759. It is submitted that constitutional avenues for enforcement of contractual obligations should not be encouraged. Reliance has also been made of the case of Silppi Constructions Contractors Vs Union of India and Anr. reported in (2020) 16 SCC 489. In the said case the Hon'ble Supreme Court has laid down the necessity of an exercise of restraint and caution on the part of the Court in interfering in contractual matters.

Juxtaposed, in the present case it is not the tender process as such which has been cancelled but only the bid of the petitioner which has been held to be technically non-responsive by the DFO, Dhemaji without any authority of law.
