The Medical Council being an expert body, if a policy decision has been taken by it as regards the necessity of asking a student having a degree form some foreign universities to undergo a screening test, no fault can be fund therewith. The said policy decision has also been upheld by the Apex Court in Medical Council of India v. Indian Doctors from Russia Welfare Association and Ors. (supra) to the extent that subject to the guidelines issued by the Apex Court, the validity thereof has been upheld and as such, the same would be a law which would be binding on this court.
