Section 16 in The Punjab Panchayat Samitis and Zila Parishads Services Rules, 1965

16. Relaxation.

- Where the Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these Rules, with respect to any class or category or persons]. The Punjab Service (Medical Attendance) Rules, 1940 shall apply mutatus mutandis to the members of the punjab Panchayats Samitis and Zila Parishads Services in so far as they are not inconsistent with the provisions of the Punjab Panchayat Samitis and Zila Parishad Act, 1961 and the rules made there under.Provided that the word 'Government' and the words Government servants where ever occurring in the aforesaid rules, the words Panchayat Samiti or Zila Parishad as the case may, and the words, Members of the Punjab Panchayat Samitis and Zila Parishad Services "shall respectively be deemed to have been substituted]. Notes:
(1)Knowledge of Hindi or/and Punjabi will be essential for all incumbents of post of the extent prescribed by the Government for similar categories employees from time to time in accordance with their policy.
(2)The employees of the Zila Parishads or Panchayat Samitis who were working in the district Boards immediately before their abolition and have been continuing in service since then shall draw their pay and allowances in the scales held by them immediately before the enforcement of these rules.Provided that an employee may exercise his option for the scale prescribed in these rules for the post held by him within a period of six month of the commencement of these rules and in that case his pay will be fixed in the scale as provided in these rules in accordance with the provisions of note 4 below.
(3)The concession of rent-free accommodation or in lieu thereof ten percent of their pay subject to a maximum of ten rupees is permissible to the Veterinary Compounders, Nurse Dias and Dispensers working in the Civil Dispensaries.
(4)The Secretaries of Gram Panchayat who were appointed as such before commencement of these rules shall be deemed to have been appointed by the Panchayat Samiti concerned, and their pay will be fixed in the following manner:-
(a)If the pay drawn by him immediately before the commencement of these rules fits in the new scale, specified in these rules at any stage his pay will be fixed in the new scale at that stage;
(b)If the pay drawn by him immediately before the commencement of these rules does not fit in at any stage in the new scale, his pay will be fixed in the new scale at a stage next below that pay which is being drawn by him immediately before such commencement:
Provided that the pay drawn by him immediately before the commencement of these rules will not be affected and the difference between his pay and the stage at which the same is fixed shall be treated as personal pay and shall be absorbed at the time of accrual of the next grade increment.
