(laptop)-05-03/2011-1518. - In exercise of the powers conferred by section 8 of the Bihar Legislature (Members' Pay, Allowances and Pension) Act, 2006, (Bihar Act 16 of 2006) The Governor of Bihar is pleased to make the following Rules:- Bihar Legislature (Facility of Computer Equipment to Member) Rules, 2011

1. Short Title, Extent and Commencement.

(1)These rules may be called The Bihar Legislature (Facility of Computer Equipment to Member) Rules, 2011

(2)It shall extend to Members of Bihar Legislature.

(3)It shall come in force from the date of notification.

2. Definitions.

- In these rules, unless the context otherwise requires:-

(a)"Act" means Bihar Legislature (Members' Pay, Allowances and Pension) Act, 2006;

(b)"Assembly Secretariat" means the Bihar Legislative Assembly Secretariat;

(c)"Council Secretariat" means the Bihar Legislative Council Secretariat;

(d)"Member" means a Member of Bihar Legislature;

(e)"Appendix" means an Appendix to these rules;

(f)"Authorised dealer/supplier" means a firm authorised by an Original Equipment Manufacturer of computer equipment to sell its products;

(g)"Computer equipment" means all electronic gadgets capable of storing, retrieving, processing, scanning, transferring and printing of data by whatever name called, and includes all equipment specified in the Annexure;

(h)"Procedure" means the detailed procedure of procurement of computer equipment and reimbursement/ advance payment to the members under the scheme;

(i)"Scheme" means the Scheme of financial entitlement of Members of Bihar Legislature for purchase of Computer Equipment;

(j)"Software" means a programme or a set of programmes used to operate a computer, and includes system software.

(k)Words and Expressions used in this Rules but not defined shall have the same meaning which are assigned to them in the Act.

3. Scheme and Procedure of Financial Entitlement of Members for Computer Equipment.

(1)Computer equipment shall be procured by the Members through a Scheme of financial entitlement.

(i)The financial entitlement of a Member for purchasing computer equipment and software under the Scheme during his term as Member of Bihar Legislature shall be upto Rs. 1,00,000/- (One Lac).

(ii)Notwithstanding other conditions under these Rules, a member of the Legislature who has already been provided with Laptop Computer may opt for the New Scheme. Provided that, he/she shall have to either deposit the amount equal to depreciated value of the Laptop Computer to the Secretariat of the Assembly/Council or have to give a letter of intention to the Assembly/Council to the effect to deduct the said amount from the amount of the New Scheme. The depreciated value of Laptop computer shall be determined by Bihar State Electronics Development Corporation Ltd. (BELTRON).

(2)A member shall be entitled to purchase any or all of the items of computer equipments specified in the Appendix-1 under this Scheme.

(3)A member shall be free to purchase any model of the computer equipment and software, specified in the Appendix, at any time during his term. He/She shall be equally free to purchase more than one unit of computer equipment specified in the Appendix subject to the condition that the total amount of reimbursement/ payment shall not exceed the entitlement under clause (i) of sub-rule(1) of this rule.Provided that in case the cost of equipment purchased by a Member exceeds his/her financial entitlement, the difference amount thereof shall be borne by the Member himself/herself.

(4)A member shall purchase the specified brand of computer in Annexure- II from the authorised dealer/supplier.

(5)A member shall be free to purchase any brand of Printer, Scanner and UPS.

(6)The financial entitlement of a Member shall be the amount fixed on the date of purchase of computer equipment. Where a member purchases computer equipment in parts, he is entitled to get reimbursement to the extent of amount fixed at the time of procurement of computer equipment first time. His/Her entitlement shall not be affected by increase/decrease in the amount subsequent to his first procurement.

(7)The computer equipment purchased by a Member under the Scheme shall remain with him/her. However, he/she shall have to deposit depreciated cost of the computer equipment as per prevailing Income Tax Rules if he ceases to be a member.

4. Advance Payment.

- The Assembly/Council Secretariat shall make advance payment to the member against Pro forma Invoice issued by the Authorised dealer/ supplier.

5. Maintenance of account and audit.

- The members shall make available the proof of purchase in original duly attested by him within 30 days from the date of release of payment against pro forma invoice to the Assembly Secretariat/Council Secretariat for the purpose of maintenance of account and audit. A bill/cash memo, issued by the supplier, would constitute an admissible proof of purchase provided it contains/reflects the following:-

(i)the serial number of each equipment sold;

(ii)the fact that the goods have been delivered;

(iii)the fact that the payment has been received in full.

6. Maintenance and Insurance of Computer Equipment.

- It shall be for the member to decide if he/she wishes to get the computer equipment purchased under the scheme insured. The arrangement for insurance & maintenance of the computer equipment shall be made by the member himself/herself.Appendix-IItems of Computer Equipment and Software
