Since the issue relating to suspension of para 6 of KVS Transfer Policy-2021 is under challenge in all these Original Applications and as such we propose to decide all these Original Applications by passing a common order.
2. Heard the learned counsel for the respective applicants, learned counsel for the respondents and perused the pleadings available on record.

By the batch of Original Applications, the applicants of the respective O.As have assailed the separate rejection orders issued to them by means of which their representation has been rejected by the respondents in compliance of directions issued by the Hon'ble High Court of M.P. The applicants have also challenged the original transfer order by which they have been transferred out from their present place of posting with a further prayer to allow them to continue on their respective place of posting.
4. This is second round of litigation before this Tribunal. For brevity of the case, the facts of each O.As are being narrated here-in- under:-
5. O.A. No. 241 of 2023:- In this O.A., the applicant, who is working as PRT in Kendriya Vidyalaya, No.3 Bhopal (MP) has been Page 56 of 127 OAs Nos. 241/2023 & other connected OAs 57 transferred to Kendriya Vidyalaya, Jajpur (Orissa) by order dated 16.9.2022. Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions of Transfer Guidelines has not been strictly adhered to while suspending para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A-7) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.
O.A. No. 242 of 2023:- In this O.A., the applicant, who is working as PRT in Kendriya Vidyalaya, No.1 STC, Jabalpur (MP) has been transferred to Kendriya Vidyalaya, No. 2, Chhindwada by order dated 16.9.2022. Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions of Transfer Guidelines has not been strictly adhered to while suspending para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A-10) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the Page 57 of 127 OAs Nos. 241/2023 & other connected OAs 58 order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.
O.A. No. 243 of 2023:- In this O.A., the applicant, who is working as PRT in Kendriya Vidyalaya, No.1 STC, Jabalpur(MP) has been transferred to Kendriya Vidyalaya, Malanjkhand by order dated 16.9.2022. Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions of Transfer Guidelines has not been strictly adhered to while suspending para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A-
10) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.
O.A. No. 244 of 2023:- In this O.A., the applicant, who is working as TGT (Biology) in Kendriya Vidyalaya, No.3 Bhopal (MP) has been transferred to Kendriya Vidyalaya, Miryalaguda, District Nalagonda by order dated 13.9.2022. Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions of Transfer Guidelines has not been strictly adhered to while suspending para 6 of Transfer Guidelines. O.A. No. 245 of 2023:- In this O.A., the applicant, who is working as PRT in Kendriya Vidyalaya No.3, Bhopal has been transferred to Kendriya Vidyalaya Aruvankadu (Tamilnadu) by order dated 16.9.2022. Challenge for the said transfer order is that the applicant has been transferred 1800 Kms. away from her present place of posting and that provisions of Transfer Guidelines has not been strictly adhered to while suspending para 6 of Transfer Guidelines. The applicant has also challenged the rejection order on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is a stereo type order.
O.A. No.246/2023:- In this O.A., the applicant who is working as PRT has been transferred from Kendriya Vidyalaya No.3 (First Shift), Bhopal to Kendriya Vidyalaya, Burhanpur vide order dated Page 59 of 127 OAs Nos. 241/2023 & other connected OAs 60 16.09.2022 (Annexure A/1). Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A/9) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.
O.A. No.247/2023:- In this O.A., the applicant who is working as PRT has been transferred from Kendriya Vidyalaya BMY, Bhilai to Kendriya Vidyalaya Maithon Dam, District Dhanbad (Jharkhand) vide order dated 16.09.2022 (Annexure A/1). Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions of Transfer Guidelines has not been strictly adhered to while suspending para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A-1) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.

No.258/2023:- In this O.A., the applicant who is working as Primary Teacher (PRT) has been transferred from Kendriya Vidyalaya Durg to Kendriya Vidyalaya Simdega vide order dated 13.09.2022 (Annexure A/1). Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A/5) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.

Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A/5) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.

Challenge for the said transfer order is that the applicant has been transferred far away from his present place of posting and that provisions of Transfer Guidelines has not been strictly adhered to while suspending para 6 of Transfer Guidelines. Challenge Page 76 of 127 OAs Nos. 241/2023 & other connected OAs 77 for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions of Transfer Guidelines has not been strictly adhered to while suspending para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A-1) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.
O.A. No. 280 of 2023:- In this O.A., the applicant, who is working as PRT in Kendriya Vidyalaya No.1, Gwalior has been transferred to Kendriya Vidyalaya, Multai by order dated 16.9.2022. Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions of Transfer Guidelines has not been strictly adhered to while suspending para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A-1) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and Page 77 of 127 OAs Nos. 241/2023 & other connected OAs 78 that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.
O.A. No.281 of 2023:- In this O.A., the applicant who is working as Primary Teacher (PRT) has been transferred from Kendriya Vidyalaya No.2 Bhopal (MP) to Kendriya Vidyalaya Warangal (AP) vide order dated 16.09.2022 (Annexure A/1). Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A/3) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.
O.A. 282 of 2023 :- In this O.A., the applicant who is working as TGT (Social Science) has been transferred from Kendriya Vidyalaya No.3 EME Centre Bairagah (MP) to Kendriya Vidyalaya Ongole District Praksam (AP) vide order dated 16.09.2022 (Annexure A/1). Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that Page 78 of 127 OAs Nos. 241/2023 & other connected OAs 79 provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A/3) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in his representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law. O.A. No. 283 of 2023 :- In this case, the applicant has been transferred from Kendriya Vidyalaya CMM, Jabalpur to Kendriya Vidyalaya, Bhadrak (OR). In the said O.A., the applicant has challenged the transfer order on the ground of violation of the provisions contained in Transfer Guidelines. Not only that, para 6 of Transfer Guidelines, 2021 has been kept in abeyance and the applicant has been transferred about 1000 Kms away from her present place of posting. Though, the rejection order has been annexed in the O.A. as Annexure A/3, but the same has not been mentioned in the relief(s) clause. Further ground of the applicant is that the rejection order has been passed in a cyclostyle manner without considering the facts and circumstances as raised in her representation and as such rejection order is bad in the eyes of law. No. 284 of 2023:- In this O.A., the applicant who is working as TGT Social Science has been transferred from Kendriya Vidyalaya No.2 Bhopal (MP) to Kendriya Vidyalaya Kasrawad District Khargone vide order dated 13.09.2022 (Annexure A/1). Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A/3) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.

No.285 of 2023:- In this O.A., the applicant who is working as Primary Teacher (PRT) has been transferred from Kendriya Vidyalaya GCF 1 to Kendriya Vidyalaya IIT Bhabaneswar (OR) vide order dated 16.09.2022 (Annexure A/1). Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. The applicant has also challenged the Page 80 of 127 OAs Nos. 241/2023 & other connected OAs 81 rejection order dated 29.03.2023 (Annexure A/3) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.

The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A/2) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in his representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.

No.318/2023:- In this O.A., the applicant who is working as PGT (Physics) has been transferred from Kendriya Vidyalaya No.1 STC, Jabalpur to Kendriya Vidyalaya No. 2 Chhindwara vide order dated 12.09.2022 (Annexure A/1). Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A/2) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in his representation while passing the order and that the rejection order is Page 101 of 127 OAs Nos. 241/2023 & other connected OAs 102 a stereo type order and as such rejection order is bad in the eyes of law.

No.319/2023:- In this O.A., the applicant who is working as PGT (Physics) has been transferred from Kendriya Vidyalaya No.1 Rewa to Kendriya Vidyalaya Jayant Colliery District Singrauli vide order dated 12.09.2022 (Annexure A/1). Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A/2) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in his representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.

Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. No.370/2023:- In this O.A., the applicant who is working as Primary Teacher (PRT) has been transferred from Kendriya Vidyalaya No.3 Bhopal (MP) to Kendriya Vidyalaya Paradip Port (OR) vide order dated 16.09.2022 (Annexure A/1). Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. No.372/2023:- In this O.A., the applicant who is working as TGT (Social Science) has been transferred from Kendriya Vidyalaya No.3 Bhopal (Shift-I) to Kendriya Vidyalaya Harda vide order dated 13.09.2022 (Annexure A/1). Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A/2) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in his representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.
O.A. No.373/2023:- In this O.A., the applicant who is working as PRT has been transferred from Kendriya Vidyalaya No.1 Rewa to Kendriya Vidyalaya Lakhnadon vide order dated 16.09.2022 (Annexure A/1). No.374/2023:- In this O.A., the applicant who is working as TGT (English) has been transferred from Kendriya Vidyalaya No.1 Rewa to Kendriya Vidyalaya Karwar, Arga Karnataka vide order dated 16.09.2022 (Annexure A/1). Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A/2) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is Page 108 of 127 OAs Nos. 241/2023 & other connected OAs 109 a stereo type order and as such rejection order is bad in the eyes of law.
O.A. No. 380 of 2023:- In this Original Application, the applicant, who is working as PGT (Computer Science) in Kendriya Vidyalaya Guna, District (MP) has been transferred to Kendriya Vidyalaya, Ongole, Hyderabad Division, Telangana by order dated 12.9.2022. Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions of Transfer Guidelines has not been strictly adhered to while suspending para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A-1) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.
O.A. No.381/2023:- In this O.A., the applicant who is working as TGT (English) has been transferred from Kendriya Vidyalaya Guma to Kendriya Vidyalaya Dharmapuri Tamilnadu vide order dated 13.09.2022 (Annexure A/4). Challenge for the said transfer order is that the applicant has been transferred far away from her present Page 109 of 127 OAs Nos. 241/2023 & other connected OAs 110 place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. No.384/2023:- In this O.A., the applicant who is working as Primary Teacher (PRT) has been transferred from Kendriya Vidyalaya CISF Bhilai to Kendriya Vidyalaya SER Dangoaposi vide order dated 16.09.2022 (Annexure A/1). Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions contained in Transfer Guidelines has not been strictly adhered to while suspending Para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A/5) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in his representation while passing the order and that the rejection order Page 110 of 127 OAs Nos. 241/2023 & other connected OAs 111 is a stereo type order and as such rejection order is bad in the eyes of law.
O.A. No. 421 of 2023:- In this O.A., the applicant, who is working as TGT (English) in Kendriya Vidyalaya, No.1 Indore (MP) has been transferred to Kendriya Vidyalaya, Rajampet, Andhra Pradesh by order dated 13.9.2022. Challenge for the said transfer order is that the applicant has been transferred far away from his present place of posting and that provisions of Transfer Guidelines has not been strictly adhered to while suspending para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A-6) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.
O.A. No. 422 of 2023:- In this O.A., the applicant, who is working as TGT (Hindi) in Kendriya Vidyalaya, No.1, Indore (MP) has been transferred to Kendriya Vidyalaya, Kasarwad, District Khargone by order dated 13.9.2022. Challenge for the said transfer order is that the applicant has been transferred far away from her present place of posting and that provisions of Transfer Guidelines have not been Page 111 of 127 OAs Nos. 241/2023 & other connected OAs 112 strictly adhered to while suspending para 6 of Transfer Guidelines. The applicant has also challenged the rejection order dated 29.03.2023 (Annexure A-7) on the ground that it has been passed without application of mind in a routine manner as the respondents failed to consider the pleas raised by the applicant in her representation while passing the order and that the rejection order is a stereo type order and as such rejection order is bad in the eyes of law.
6. So to summarise, all the Original Applications have been filed seeking two reliefs namely: (a) quashing of transfer order and (b) quashing of impugned rejection order of the representation submitted in pursuance of the direction of Hon'ble High Court of M.P. made by each individual.

Per-contra, the learned counsel for the respondents has filed separate Reply in each O.As wherein they have stated that the transfer order in each case has been passed on administrative exigencies and also in public interest. They have cited number of decisions justifying the action taken by the respondents while transferring the applicants from their present place of posting. They have also stated that transfer is an incidence of service and that the applicants are having all India transfer liability and as such they can be posted anywhere in India in the exigencies of service. The Page 112 of 127 OAs Nos. 241/2023 & other connected OAs 113 respondents also stated that the applicants have failed to aver that the transfer order is based on non-application of mind and it suffers from malafide or it has been passed by an authority who is not competent to do so. The respondent also took a ground in the Reply that most of the applicants, who were transferred out, were based on the seniority roster maintained at each station and most of the transferred applicants had a stay of more than 10 years at a particular station. The respondents have also asserted that it is the sole prerogative of the employer to post an employee according to administrative need and exigencies of service and as such action of the respondents cannot be said to be faulty one. The respondents also took the plea that the representation of the applicant has been duly considered by the authorities concerned and the outcome of the same has been informed to the applicant by passing a separate order. Since the transfer order has been passed in administrative exigencies as well as in public interest and as such no interference is called for by this Tribunal and the O.As filed by the respective applicants are liable to be dismissed.
8. This was the question that has already been answered in the rejection of all the O.As earlier where the transfer orders were assailed by the applicants. In the earlier round of litigation, the Page 113 of 127 OAs Nos. 241/2023 & other connected OAs 114 applicants had knocked the door of this Tribunal by filing separate O.As assailing the transfer orders. While entertaining the O.As, this Tribunal had passed an interim order staying the operation of transfer order. However, subsequently all the Original Applications were clubbed together and were dismissed by a common order dated 24.2.2023. Against that, all the applicants carried the matter before the Hon'ble High Court of M.P. by filing separate Writ petitions. All the Writ petitions were clubbed together and were disposed of by a common judgment and order dated 3rd March, 2023 with a direction to the applicants to make a representation individually to the respondents on or before 6.3.2023 by taking all the grounds in support of their case and the transfer guidelines. The respondents were directed to pass appropriate orders on or before 20.3.2023 by extending the interim order as already granted by this Tribunal in operation till 10.4.2023. In compliance of the order of Hon'ble High Court of M.P., the respondents have considered and accepted the contention of 29 applicants and rejected the representations of the rest of the applicants by passing separate orders, which are under challenge in the O.As.

In all these O.As, before this Tribunal now, the applicants have challenged the transfer orders as well as orders rejecting the Page 114 of 127 OAs Nos. 241/2023 & other connected OAs 115 representation of the applicants which has been decided pursuant to order of Hon'ble High Court of M.P. in separate O.As. The applicants in all these O.As have questioned the validity of suspension of para 6 of Transfer Policy-2021. Submission of learned counsel for the applicants is that on account of suspension of para 6 of Transfer Policy, the merit point meant for spouse ground has not been taken into account while transferring the applicants from their present place of posting, which is the main criterion for transferring the teacher from one place to another. Since para 6 deals with merits- point under spouse ground has been suspended by the respondents and as such the transfer order as passed by the respondents is not at all legally sustainable in the eyes of law.

The next limb of the argument of learned counsel for the applicants is that the decision of suspension of para 6 of Transfer Policy has been taken by an authority, who is not competent to do so and as such transfer order is bad in the eyes of law. Another ground taken by the applicants is that they have been transferred far away from their present place of posting, in some cases the distance is more than 1500 Kms. The applicants have also taken a ground that the said transfer order has been passed during mid academic session, hence the same is not legally sustainable. Another ground taken by the applicants is illness of spouse, parents as Page 115 of 127 OAs Nos. 241/2023 & other connected OAs 116 well as their wards. Apart from that, applicants have also taken a ground that as per the O.Ms. issued by the Government on the subject, husband and wife should be posted at the same station as far as possible. Lastly the applicants have stated that their representation has been rejected by the respondents without application of mind in a cursory and callous manner without detailing the points/grounds raised in their representation.

13. We have carefully gone through the citations/decisions as submitted by all the learned counsel for the parties. It is established that the transfer is an incidence of service and the employee has no vested right to continue at a particular station forever. It is the sole prerogative of the employer to post an employee according to administrative need and exigencies of services and the employer is the best judge to utilise the services of its employee where the need so arises. The scope of interference of the Tribunals/Courts with regard to transfer matter is in a very narrow campus. Time and again the Hon'ble Supreme Court has been pleased to hold that Courts/Tribunals should not interfere in day-to-day transfer orders issued by the authorities concerned. Transfer order can only be interfered with when the same is malafide or against the statutory rules and except these two grounds, the transfer order cannot be interfered with by the Courts/Tribunal.
14. It is also noticed that annual transfer process of KVS has been suspended for the session 2022-23 and now the academic session 2023-24 is going on. It is also necessary to point out here that provisions of para 6 of Transfer Policy-2021 have not been suspended, but have been kept in abeyance. As per the counsel for applicants, only the Board of Governors is competent body to revise Page 118 of 127 OAs Nos. 241/2023 & other connected OAs 119 the transfer guidelines but they have not shown any document to this effect and relied on just an observation made in course of passing an order dealing with KVS transfer issue by Ahmedabad Bench of the Tribunal. The learned counsel for the respondents has opposed this interpretation as being without basis. Para 13 of the Transfer guidelines confers the power on Commissioner, KVS to relax these guidelines albeit with the approval of Chairman (Union Minister). The records of notings on the file showing such approval was produced before this Tribunal in earlier round of litigation, that had led to dismissal of O.As challenging the transfer order. Apart from that, we may also observe that para 6 of Transfer policy was suspended during the academic session 2022-23.

Government of India issued O.M. dated 30.9.2009 followed by another O.M. dated 24.11.2022 wherein it has been provided that husband and wife should ordinarily be posted at the same station as far as possible. The guidelines contained in the aforementioned O.Ms are only guiding principle. As such the version of the applicants that they should be posted at the same station where his/her spouse is posted, will not take precedence over administrative exigency of the organization that they are serving.

As regards illness of spouse, parents as well as wards are concerned, it is stated that in some defined critical illness, there is Page 119 of 127 OAs Nos. 241/2023 & other connected OAs 120 some dispensation/concession that has been provided for a certain period of time and not for all the times to come. On this ground too, the applicants have no case and as such the aforesaid ground taken in the O.A. for assailing the impugned orders as well as rejection order cannot be said to be illegal one.
17. Submission of learned counsel for the applicants is that the rejection order has been passed without application of mind and as such the same is liable to be quashed straightaway. A perusal of Hon'ble High Court's directions reveals that there are two planks on which the individual representation is to be decided: (a) the grievance of the applicant on merits; and (b) also in terms of transfer guidelines. In this context, it is stated that the rejection order has been passed by the authorities concerned without detailing the points as urged by the applicants in their respective representation and in a routine and repetitive manner they have passed the impugned order rejecting the representations of the applicant. We have carefully perused the rejection order and we find that the same has been passed in a stereo type manner without considering or detailing the pleas/grounds as raised by the applicants in their representations and as such the same cannot be termed as a valid and reasoned order. Not only that, no specific reason/ground has been assigned by the respondents while rejecting the representations of the applicants, hence the Page 120 of 127 OAs Nos. 241/2023 & other connected OAs 121 rejection order cannot be said to be a legal and valid order. More- over the directions of Hon'ble High Court of M.P. that transfer guidelines should be considered, has not at all been paid heed to. The judicial order will definitely take precedence over the executive instructions of supression of certain paras of transfer guidelines. Infact, we have observed that the rejection order in all the cases have mentioned that the transfer guidelines are suspended, that is a clear violation of the observation made by the Hon'ble High Court of M.P. in course of directing the applicants to file representations before the respondents .
18. The rejection order does not mention the pleas/grounds as raised by the applicants in their representation. There is also no iota of reason assigned in the impugned rejection order as to why the defence taken by the applicants in the representation was not found to be trustworthy to the respondents. In the case of Kranti Associates (supra) the Hon'ble Supreme Court has been pleased to hold that "the reasons are heart beats of conclusion. In absence of reasons, conclusion cannot sustain judicial scrutiny. It has also been observed that reasons in support of decisions must be cogent, clear and succinct. A pretence of reasons or 'rubber stamp reasons' is not to be equated with a valid decision making process. The said ratio has been reiterated by Hon'ble Supreme Court as well as Hon'ble High Page 121 of 127 OAs Nos. 241/2023 & other connected OAs 122 Courts in number of decisions. Thus, the respondents were under legal obligation to deal with each of the points as raised by the applicants in their representations while taking the decision thereon, which admittedly, they failed to do so. The argument of counsel for respondents invoking the "Doctrine of useless formality" does not hold ground as different individuals have cited different and distinct grounds. Whether those grounds are valid or not can be decided only after examining those grounds. This cannot be brushed aside by quoting the "Doctrine of useless formality".
19. If we summarise the rival contention of the two parties, it can be listed as follows.
19.1 Firstly, learned counsel for the applicants have started with a suggestion that the judgement delivered by this bench in the previous O.A. rejecting their plea against the transfer was per incuriam. The reason cited was that the Ahmedabad bench of the Tribunal has in a similar matter passed an order in January 2023, setting aside the transfer orders of Kendra Vidyalaya Sangathan (KVS) for the academic session 2022-23. So this bench should not have taken any decision to the contrary and if it felt that a contrary decision was to be taken, then it should have referred the matter to Principal Bench, New Delhi to be adjudicated upon. The learned counsel for the respondent has vehemently opposed this saying that it is a contemptuous line of Page 122 of 127 OAs Nos. 241/2023 & other connected OAs 123 argument. He has apprised that they are perhaps not aware that Ernakulam bench has already passed an order in the month of December 2022 which is in line with the orders passed by this bench of the tribunal. So if at all any order was per incuriam, it was the order of Ahmedabad bench and infact that Bench should have referred the matter to Principal Bench, New Delhi. Later on, Principal Bench, Delhi has also dismissed the O.A. filed by the Association of KVS Teachers on this particular issue itself. Hence, the majority view with an exception of Ahmedabad bench of the Tribunal is in line with the order passed by this bench of the Tribunal. Hence this argument of declaring the order of this Jabalpur bench as incuriam is contemptuous. If it were so then Hon'ble High Court of M.P. where the order of this tribunal was challenged would not have decided not to interfere with the order of the tribunal and simply disposed of their petition with the only relief that the representation should be decided by KVS individually by going into individual cases as well as transfer guidelines. Hence this issue is already closed, and we are not inclined to examine afresh the already decided issue. 19.2 Secondly, there has been an argument that the representations that have been rejected by way of the so-called reasoned and speaking order is actually not reasoned and it is a stereotype order. Each and every order of rejection has the same Page 123 of 127 OAs Nos. 241/2023 & other connected OAs 124 wording and the same paragraph setting with a minor change of the name of the teacher whose representation is being rejected and simply stating that the teacher has been staying at that particular place for so many years. Learned counsel for the respondents have again opposed this line of argument and said that the doctrine of useless formality needs to be invoked. In fact stating the same ground again and again and then rejecting it would have been nothing but an useless formality. He has further argued that the suspension of para 6.1 which talks about the displacement count would have made no difference because this was kept in abeyance. Learned counsel for the respondents have also argued that the counsel for applicant have not understood the purport of para 6 which deals with displacement Count. This displacement count is actually not meant for the teacher who is being assigned a particular number as displacement count. It is basically done with the objective of accommodating a teacher who is coming from a hard station at a particular place. When she/he is to be accommodated, then who will she/he replace is to be decided with the help of this displacement count. So this displacement count is not being calculated with the purpose of retaining a teacher. Rather it is being counted to decide as to who will be sent away to accommodate the incoming teacher. OAs Nos. 241/2023 & other connected OAs 125 So this displacement count discussion is a misconceived point so far as learned counsel for the applicant are concerned. 19.3 Thirdly, learned counsel for the applicant have said that KVS has not followed the order of Honourable High Court in true spirit. Honourable High Court of Madhya Pradesh has passed an order that the representation of each and every teacher should be decided on the basis of individual hardships that have been stated in their representation as well as transfer guidelines. Since it is a Judicial pronouncement with regard to transfer guidelines so it will supersede the executive instructions of suspending some of the paras of the transfer guidelines. They also argued that the board of governor should have considered this matter before suspending any para of the transfer guidelines. Counsel for the respondent has again opposed and said that in para 13, the power to relax these guidelines is conferred in the commissioner who with the concurrence of the chairman that happens to be union Minister for education can relax these guidelines and there is nothing wrong in it. It is nowhere written that the board of governors will consider relaxing this guideline. The decision with regard to relaxation of rules has actually been taken by the commissioner with the approval of the chairman who happens to be the Union Minister. This tribunal will not like to go into this question because once the judicial pronouncement of Hon'ble High Court of Page 125 of 127 OAs Nos. 241/2023 & other connected OAs 126 M.P. has already been made, then it will supersede all the executive instruction and the order of High Court should always be respected. In view of the fact that the representations have been considered on the basis of individual hardships alone needs to be reconsidered and all the transfer guidelines should be taken into account before arriving at a final decision with regard to either acceptance or rejection of the representation made by individual teachers.
20. The fact also remains that the KVS academic session for 2022-23 is already over and the new session 2023-24 has begun. Right now summer vacations have started so it gives ample time and opportunity for KVS to consider individual representations and decide as per the direction issued by Honourable High Court of Madhya Pradesh. The suggestion of referring this Tribunal's order rejecting the transfer orders matter in previous round of litigation leading to dismissal of Bunch of OAs to the Principal Bench is rejected and the part that representation should be considered as per the order of the High Court is left to KVS.
21. The matter is remitted back to the respondents with a direction to consider afresh the representation of the applicants by passing a reasoned and speaking order in accordance with directives issued by the Hon'ble High Court of M.P. vide its order dated 03.03.2023 within a period of 90 days from the date of receipt of Page 126 of 127 OAs Nos. 241/2023 & other connected OAs 127 certified copy of this order under intimation to the applicants. The interim relief granted during the pendency of these Original Applications is vacated in line with the observation made by the Hon'ble High Court of M.P. in some of the petitions of individual teachers that has also landed up before this tribunal in the form of O.A. No. 437/2023 (Aruna Tiwari v/s KVS).
22. All the Original Applications stand disposed of with the aforesaid terms. There shall be no order as to costs.
