The Punjab State Legislature Officers, Ministers and Members (Medical Facilities) Act, 1965Punjab Act 26 of 1965Statement of objects and Reasons. - "The provision of the reasonable Medical facilities for persons engaged in public service, whether in public or private sector, is essential. This facility already exists for members of Parliament and Legislators in some of the other States. It had been a long standing demand in this State also. During the last session of the State Legislature a Bill providing for medical facilities to Legislators and enhancing their compensatory allowance from Rs.300 to Rs. 400 per mensem was prepared but in view of the National Emergency the provision of increase in their allowance has been dropped".See Punjab Government Gazette Extraordinary, dated the 2nd November, 1965, Page 1174.Received the assent of the Governor of Punjab on the 21st November, 1965, and was first published in the Punjab government Gazette Extraordinary, dated the 23rd November, 1965.An act to extend medical facilities to persons holding certain offices in the Punjab State.Be it enacted by the Legislature of the State of Punjab in the Sixteenth Years of the Republic of India as follows:-

1. Short title.

- This Act may be called the Punjab State Legislature Officers, Ministers and Members (Medical Facilities) Act, 1965.

2. Medical Facilities.

(1)Notwithstanding anything contained in any other law for the time being in force, every person holding, for the time being, any of the following offices shall be entitled to such medical facilities for himself and for members of his family as may be prescribed by rules made by the State Government in this behalf, namely:-

(i)[-] [Vide Adaptation of Laws Order, 1970.]

(ii)the Speaker or the Deputy Speaker of the Punjab Legislative Assembly;

(iii)a Minister or a Minister of State or a Deputy Minister of the Punjab State; or

(iv)a Member of the [-] [Omitted by the Adaptation of Punjab Laws Order, 1970.] Punjab Legislative Assembly.

(2)Every rule made under sub-section (1) shall be laid as soon as may be after it is made before [-] [Omitted by the Adaptation of Punjab Laws Order, 1970.] the State Legislature while it is in session for a total period of ten days which may be comprised in one session or in two successive sessions, and, if before the expiry of the session in which it is so laid, or the session immediately following, [the legislature] [Substituted by the Adaptation of Punjab Laws Order, 1970.] agree in making any modification in the rule or [the Legislature] [Substituted by the Adaptation of Punjab Laws Order, 1970.] agree that the rule should not be made, the rule shall, thereafter, have effect only in such modified form or be of no effect as the case may be, so however, that any such modification or annulment shall be without prejudice to the validity of any thing previously done under that rule.Form VIII

Form of Application for Grant of Family PensionApplication for the spouse of the deceased member Shri/Shrimati ________ ___________________________ who was serving as member.

1. Name, Father's Name/Husband's name.

Name in case of female, address of the applicant.

2. Circumstances in which the death occurred and date of death of the member.

3. Treasury from which family pension is to be drawn.

4. Descriptive roll of widow/widower of Shri/Shrimati __________________

(i)Date of Birth

(ii)Height

(iii)Identification marks, if any, on the body.

(iv)Left/right had thumb and fingers impressions

5. Any other relevant information.

Witnesses:Signature or left/right hand thumb impression.Note. - The descriptive roll (Column 4) and signatures or left/right hand thumb and fingers impressions accompanying application for family pension should be in duplicate (in two separate sheets) and attested by two gazetted officers or persons of respectability of the Village/Town/City in which the a applicant resides.Specimen signatures of Shri/Shrimati _____________________ widow/widower of late Shri/Shrimati __________________ who was serving as member.Attested.Descriptive roll of Shri/Shrimati ___________ widow/widower of late Shri/Shrimati ___________ who was serving as memberHeight __________________________Identification marks :-Attested.

OrderSanction is hereby accorded to the payment of family pension of Rs. ________________ (Rupees____________________________________ Only) under the Punjab State Legislature Members (Pension and Medical Facilities Regulation) Act, 1977 to Shri/Shrimati __________________________________________ husband/wife of Shri/Shrimati ______________________________________________ residing at _____________________________________________ subject to the provisions of the Punjab State Legislature Members (Pension and Medical Facilities Regulation) Rules, 1984 as amended from time to time.
