The Cuttack Municipal Council Control and Supervision of Slaughter Houses and Business Carried on by Butchers Bye-laws, 1980

1.

(a)These bye-laws may be called "The Cuttack Municipal Council Control and Supervision of Slaughter Houses and Business Carried on by Butchers Bye-law, 1980".
(b)They shall come into force at once.

2.

The pattadar of slaughter house within 20 days from the date of enforcement of these bye-laws shall furnish to the Executive Officer, Cuttack Municipality, the names of all those persons who on his behalf shall kill castrated goats and sheep and barren she-goats and ewe for the purpose of sale of their meat. The Executive Officer shall forthwith inform the Health Officer of these names.

3.

No sheep or goat of any kind below one year of age shall be slaughtered in the slaughter house.

4.

No butcher other than those registered and licensed in Cuttack Municipal Office or whose names have been furnished to the Executive Officer by the pattadar under Bye-law 2 above shall sell in Municipal area the meat of any castrated-goats and sheep or barren sheep, goats and ewe killed by them.

5.

(i)Everyday by 7 a.m. in winter season (from November to February) 6 a.m. in summer season from March to October) butchers shall offer to the Health Officer or Veterinary Surgeon or authorized Health Inspector of Cuttack Municipality for inspection in the Municipal slaughter house all castrated goats and sheep and barren she-goats and ewe they intend to kill that day and will kill within the fixed hours only such of them as have been passed by the Health Officer or Health Inspector as free from diseases and fit for human consumption.
(ii)The butchers shall in case of necessity kill at slaughter house between 8 a.m. to 4 p.m. on any day castrated goats and sheep or barren she-goats and ewe with the previous recommendation of the Health Officer after examination of beasts as aforesaid.
(iii)When the slaughtering of sheep or goat in places other than Public Slaughter Houses has been prohibited under Section 314 of the Orissa Municipal Act, 1950, no sheep or goat etc. as aforesaid shall be killed outside the slaughter house unless otherwise specifically provided under the Act or rules thereunder.

(i)The butchers shall take off the skin of the castrated goats and sheep or barren she-goats and ewe which they have killed and without cutting the meat and bones thereof into pieces, shall keep the killed and skinned animal hung up by means of ropes tied to their hind legs.
(ii)For the purpose of distinguishing the sex of the animals killed the tails and the skin to the extent of 3 inches just below the tails of the animals shall not be removed.

7.

(i)After a castrated goat or sheep or barren she-goat or ewe has been killed and skinned, the Health Officer of Cuttack Municipality or any other officer authorised for the name by the Executive Officer or the Health Officer, shall impress his seal mark on one of its hind legs and the impressed spot be kept unremoved for the purpose of identification. No meat of any killed goat or sheep bearing no seal mark shall be sold.
(ii)The licensed meat-shall keepers to whom the licence has been issued by the Cuttack Municipality for sale of meat shall take the said sealed goats or sheep for the purpose of sale in their respective stalls specified in the licence in the town without cutting any portion of the body of the animal and keep the same hung up by means of ropes tied to their hind legs, For the purpose of distinguishing the sex of the animal and for identifying the same by the customers and public, the tails and skin to the extent of 3 inches just below the tail of the animal shall not be removed.
(iii)Meat from such part of the body of the animal as would be wanted by the customers may be cut and sold.

No she-goat or ewe except barren she-goat and ewe shall be killed for meat of any such she-goat or ewe shall be sold within the Municipal area.

9.

The pattadar of slaughter house and licensed meat-stall keeper shall maintain the slaughter house and sale premises and shall in neat and hygienic condition.

10.

The pattadar of slaughter houses or licensed dealers shall make adequate arrangements in the slaughter houses tor hygienic facilities like space, water, electricity and as far as possible, for cold storage.

11.

(1)The licensed meat-stall keepers have to sell the meat at the prescribed rates as will be specified by the Cuttack Municipal Council from time to time.
(ii)An Oriya copy of the price list of meat shall be kept hung up in front of the slaughter house and the meat stalls and any other places where the meat is permitted to be sold by the Executive Officer of Cuttack Municipality.

12.

The Health Officer or the authorised Health Inspectors of Cuttack Municipality may enter into or inspect the slaughter house or premises used for sale of meat at any time during the day and the pattadar of the licensed dealer, as the case may be, shall allow him to inspect or give such information as may be required by the said Inspecting Officer.

13.

The unstamped carcass and meat of the animals exposed for sale for human consumption if detected at any place or time the Health inspectors of Municipal Council, Cuttack shall seize the unstamped carcass and meat of animals and produce either before the Health Officer or the Executive Officer. Under written order of the Health Officer or Executive Officer of Cuttack Municipal Council the said unstamped carcass and meat of animal are to be destroyed.

14.

These bye-laws are enforceable in addition to the provisions laid down under the Orissa Municipal Act and rules framed thereunder and the provisions made under laws in force providing and regulating the slaughter houses and sale of meat for human consumption.

15.

Any breach or violation of any of the above bye-laws or conditions herein by any person shall be punishable-
(a)with a fine which may extend to fifty rupees and in case of continuing breach with a fine which may extend to fifteen rupees for everyday during which the breach continues after conviction for the first breach
(b)with a fine which may extend to ten rupees for everyday during which the breach continues after receipt of notice from Chairman or Executive Officer or Health Officer of the Cuttack Municipality to discontinue such breach.
