Per contra, counsel for the State relied on a judgment delivered by the
Co-ordinate Bench in the case of Sahid Khan & Others v/s The State of
Madhya Pradesh & Others reported in 2013 (4) M.P.L.J. 439 . He referred to
paras - 37 & 52 to 57 of the said judgment to submit that it is well within the
competence of the State Government to prescribe such condition in the
permit.
