Section 9 in Jammu and Kashmir Prohibition of Benami Property Transactions Act, 2018

9. Qualifications for appointment of Chairperson and Members.

(1)A person shall not be qualified for appointment as the Chairperson or a Member of the Adjudicating Authority unless he,-
(a)has been a member of the all India Service or the Jammu and Kashmir Administrative Service and has held the post of Secretary to Government or equivalent in these services ; or
(b)has been a member of the Jammu and Kashmir Legal (Gazetted) Service and has held the post of Secretary to Government in that Service.
(2)The Chairperson and other Members of the Adjudicating Authority shall be appointed by the Government on the recommendation of a Search-cum-Selection Committee consisting of the following :
(a) Chief Secretary Chairperson
(b) Administrative Secretary, Home Department Member
(c) Administrative Secretary, GeneralAdministration Department Member
(d) Administrative Secretary, Department of Law,Justice and Parliamentary Affairs Member
(3)The Government shall appoint the senior most Member to be the Chairperson of the Adjudicating Authority.
