Section 257 in Bihar Board's Miscellaneous Rules, 1958

257. Selection of sites for Central and Provincial buildings cost of which is Rs. 5,000 or more.

- The following rules have been laid down for the selection of sites for Central and Provincial buildings when cost is Rs. 5,000 or more:-[Public Works Department Circular Memo No. 5363-B, dated the 31st March, 1920].
(1)Paragraph 205, Chapter II, Public Works Department Code, Tenth Edition lays down that "the site of every building should, if possible, be definitely settled before the detailed designs and estimates are prepared" but in the orders contained in Government of India's Circular No. 6 RW., dated the 20th August, 1913, permission was given to proceed with the acquisition of a site as soon as administrative approval is accorded. The Executive Engineer should, therefore, unless instructed to the contrary, take steps to have a site selected as soon as requisition is received from a competent authority for an approximate estimate for a building project.
(2)On receipt of administrative approval to a project for which a site has not yet been duly selected, the Executive Engineer shall at once ask the District Magistrate to convene a site committee and as soon as the site has been selected, he will apply for an estimate for the acquisition of land, if necessary, and submit it with the draft declaration, through the usual channel, to the authority competent to sanction it. The amount of this estimate should be subsequently incorporated in the detailed estimate for the project.
(3)The selection of sites for buildings at places other than the New Capital Area, Patna and Ranchi shall ordinarily be made by a committee composed of-

If the proposed site is within a municipality or controlled area, the Chairman of the municipality or President of the station committee shall be a member "ex officio". Where the question of sanitary fittings and (or) pipe water-supply has to be considered, an intimation should be given to the Superintending Engineer, Public Health Engineering Department, to enable him to arrange that the Public Health Engineering Department is represented at the site committee.In outlying stations members may, on their own responsibility, depute subordinates not below the rank of a gazetted officer, to represent them.If for any reason any member of the committee cannot attend on the date fixed his opinion may be taken separately, the plans and proceedings being sent to him for the purpose by the District Officer.This committee will be assembled by the District Officer at the request of Executive Engineer."The committee should meet on the first Monday of every month, or, if the first Monday be a public holiday, on the first working day thereafter, whenever there is business to be transacted. In urgent cases the committee should meet oftener, and the meeting should be held within ten days of a requisition being received from the Executive Engineer.
(4)The Executive Engineer will prepare a plan of the site selected embodying such information on the above points as may be necessary in each case, e.g., if the site is on land liable to be flooded, the highest flood level should be shown with reference to the general level of the site. He will forward this plan with the proceedings of the Committee after both have been countersigned by the members, to the Superintending Engineer of the circle.He will be responsible for any action required under Paragraphs 206 and 207 of the Public Works Department Code and will place before the site committee an expression of opinion received from the Military Department.
(5)The Superintending Engineer will, if he agrees with the conclusion of the committee both as regards the site and arrangement of the buildings countersign the papers and forward them to the Head of the Department concerned for counter-signature and transmission to the Commissioner of the Division for signature and return to the Executive Engineer.
(6)If the members of the committee are unable to agree or if the Superintending Engineer differs from their conclusions, he will in the event of failing to come to an agreement with the President of the Committee, submit the case to the Commissioner of the Division for decision, attaching his note to the proceeding of the Committee. After deciding the case so referred, the Commissioner will communicate his decision to the Superintending Engineer and to the President of the site committee, forwarding the plans as approved to the Superintending Engineer for disposal by the Head of the Department. Whenever possible, the Superintending Engineer should discuss the matter personally with the President before forwarding the case to the Commissioner.
(7)In cases where the views of the Head of the Department differ from those of the local authorities, the matter should be referred for the decision of Government. Decision of the Government of India is required in the case of central buildings.
(8)In the case of important buildings the Governor desire that Heads of Departments will, before countersigning the plan send it to the Director of Public Health and Superintending Engineer, Public Health Engineering Department, for opinion.
(9)Two plans are required-
(a)A block plan, scale 41¼ to the inch, or, if this is too large 82½ to the inch, showing the relative position of all buildings, wells etc., included in the project as well as all existing buildings, wells, etc., in the same compound.
(b)An index plan, scale 16 or 32 inches to the miles, showing the site and its surroundings on north, south, east and west.
(10)Selection of sites for Government buildings in the New Capital Area, Patna and Ranchi (including Doranda and Hinoo). - In view of the importance of sites at the State headquarters and at Ranchi, Government have decided that a Site Selection Committee consisting of the following should be constituted for selection of sites for public buildings to be constructed in the New Capital Area, Patna and Ranchi (including Doranda and Hinoo).
