This is an application for releasing 70 per cent of the award amount in favour of respondent No. 1.
From perusal of the record, it transpires that an amount of Rs. 6,45,524/- deposited before the concerned Assistant Labour Commissioner, Jammu has been received by the Registry.
Since the appeal is primarily on the quantum and therefore, it will be in the interest of justice, of, at least, 50 per cent of the total amount is released in favour of respondent No. 1. Ordered accordingly.
The release of 50 per cent of the award amount as directed above shall, however, be subject to respondent No. 1 submitting an undertaking to the Court that in case he fails or is called upon by this Court to pay back the whole or part of the released amount, he will deposit the same within one month from the date of passing of such order.
