28. As regards, the Judgment of the Hon'ble Supreme Court in
Union of India State of Uttar Pradesh, (2007) 11 SCC 324 relied by
learned Government Advocate for the first to third respondents, the
learned counsel for the petitioner submits that the said judgment has no
resemblance or nexus to the facts and circumstances of the instant Writ
Petition and hence, the ratio is not applicable to the instant case.
