Section 21 in Bachelor of Engineering and Technology, Bachelor of Pharmacy and Diploma in Pharmacy (Regulation of Admission and Payment of Fees) Rules, 2008

21. Vacant Seats.

- [(l-A) (i) After the completion of admission process or offering admission to all candidates whose name appear in the merit list, if the seats remain vacant, such vacant seats shall be offered to those candidates who have passed qualifying examination with minimum 45% marks (40% for SC / ST / SEBC candidates) in theory only or in theory and practical marks of subjects, -(a)in case of degree engineering or technology course Physics, Mathematics and computer as compulsory subjects and(b)in the case of degree or diploma pharmacy course Physics, Chemistry and Computer as compulsory subjects.The other conditions of eligibility as prescribed in sub-rule (1) of Rule 5 shall apply.(ii)The applications from the candidates eligible under clause (i) shall be invited by the Admission and admission shall be granted on the basis of merit by preparing a separate merit list in accordance with rule (11).
(1B)The seats which remain vacant after the completion of process as provided in sub-rule (1A) shall be filled in by the institutes, in accordance with the direction of the Admission Committee, in the manner prescribed in sub-rule (2).] [Substituted by Notification No. GH\SH\25\2012\PVS\102012\1307\S, dated 11.6.2012.]
(2)Such institute shall, invite application from the eligible candidates and prepare an inter-se merit-list in the following order:-
(i)names of the candidates whose name appears in the merit list of the Admission Committee,
(ii)names of the candidates who have passed qualifying examination from outside the Gujarat State and have appeared in GUJCET conducted in the current academic year, giving priority to the candidates of origin of Gujarat State."
(iii)After allotting the seats to candidates mentioned in sub-clause (i) & (ii) above, if any seat remains vacant, the institute shall invite application from the candidates who have passed diploma engineering course and grant admission on merit. Such candidates shall be eligible for admission in first year of engineering only.
(3)[ Notwithstanding any thing contained in sub-rule (1) and sub-rule (2), for the academic year 2011-2012, the seats which have remained vacant as provided in sub-rule (1) shall be filled up by the Admission Committee in accordance with the provisions of these rules in so far as they are applicable for granting the admission.] [Inserted by Notification No. GH/SH/39/2011/PVS/102011/335/S, dated 3.8.2011.]
(6)[ Subject to the other provisions of these rules, for admission in the academic year 2011-12, a candidate who has passed the qualifying examination and who has appeared at GUJect in the previous academic year only shall be eligible for admission to first year Bachelor of Engineering and technology, Bachelor of Pharmacy and Diploma in Pharmacy on the seats declared vacant under Rules 21.] [Added by Notification No. GH\SH\49\2011\PVS\102011\335\S, dated 13.9.2011.]
(7)[ Notwithstanding anything contained in these rules, for admission in the academic year 2011-2012 [and academic year 2012-2013] [Added by Notification No. GH\SH\52\2011\PVS\102011\1313\S, dated 10.10.2011.], a candidate who is otherwise eligible under these rules but has not appeared at GUJCET shall also be eligible for admission to the first year Bachelor of Engineering, Bachelor of Pharmacy and Diploma in Pharmacy Courses, on the seats declared vacant under Rules, 21.]
