The University of (Amending and Validating) Act, 1964Act No. 10 of 1964[Received the assent of the Governor on the 1st day of April, 1964.]Notification No. 7(7)-L/64, dated 1-4-1964, Published in Rajasthan Gazette, Extraordinary, Part IV-A, dated 2-4-1964, page 33. - The following Act of the Rajasthan State Legislature received the assent of the Governor on the 1st day of April, 1964, and is published for general information.-An Act further to amend the University of Rajasthan Act, 1946 in the manner hereinafter appearing, and to provide for the validation of the re-constituted Senate and Syndicate, continuance in office of the members thereof, and certain other matters connected therewith.Be it enacted by the Rajasthan State Legislature in the Fifteenth Year of the Republic of India as follows:-

1. Short title and commencement.

(1)This Act may be called the University of Rajasthan (Amending and Validating) Act, 1964.
(2)It shall come into force at once.

2. Definition.

- In this Act, unless the subject or context otherwise requires,-
(i)"amending act" means the University of Rajasthan (Amendment) Act, 1962;
(ii)"Deans" in relation to the members of the reconstituted Syndicate, means the Deans of the Faculties of Arts, Science and Medicine respectively;
(iii)"Principal Act" means the University of Rajasthan Act, 1946, as amended by the Amending Act;
(iv)"Re-constituted authorities" means the State and Syndicate of the University of Rajasthan, as first re-constituted after the commencement of the amending Act;
(v)"Removal of difficulties order" means the University of Rajasthan (Removal of Difficulties) (First) Order, 1962, dated 28th day of November, 1962.

3. Amendment of section 5, the University of Rajasthan Act, 1946.

- In section 5 of the principal Act, for the words "Rajasthan Agricultural" the word "Udaipur" shall be substituted.

4. Amendment of section 12, the University of Rajasthan Act, 1946.

- In section 12 of the principal Act, after sub-section (7), the following sub-section, shall be and shall be deemed always to have been inserted as if the provision thereof were in force on the date on which the Vice-Chancellor holding officer, immediately before the commencement of the amending Act, took charge of the duties of his office, namely:-"(8) The term of the office of the Vice-Chancellor shall commence with effect from the date of joining the duties of his office."

5. Validation of the re-constituted authorities and other matters.

- Notwithstanding anything contained in the principal Act or in any judgment, decree or order or any court of any defect in the removal of Difficulties Order,-
(i)the re-constituted authorities shall be, and shall be deemed always to have been, validly constituted and shall function and shall be deemed always to have functioned as validly constituted bodies till another Senate and Syndicate are constituted in accordance with the provisions of the principal Act;
(ii)all the members of the re-constituted authorities including the Vice-Chancellor and the Deans, shall be deemed always to have been validly appointed and continued, as members of a validly re- constituted Senate or Syndicate, as the case may be, till another Senate and Syndicate are constituted in accordance with the provisions of the principal Act;
(iii)any action taken, resolution passed, nomination, appointment and recommendation made, by the re-constituted authorities, shall be deemed to have been validly taken, passed or made; and
(vi)the said University shall be, and shall be deemed always to have been, competent to convene the meetings and enforce the decisions of the re-constituted authorities.

6. Repeal of Rajasthan Ordinance 3 of 1964.

- The University of Rajasthan (Validation of the Re-constituted Authorities) Ordinance, 1964 is hereby repealed but not so as to affect the previous operation of the provisions thereof or as respect any action or things taken or done thereunder.
