The matters are taken up for consideration subsequent to the order dated January 24, 2024.
We permitted the parties in the proceeding one opportunity to rely upon documents/materials that they wished to rely upon in the proceedings. We permitted the parties to produce the originals or such evidence in their possession by today.
Learned Deputy Solicitor General submits that, pursuant to the order dated January 24, 2024, the Central Bureau of Investigation (CBI), is producing one of the originals of the Section 65B Certificates.
57He submits that, such Certificate was obtained in the triplicate. CBI is in the possession of the two other original Section 65B Certificates. He seeks leave of the Court to file one of such originals through an affidavit. He also submits that, the original electronic devices seized were sent to Central Forensic Science Laboratory, Hyderbad, who returned the same. The original electronic devices are presently with the CBI and in fact are brought to Court today. He submits that, the CBI intends to place those electronic devices with CFSL, Kolkata for necessary processing. He seeks direction of the Court with regard to the production of the original electronic devices seized.
Mr. Bikash Ranjan Bhattacharya, learned Senior Advocate appearing for the writ petitioners seeks to produce documents by way of an affidavit pursuant to the order dated January 24, 2024.
Mr. Anindya Mitra, learned Senior Advocate appearing for some of the successful candidates opposes the prayer of the Deputy Solicitor General as also the prayer of the writ petitioners. He submits that, the admissibility of the documents claimed to be produced in Court be decided. The Court should not pass any directions to the CBI for obtaining Certificates or processing in electronic devices from the CFSL.
58Mr. Kalyan Bandyopadhyay, learned Senior Advocate appearing for the some of the successful candidates submits that his clients should be afforded an opportunity of cross examination at the trial, in the event, the Court pleases to hold trial on evidence. He refers to the order of the Supreme Court as also the provisions of the Evidence Act. He contends that the parties were being heard by the Court. In the midst of such hearing, none of the parties should be allowed to remove any defects as pointed out by another parties.
Other learned Senior Advocates and Advocates appearing for the successful candidates submit that the issue of admissibility of the documents be kept open and that a procedure be formulated for the purpose of continuance with the hearing of the matters.
We issued directions as contained in our order dated January 24, 2024 as also the previous order dated January 19, 2024.
Learned advocate appearing for the School Service Commission (SSC) files a sealed envelop containing hard copies of the candidates in the panel and waiting list showing the OMR marks, four compact discs with regard to four categories of candidates showing the OMR server marks of all candidates. These be kept with the records.
59Admissibility of these evidences will be decided at the hearing along with other issues.
In view of the order of the Hon'ble Supreme Court, the number of matters pending and the issues required to be decided, as specified by the Hon'ble Supreme Court and as brought out in course of hearing of these matters, we propose to hear the matters on the basis of the affidavit evidence.
In such circumstances, it would be appropriate to permit the opposing parties one opportunity to use affidavits dealing with the documents sought to be relied on by the petitioners and the other parties filed today.
Let such affidavit by any of the parties be filed within February 12, 2024 as prayed for.
Parties may take inspection of the documents sought to be relied upon by February 12, 2024 by February 16, 2024.
The hearing of these matters shall commence on and from February 19, 2024.
Parties are requested to address the Court in addition to their submissions made earlier.
So far as the prayer of the Deputy Solicitor General with regard to the original electronic devices are concerned, it would be appropriate to permit the CBI to produce such originals with the CFSL, Kolkata 60 where they propose to submit the same for necessary processing.
Mr. Kalyan Bandyopadhyay, learned Senior Advocate appearing for some of the successful candidates further submits that, persons who require inspection of the OMR sheets may send such requisition to the advocate on record for the CBI for inspection of the OMR sheets.
Such suggestion being reasonable is accepted.
Such requisition be made by 4:30 p.m. on February 6, 2024. CBI receiving requisitions within such period will provide inspection of the documents sought for.
Inspection of documents sought to be relied upon by the parties in the proceedings be completed by February 9, 2024. Documents which are filed in Court today may be inspected by the learned advocate for the parties, on requisition being made to such effect before the learned Registrar General.
Learned Registrar General is requested to keep the documents filed today in safe custody and grant inspection to such parties who apply for inspection before her. It is clarified that the inspection be completed by February 9, 2024 so far as the Registrar General is concerned.
Needless to say, that the issue of admissibility of the documents filed today or that may be filed 61 pursuant to our order is kept open to be decided at the final hearing.
Mr. Kalyan Bandyopadhyay, learned senior advocate appearing for some of the successful candidates opposes the prayer for grant of inspection of documents submitted by CBI and SSC. He submits that, there is a possibility of further tampering if inspection is granted.
We were invited by one of the parties to the proceedings with regard to inspection of the documents concerned. Moreover, in our standing, if a party submits any document, the opposite party should be afforded an opportunity to inspect such document. Whether or not a party entitled to inspection, exercises the right of inspection is at the discretion of such party.
Original electronic devices are produced by the CBI pursuant to the orders passed by this Court.
According to the CBI, such original devices are required to be sent to CFSL.
There is a criminal proceeding pending.
According to the CBI, those electronic devices are required for such criminal trial also.
In such circumstances, we deem it appropriate to record that the original electronic devices are produced in sealed cover. They are returned to the learned Deputy Solicitor General with the direction 62 upon the CBI to produce Working Copy of such electronic devices prepared by CFSL.
Let such Working Copy be produced on February 19, 2024.
