This Court passed the following interim order on the contempt
petition: -
"Civil Revision No.1692 of 2002 came up for
consideration before this court
default.
Since, the main writ petition itself has been dismissed,
therefore, the contempt petition qua alleged violation of the interim order
passed ... that writ petition or the contempt petition arising from another
order passed in earlier contempt petition arising from such interim order
cannot be continued
next date of hearing. In the meantime, the present contempt petition filed
pleading violation of interim protection.
There is no representation on behalf ... called for in
contempt petition filed for violation of the interim order. The contempt petition is
dismissed with liberty to the petitioner to revive
vacation of stay order dated 2.7.2012 in the writ petition and the instant
contempt petition were filed on 3.10.2012 simultaneously in this Court
through ... factum of filing of the application for vacation of interim order in the
instant contempt petition. This Court is of the view that the petitioner
circumstances as the
impugned orders no longer survive being interim orders passed in
contempt petitions which have subsequently been decided as infructuous,
the respondents ... infructuous on
20.12.2021, in view of the impugned interim order passed in the contempt
petition. He submits that it may be observed that the order
reply, respondent, has submitted that the
present contempt petition is hopelessly time barred as
interim order is dated 09.10.1997 whereas the present

been eroded by vacation of interim order.

order whereas main suit has been decided against ... Regular Second Appeal is pending in
which there is no interim protection.
The contempt petition is dismissed for non-prosecution

interim order, contempt petition cannot be proceeded with as
on date.
In view of above, contempt petition is disposed of at this
stage with liberty ... cause of action survives
either after decision of the LPA or the interim order is modified.
