Section 5 in Bachelor of Engineering and Technology, Bachelor of Pharmacy and Diploma in Pharmacy (Regulation of Admission and Payment of Fees) Rules, 2008

5. Eligibility for Admission.

(1)For the purpose of admission, a candidate shall have passed the qualifying examination from,
(i)the Gujarat Board; or
(ii)the Central Board of Secondary Education Board :
provided that -
(a)the school in which the candidate has studied, shall have been located in the State of Gujarat; or
(b)the school in which the candidate has studied, shall have been located in the Union Territories of Diu, Daman and Dadra Nagar Haveli and whose parents are origin of Gujarat; or
(iii)the Council of Indian School Certificate Examination, New Delhi :
provided that-
(a)the school in which the candidate has studied, shall have been located in the State of Gujarat; or
(b)the school in which the candidate has studied, shall have been located in the Union Territories of Diu, Daman and Dadra Nagar Haveli and whose parents are origin of Gujarat; or
(iv)the National Institute of Open Schooling:
provided that,
(a)the study centre/school in which the candidates has studied, shall have been located in the State of Gujarat; or
(b)the study centre/school in which the candidates has studied, shall have been located in the Union Territories of Diu, Daman and Dadra Nagar Haveli and whose parents are origin of Gujarat; or
(v)the International School Board :
provided that,
(a)the study centre/school in which the candidates has studied, shall have been located in the State of Gujarat; or
(b)the study centre/school in which the candidates has studied, shall have been located in the Union Territories of Diu, Daman and Dadra Nagar Haveli and whose parents are origin of Gujarat; and
(vi)have appeared in the Gujarat Common Entrance Test conducted in the current academic year,-
In case of,
(a)a degree in engineering or technology course, passed with minimum 45% marks (40% marks for SC/ST/SEBC candidates) in theory only or in theory and practical with Physics, Mathematics as compulsory subjects along with Chemistry or Biology or Biotechnology subject;
(b)a degree or diploma in pharmacy course, passed with minimum 45% marks (40% marks for SC/ST/SEBC candidates) in theory only or in theory and practical with Physics, Chemistry as compulsory subjects along with Mathematics or Biology or Biotechnology subject.
(2)Deleted
(3)A candidate whose parents are origin of Gujarat and are serving out of Gujarat in the service of Central Government or other State Governments, Military, Boards or Corporations owned or controlled by the Central Government or other State Governments or any nationalized bank and who has passed the qualifying examination from the State where parents are serving and appeared in the Gujarat Common Entrance Test conducted in the current academic year, shall be eligible for admission and his candidature shall be included in the second merit list as prescribed in sub-clause (ii) of sub-rule (2) of rule 11.
(4)A candidate who has passed the qualifying examination and,
(i)has appeared in the Gujarat Common Entrance Test conducted in the current academic year; and
(ii)whose parents are serving in the category of service as shown below; and
(iii)who are transferred from other States to Gujarat and have resumed their duty in the place where they are transferred in Gujarat and shall remain so transferred in the State of Gujarat at the time of registration for admission.
shall be eligible for admission and his candidature shall be included in the second merit list as prescribed in sub-clause (b) (i) of sub-rule (2) of rule 11:Category of Service :
(a)Officers or Employees of Central Government; or
(b)Officers or Employees of Public Sector Undertakings of Central Government and State Government; or
(c)Officers or Employees of nationalized banks; or
(d)Officers or Employees of United Nations, UNICEF, World Health Organization and such other International Institutions located in Gujarat State; or
(e)Officers or Employees of Indian Administrative Service, Indian Police Service, Indian Forest Service of Gujarat Cadre working in Gujarat or working in other States on deputation from Gujarat; or
(f)Officers or Employees of Gujarat Government posted outside Gujarat State for administrative reasons.
(5)A candidate who has,
(i)studied under Jawahar Navodaya Vidyalaya Scheme upto Standard VIII in any of the schools located in the State of Gujarat,
(ii)thereafter studied in any of the schools located out of the State of Gujarat under the said scheme,
(iii)passed qualifying examination from a Navodaya Vidyalay located outside Gujarat State and
(iv)appeared in the Gujarat Common Entrance Test conducted in the current academic year shall be eligible for admission and his candidature shall be included in the second merit list as prescribed in clause (b) of sub-rule (2) of rule 11.
Explanation. - "Jawahar Navodaya Vidyalaya Scheme" means the Jawahar Navodaya Vidyalaya scheme started during the year 1985-86 by the Government of India in accordance with the National Policy of Education. The scheme is managed by Navodaya Vidyalaya Samiti, an autonomous organization under the department of Education, Ministry of Human Resource Development.
(6)A candidate who has passed the qualifying examination after appearing in the supplementary examination conducted by the Board shall not be eligible for admission in the current academic year.
(7)[ Notwithstanding any thing contained in sub-rule (6), for the academic year 2011-2012 [and academic year 2012-2013] [Inserted by Notification No. GH/SH/39/2011/PVS/102011/335/S, dated 3.8.2011.], the candidates who have passed the qualifying examination after appearing in the supplementary examination conducted by the Board and who have appeared in the GUJCET examination shall also be eligible for admission on the seats which have remained vacant as provided in sub-rule (1) of Rule 21.]
