No. 13/49/2003-5B&R-II/149. - In view of the decision dated 17th of October, 2003 of the Council of Ministers, Punjab approving the proposal of the Department of Rural Development and Panchayats and in exercise of the powers conferred under Sections 30, 31, 119, 120 and 180 of the Punjab Panchayati Raj Act, 1994 (Punjab Act No. 9) and all other powers enabling him in this behalf, the Governor of Punjab is pleased to transfer the 876 Single Village Rural Water Supply Schemes alongwith their functions, funds and functionaries, so appointed on these schemes, of the Department of Public Health, Punjab as indicated in the Annexure-I, to Department of Rural Development and Panchayats, Punjab, subject to the stipulations in the schedule appended as Annexure-II. Annexure-IITransfer of 876 Single Village Water Supply Scheme of the Department of Public Health to the Panchayati Raj Institution under the Programme of devolution of powers will be subject to the following conditions :-
(i)The employees so transferred alongwith schemes, shall remain on deputation with the concerned PRI till further orders without deputation allowance.
(ii)The overall administrative control of the staff will be transferred to the concerned PRIs.
(iii)The term 'Administrative Control' will imply ensuring Proper attendance of staff at the scheme and sanctioning of their casual leave.
(iv)Power to punish them under the relevant Civil Services Rules, Punishment and Appeal Rules will remain with the parent department, i.e., the Department of Public Health.
(v)In the event of any minor and major lapse found in the performance of duties by any of the staff members, the concerned PRI will recommend suitable punishment to the parent department, i.e. the Department of Public Health.
(vi)The payment of salaries of these transferred staff will be made by the Public Health Department till 28th February, 2004. The authority to make salary payments with effect from 1st March, 2004 will be notified later.
(vii)User charges will be collected by Village Water and Sanitation Committee (VWSC) with effect from 1st April, 2004. The pump operator will assist the VWSC in collections.
(viii)Village Water and Sanitation Committee/Gram Panchayat (G.P.) shall operate cashbook and bank account. Routine expenditure of G.P. shall in no case be amalgamated with VWSC account.
(ix)User charges are to be kept in a separate account of VWSC/GP.
(x)Grants received from Government/other sources for drinking water supply will also be kept in a separate account of VWSC.
