Rule JAMMU-KASHMIR-LEGISLATIVE-ASSEMBLY-SECRETARIAT-RIGHT-TO-INFORMATION-RULES-2012 of 2012

Jammu & Kashmir Legislative Assembly Secretariat Right To Information Rules, 2012Published vide Notification dated 26.09.2012, published in the Govt. Gazette dated 26.09.2012In exercise of the powers conferred by sub-section (1) of section 25 of the Jammu and Kashmir Right to Information Act, 2009 (Act No. VIII of 2009), the Speaker, J&K Legislative Assembly hereby makes the following rules, namely:—

Chapter I
General

1.

(1)These rules may be called the Jammu and Kashmir Legislative Assembly Secretariat Right to Information Rules, 2012.
(2)These shall come into force from the date of their publication in the Official Gazette.

The words' and expressions used herein shall, unless the context otherwise requires, have the same meanings as are assigned to them in the Right to Information Act. 2009.

Chapter II
Matters Relating To Fee And Cost

(1)A request for obtaining information under sub-section (1) section 6 shall be accompanied by an application fee of rupees ten by way of cash against proper receipt;
(2)A request for obtaining information under sub-section (1) of section 6 shall be deemed to be made duly accompanied by prescribed application fee if it is written on a non-judicial stamp paper of rupees ten;
(3)The Secretary, J&K Legislative Assembly, to facilitate, may provide additionally such alternative mode for payment of fee and cost as it may deem less cumbersome and technically feasible, keeping in view the e-environment of the office. The same, however, shall be widely publicised through official website and /or print media/electronic media so that it is in public domain; and
(4)For providing the information under sub-section (1) of section 7, the fee shall be charged by way of cash against proper receipt at the following rates:—
(a)Rupees two for each page (in A-4 or A-3 size paper) created or copied;
(b)Actual charge or cost price of a copy in larger size paper;
(c)Actual cost or price for samples or models; and
(d)For inspection of records, no fee for the first hour; and a fee of rupees five for each fifteen minutes (or a fraction thereof) thereafter.

Chapter III
Miscellaneous

(1)The Speaker, J&K Legislative Assembly shall designate a Public Information Officer having the rank not below Deputy Secretary and an Assistant Public Information Officer having the rank not below Under Secretary ;
(2)The Secretary, Legislative Assembly shall periodically hold meetings with the Public Information Officer and the Assistant Public Information Officer and discuss with them the cases and remove any difficulty that may arise in the process of disposal of the cases ;
(3)All the first appeals of the appellants shall lie with the Secretary, Legislative Assembly and if the Secretary prima facie does not find merit in the appeal before taking a view in the matter; the appellant shall be provided an opportunity of being heard. The Secretary shall dispose of the appeals filed before him and intimate the appellant accordingly; and
(4)All matters not specifically provided for in these rules and all questions relating to the detailed working of these rules shall be regulated in such manner as the Speaker may from time to time, direct.
