In this regard learned senior
counsel has placed heavy reliance upon the decision of
Supreme Court Sooraj (Smt.) and others vs. S.D.O. Rehli
and others, 1995 Revenue Nirnaya 121 and Single Bench
decision of this Court Datar Singh vs. State of M.P. and
others, 1997(2) MPLJ 393. The further contention of learned
Advocate General is that if the relief sought in the plaint is
seen, one can easily say that the suit is barred under Section
46 of the Act of 1960.
