Procedure (for short the Code) by the petitioners seeking
transposition of the respondent Nos. 2 to 4as party plaintiffs in a suit ... they are
required to be construed as plaintiffs by applying principle of transposition.
3. Before appreciating rival contentions of the parties, it is necessary
petition. Another prayer has been made
by the petitioner seeking transposition of the petitioner No. 2 as respondent
to these proceedings.
For the reasons stated
petitioner have been brough on record nor
there is any transposition of one of the respondents as petitioner, which is the
requirement
counsel for the petitioner sought time to lay a motion for transposition
of petitioner no. 1 as respondent.
Today, however, learned counsel for the petitioner ... this regard for doing the needful.
Let the needful be done for transposition of petitioner nos. 1 and 2 by or
before next date.
