Section 370 in Bihar Board's Miscellaneous Rules, 1958

370. Definitions.

(1)In these rules :-
(a)"Committee" means the Committee of the Bihar Coin Cabinet.
(b)"Section" means a Section of the Indian Treasure-Trove Act, 1878.
(2)Publication of notification. - Every notification under Section 5(a) shall be published at the local police station, at the Courts of the Collector, Sub-divisional Officer, and Munsif within whose jurisdiction the treasure was found, and also at some conspicuous spot in the village in which it was found.
(3)Collector's report. - On receipt of any notice under Section 4, or on receipt of information from any person other than the finder that treasure has been found, the Collector shall report the fact direct to the Provincial Government, the Bihar Coin Cabinet, and the Superintendent, Department of Archaeology, Mid Eastern Circle, Patna, stating as far as the information at his disposal permits :-
(1)the name of the finder;
(2)the nature of the treasure and the number of coins (if any);
(3)the approximate value of the treasure ;
(4)the date of the finding of the treasure ;
(5)the origin, surroundings and exact nature of the find ; and
(6)whether, in the case of treasure consisting of coin, it is recommended-
(a)that Government should acquire the whole of such treasure; or
(b)that for any special reasons, such as the largeness of the quantity found or the coins being known to be of merely metal value, Government should not acquire the whole of such treasure, but only a portion thereof, or
(c)that Government should not acquire any portion of the treasure.
(4)Cost of service of notice. - All notices issued under Section 5 or in pursuance of any rules framed under the Act, shall be served at the cost of Government.
(5)Acquisition of treasure. - The acquisition under Section 16 of the whole or any part of the treasure by the Collector, whether such treasure consists of coins or not, shall be subject to the orders of the Provincial Government.
(6)Examination of coins and report by the Bihar Coin Cabinet. - (i) When the Collector recommends under Rule 3 the acquisition of any treasure-trove consisting of coins he shall forward to the Secretary of the Bihar Coin Cabinet for inspection-
(a)if the find is small, all the coins ;
(b)if the find is large, a few specimens of each type of such coins.
(ii)The Committee may, in the case of large finds, request the Collector to forward to it all the coins or such and so many specimens thereof as they think fit, in addition to those already forwarded by the Collector, and the Collector shall comply with such request.
(iii)The Committee shall cause all coins forwarded to it under this rule to be examined and shall submit reports in Forms A and B appended to these rules, to the Provincial Government stating the number and nature of the coins and their probable numismatic value and shall advise the Provincial Government whether the coins or any part of them should be acquired.
(iv)The committee shall send a copy of every report submitted by it to the Provincial Government, to the Superintendent, Department of Archaeology, Mid Eastern Circle, Patna.
(7)Examination and acquisition of treasure, not coins. - (1) In the case of treasure-trove not consisting entirely of coins and on receiving a report under Rule 3, the Committee shall, if it appears from such report that inspection is desirable, arrange for an inspection of the treasure either by the Secretary or by some expert selected by it and shall in any case advise Government without delay as to the desirability of acquiring the treasure under Section 16.
(2)If Government decide to acquire such treasure, whether on the report of the Committee or otherwise, Government shall so inform the Collector who, after making the said declaration and complying with the provisions of Section 16, shall as soon as possible, forward the treasure so acquired either to the Bihar Coin Cabinet, Bankipur, or to any other centre which Government may direct.
(3)The Committee shall keep the Superintendent, Department of Archaeology, Mid Eastern Circle, Patna, informed of the results of the examination and acquisition of treasure.
(4)The Committee may, whenever it appears to be necessary, apply for the assistance or advice of the Superintendent, Department of Archaeology, Mid Eastern Circle, Patna, in the examination or disposal of the treasure-trove.Form AReport no........ of........ on........
