6. Ms. Neeraja Karanth submits that the civil
Court is persuaded to reject the application for leave
to withdraw the suit under Order XXIII Rule 1(3) read
with Section 151 of CPC only because of a decision of
the High Court of Himachal Pradesh in the case of
Promila Bakshi and Others Vs. Ashok Bhatia and
Others reported in AIR 2007 Himachal pradesh
