This judgment shall dispose of a bunch of RFA Nos.2250 to 2256 of 1990 and 1480 of 1991 filed by the claimants/land owners and RFA Nos.1598 to 1600 of 1991 and 493 to 502 of 1992 filed by the State of Punjab. Since identical questions of law and facts are involved in all the aforesaid appeals, however, the facts are being taken from RFA No.2250 of 1990 titled as Balwant Singh Vs. Punjab State and others.

Petitioner has approached this Court with a prayer that as per the merit list belonging to the Scheduled Caste (Others) Category, his name finds mention at Sr. No. 4 in the waiting list whereas in the list of selected candidates, candidates at Sr. Nos. 5, 13, 25, 33 and 45 in the Scheduled Caste (Others) Category have secured more than 28 marks and, therefore, they are entitled to be considered and placed in the General Category selected candidates. Petitioner has, therefore, an opportunity to be appointed against the Scheduled Caste (Others) Category. Reliance has been placed by CWP No. 4950 of 2013 2 the petitioner on the directions issued by this Court in CWP No. 601 of 2012 titled as Balwant Singh vs. State of Punjab and others, decided on 10.01.2012 (Annexure P-3) and the law laid down by this Court in CWP No. 6915 of 2012 titled as Gurpreet Singh vs. State of Punjab and others, decided on 29.05.2012 (Annexure P-4) which would entitle the petitioner to the claim, as has been made by him in the present writ petition.
