The Rajasthan Insecticides (Appeal) Rules, 1980Published vide Notification No. F. 4(3) Agr/Gr. R/A/79, dated 11-8-1980, published in Rajasthan Gazette Extraordinary, Part 4-C (2), dated 19-8-1980, page 125S.O. 59. - Whereas, a draft of the Rajasthan Insecticides (Appeal) Rules was published as required by sub-section (1) of section 37 of the Insecticides Act, 1968 (Central Act 46 of 1968) at pages 5 to 7 of part III B of the Rajasthan Rajpatra dated the 24th May, 1973, under the notification of the Government of Rajasthan, Agriculture, (Gr. II-A) Department No. F. 15 (37) Agr./Gr. 11/72, dated the 18th April, 1973, inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of thirty days from the date on which the copies of the Official Gazette containing the said notification were made available to the public:And Whereas, the said Gazette was made available to the public on the 24th May, 1973;And Whereas no objections and suggestions have been received from the public on the said draft rules;Now Therefore in exercise of the powers conferred by section 37 of the said Act, the State Government after consultation with the Central Insecticides Board hereby makes the following rules, namely:-

1. Short title and commencement.

(1)These rules may be called the Rajasthan Insecticides (Appeal) Rules, 1980.
(2)They shall come into force on the date of their publication in the Official Gazette.

2. Definition.

- In these rules, unless the context otherwise requires 'Act' means the Insecticides Act, 1968 (Central Act 46 of 1968).

3. Appeal.

(1)Any person aggrieved by a decision of the Licensing Officer under section 13 excepting under the proviso to sub-section (1) thereof, or section 14 of the Act may within a period of thirty days from the date on which the decision is communicated to him, appeal to the Director of Agriculture.
(2)The appeal shall be in writing and shall set out concisely and under distinct heads the grounds on which the appeal is preferred.
(3)Every appeal shall be accompanied by a Treasury Challan evidencing the payment of Rs. 10/- and a copy of the decision appealed against to be obtained from Licensing Officer on payment of necessary fee.
(4)The fee payable for preferring an appeal shall be deposited under the head "XXV-Agriculture (Ka) Agri-Receipts-4-other Miscellaneous Receipts."
(5)Every such appeal shall be presented either in person or through an agent duly authorised in writing in this behalf by the appellant or may be sent by registered post.

4. Procedure to be followed by the Appellate Authority.

- In deciding appeals under the Act, the Appellate Authority shall follow the same procedure which a court follows in deciding appeals from decrees or orders of an original Court under the Code of Civil Procedure, 1908 (Central Act 5 of 1908).Notifications

1. Existing Serial Number 4 and entries against it shall be deleted.
