Section 37(1) in West Bengal Trade Unions Rules, 1998

(1)
(a)It shall be the general duty of the Returning Officer at any election to do all such acts and things as may be necessary for effectively conducting the election in the manner provided in these rules.
(b)The Returning Officer shall, with the prior approval of the Registrar, provide sufficient number of polling stations for an election in consultation with the contesting Trade Unions and shall publish, not later than 12 days before the date of the poll, a list showing such polling stations and the area for which they shall be set up. The Returning Officer shall also display the list in his office notice board and send copies thereof to the contesting Trade Unions as well as the management of the concerned establishments.
(c)The Returning Officer shall appoint a Presiding Officer for each polling station and such other Polling Officer or officers to assist the Presiding Officer as he may think necessary.
(d)A Polling Officer shall, if so directed, in writing, by the Presiding Officer, perform all or any of the functions of the Presiding Officer under these rules.
(e)If the Presiding Officer. owing to his illness or any other reason whatsoever, absents himself from the polling station, the functions of such Presiding Officer shall be performed by such Polling Officer as has been perviously authorised by the Returning Officer to perform such functions during any such absence.
(f)It shall be the general duty of the Presiding Officer at a polling station to keep order there and to see that poll is freely and fairly taken and counting of votes is freely done.
