The Delhi Metro Railway (Prohibition of Carriage of Large-Sized Luggage, Carriage of Offensive and Dangerous Goods in the Metro Railway, Travelling of Persons Suffering From Infectious and Contagious Diseases in the Metro Railway and Value, Period of Validity and Such Other Particulars Indicated in the Ticket Issued by the Metro Railway) Rules, 2002Published vide Notification No. G.S.R. 819 (E), dated 10th December, 2002, Gazette of India, Extraordinary, Part 2, Section 3(1) dated 11.12.2002 (w.e.f. 11.12.2002)G.S.R. 819 (E), dated 10th December, 2002. - In exercise of the powers conferred by Section 32, of the [Delhi Metro Railway (Operation and Maintenance) Ordinance, 2002 (Order 7 of 2002),] [Now see the Delhi Metro Railway (Operation and Maintenance) Act, 2002 (60 of 2002).] the Central Government hereby makes the following rules, namely:-

1. Short title and commencement.

(1)These rules may be called the Delhi Metro Railway (Prohibition of Carriage of Large-sized Luggage, Carriage of Offensive and Dangerous Goods in the Metro Railway, Travelling of Persons suffering from Infectious and Contagious Diseases in the Metro Railway and Value, Period of Validity and such other particulars indicated in the Ticket issued by the Metro Railway) Rules, 2002.

(2)They shall come into force on the date of their publication in the Official Gazette.

2. Definitions.

(1)In these rules, unless the context otherwise requires,-

(a)"Authorised" means authorised by metro railway administration ;

(b)"metro railway" means rail-guided mass rapid transit system having dedicated right-of-way, with steel wheel or rubber-tyred wheel coaches, but excluding tramways, for carriage of passengers and includes,-

(i)all land within the boundary marks indicating the limits of the land appurtenant to a metro railway ;

(ii)all rails tracks, sidings, yards or branches worked over for the purposes of, or in connection with, a metro railway ;

(iii)all stations, offices, ventilation shafts and ducts, warehouses, workshops, manufactories, fixed plants and machineries, sheds, depots and other works constructed for the purpose of, or in connection with a metro railway ;

(c)"metro railway administration" in relation to,-

(i)a Government metro railway means the General Manager of that railway; or

(ii)a non-Government metro, railway means the person who is the owner or lessee of that metro railway, or the person working that metro railway under an arrangement with the owner or lessee of the metro railway ;

(d)"notification" means a notification published in the Official Gazette; and

(e)"Ordinance" means the [Delhi Metro Railway (Operation and Maintenance) Ordinance, 2002 (Ordinance 7 of 2002).] [Now see the Delhi Metro Railway (Operation and Maintenance) Act, 2002 (Act 60 of 2002).]

3. Carriage of goods or luggage.

- No person shall, while travelling in metro railway, carry within him any goods other than a small baggage containing personal belongings not exceeding 60 cm x 45 cm 25 cm in size and 15 kg. in weight, except with the price approval of the metro railway administration.

4. Prohibition against carriage of dangerous and offensive goods.

(1)No person shall take or cause to be taken on the metro railway the following dangerous materials, namely-

(a)Explosive substances which possess risk of explosion or fire or both ;

(b)Gases compressed, liquefied or dissolved under pressure ;

(c)Petroleum and other inflammable liquids ;

(d)Inflammable solids;

(e)Oxidizing substances ;

(f)Poisonous (toxic) substances ;

(g)Acids and other corrosives ;

(h)Radio active substances ; and

(i)Any other article declared as dangerous material by the metro railway administration from time to time.

(2)No person shall take or cause to be taken on the metro railway the following offensive materials, namely-

(a)Blood, dried ;

(b)Corpses ;

(c)Carcasses of dead animals ;

(d)Bones excluding bleached and cleaned bones ;

(e)Manure of any kind ;

(f)Rags, including oily rags ;

(g)Any decayed animal or vegetable matter ;

(h)Human ashes ;

(i)Human skeleton ; ,

(j)Parts of human body ; and

(k)Any other article declared as offensive material by the metro railway administration from time to time.

(3)If any metro railway official has reason to believe that any person is carrying with him, in a container of any form, or otherwise, any dangerous or offensive material, he may cause such container to be opened by its carrier for the purposes of ascertaining its contents.

(4)Any metro railway official may remove from the metro railway any person taking with him any dangerous or offensive material.

Notwithstanding anything contained in these rules, the members of the Armed Forces of the Union Government, State Police, the para-military forces, the National Cadet Corps, and other uniformed forces of the Central Government, State Governments and Union Territory's Governments, while on metro railway in the course of their duty, shall carry the authorised weapons, arms and ammunition.

6. Application of other Acts and Rules.

(1)Nothing in these rules shall be deemed to detract from the operation of-

(a)Explosive Act, 1884 (Act 4 of 1884);

(b)Explosive Rules, 1983 ;

(c)The Indian Arms Act, 1959 (Act 54 of 1959); or

(d)The Indian Arms Rules, 1962.

(2)Nothing in these rules shall prevent carrying of one piece of safety match box or a gas lighter on his person by a metro railway passenger.

7. Diseases declared to be infectious and contagious.

- No person suffering from any one or more of the following infectious or contagious diseases shall travel by the metro railway, namely-

(a)Cerebro-Spinal Meningitis;

(b)Chicken-pox ;

(c)Cholera ;

(d)Diphtheria ;

(e)Measles ;

(f)Mumps;

(g)Scarlet fever ;

(h)Typhus fever ;

(i)Typhoid fever ; and

(j)Whooping cough :

Provided that in the case of closed (non-infective) leprosy patient carrying a certificate from a Registered Medical Practitioner certifying him to be non-infective shall travel by the metro railway.

8. Particulars of ticket.

(1)Any person desirous of travelling on the metro railway shall, upon payment of fare, be issued with a ticket by the metro railway administration or an agent authorised in this behalf.

(2)The ticket issued under sub-rule (1) shall be of two types, namely-

(i)contactless smart card for multiple journeys ; and

(ii)contactless smart token for single or two journeys.

(3)

(i)Contactless smart card shall be a stored value card and its value shall be encoded in the card and it shall be issued in three denominations, namely, Rs. 100, Rs. 200 and Rs. 500.

(ii)After the value of the contactless smart card getting exhausted on undertaking multiple journeys, it shall be possible to get it re-charged by making additional payment.

(iii)The maximum value for which contactless smart card can be recharged shall be Rs. 800 ; and

(iv)Validity period of contactless smart card shall be one year from the date of its issue.

(4)Contactless smart token shall be blue token for single journey and red token for two journeys. The value of contactless smart token shall be as per the fare as specified in the fare table published by the metro railway administration from time to time :-

(i)Blue token shall be captured at the end of the journey in the system provided at the exit gate. Fare paid shall be encoded on the blue token and its period of validity shall be one day.

(ii)Red token shall be captured at the end of the second journey in the system provided at the exit gate. Fare paid shall be encoded on the red token and its period of validity shall be two days.
