely on conjectures and imagination without proper application of mind, examination is seen to have been cancelled. In fact, the respondents should have taken action against the 15 candidates as per the list which has been attached in the record if at all they deem to take and ought to have cancelled only their candidature in view of the law laid down by Hon'ble Apex Court in the case of Union of India & Others vs. Rajesh P.U., Puthuvalnikathu & Another (supra).

With reference to the facts of the present case, we are of the considered opinion that the facts in the 72 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 OAs before us are squarely covered by the decisions relied by the applicants and, therefore, cancelling the entire examination is patently arbitrary showing non- application of mind and, therefore, the respondents are bound to declare the final results of the Departmental Examination for recruitment to the cadre of Postal Assistants/Sorting Assistants from eligible Postman/ Mail Guard/ Dispatch Rider and MTS cadre on the basis of the examination already held on 15.09.2019 as action could have been taken against the identified/tainted candidates and that they could have been weeded out from rest of the candidates.
24. Therefore, in absence of due and proper application of mind and in absence of any material available before the competent authority against the present applicants, cancellation of examination without recording any finding is highly unjust and arbitrary.

Accordingly, all the aforesaid Original Applications succeed and the impugned orders dated 03.04.2020 (Annexrure A/1) are hereby quashed and set aside in respect of the applicants in the said OAs. The 73 OA No. 291/195/2020, OA No. 291/196/2020, OA No. 291/197/2020, OA No. 291/198/2020, OA No. 291/199/2020, OA No. 291/205/2020, OA No. 291/274/2020 and OA No. 291/275/2020 respondents are directed to declare their result and further carry out the procedure of selection/appointment as has been carried out in other postal circles in pursuance of the Notification dated 05.08.2019 with all consequential benefits. No costs.
