Marketing (India), and purchased 11 batteries of Q.Rich 160 from the
complainant firm, and the complainant firm issued ... that Ld Trial Court had failed to appreciate the fact that the batteries supplied
were defective and could not be used for any purpose
Jaitpur. It is also
alleged that on 05.10.2015, accused got recovered battery belonging to
complainant from his juggi and thereafter, accused was arrested in this ... they could not be apprehended. The accused
got recovered one inverter battery and one battery of four wheeler and
some kabada. The police had seized
about 11:00 PM, near Peeragarhi Flyover, four boys
sat in his battery rickshaw and asked him to go to Nihal Vihar.
When the complainant ... asked him that his
mobile phone had fallen. The complainant stopped his battery
rickshaw, then one boy Saurav S/o Gaurav apprehended him and
another
belonging to
the complainant Sumit Wadhwa which was containing one old battery of
Nokia, one battery of Samsung, one hands free lead, 7 chargers ... property i.e. one mobile cover of Nokia body, 13 chargers, six
batteries and one ear phone were also seized vide seizure memo
spot as to who were owners of the 35 ERickshaws
whose batteries were illegally charged with stolen electricity. There
is no independent witness either ... prove the
fact that the accused was illegally recharging the batteries of 35 E
Rickshaws which were allegedly found at the spot
