38A. [ Affiliated colleges [recognised or approved institution] [Section 38A was inserted by Gujarat 4 of 1961, section 4.] to comply with provisions pertaining to medium of instruction.
(1)Every affiliated college and [recognized or approved institution] [These words were substituted for the words 'recognised institution' by Gujarat 6 of 1973, section 37 (1).], shall in respect of the medium of instruction, teaching, training and examination therein, comply with the provisions made in that behalf by this Act, and the Statutes, Ordinances and Regulations made under it.(2)If any affiliated college [or recognized or approved] [These words were substituted for the words 'recognised institution' by Gujarat 6 of 1973, section 37 (1).] institution contravenes the provisions of sub-section (1), then notwithstanding anything contained in the other provisions of this Act-(a)the rights conferred on such college or institution by the affiliation a [recognition or approval] [These words were substituted for the words 'or recognised' by Gujarat 6 of 1973, section 37 (2) (a).] shall stand withdrawn from the date of such contravention, and(b)such college or institution shall cease to be an affiliated college [or recognized or approved] [These words were substituted for the words 'recognised institution' by Gujarat 6 of 1973, section 37 (1).], institution for the purposes of this Act.(3)Any dispute under sub-section (1) or (2) shall be referred to the Chancellor.
