34. As held by this Court in State of Punjab v. Balwant Singh &
others (supra), quoted by my esteemed sister, the State Government
does not take the property as a rival or preferential heir of the
deceased, but as the lord paramount, when there is no heir qualified to
succeed.

(dead) by LRs.16, a two-Judge Bench of this Court analysing the
provisions of Sections 14, 15 and 16 of the Act reiterating the view taken
in the State of Punjab Vs. Balwant Singh & Ors.(Supra), observed as
under :-

21. A perusal of the aforesaid provisions would show that the basic
aim of Section 15(2) is to ensure that inherited property of an
issueless female Hindu dying intestate goes back to the source. It
was enacted to prevent inherited property falling into the hands of
strangers. This is also evident from the recommendations of the Joint
Committee of the Houses of Parliament, which have been duly noticed
by this Court in the case of State of Punjab v. Balwant Singh, 1992
Supp (3) SCC 108. The scheme underlying the introduction of the
aforesaid provision had been discussed as follows:

The Land Acquisition Collector vide Award dated 10.07.1986
determined the market value of the acquired land in village Ram Nagar at
Rs.34480/- per acre for Chahi, Rs.32480/- per acre for Chahi Nehri,
Rs.32480/- per acre for Nehri , Rs.26,000/- per acre for Gair Mumkin all
kinds and Rs.25,000/- for Barani land.

In these circumstances I set aside
Criminal Revision No. 12/2008 3 State Vs Balwant Singh
the impugned order and direct Ld. Additional Chief Metropolitan
Magistrate, New Delhi to release the passport on superdari to the
revisionist on his furnishing superdarinama in the sum of
Rs.50,000/. Apart from it the revisionist shall also furnish an
undertaking by Sh. Randhir Singh the father in law of the
revisionist that in case the revisionist does not produce the passport
as and when required by the trial court, Sh. Randhir Singh shall
deposit Rs.50,000/ with the trial court and in case he fails to
deposit this amount, his land (documents of which would be
furnished by Sh. Randhir Singh before Ld. ACMM shall be liable to
attach).
