The reliance placed by the learned counsel for the petitioner on the
order passed by this Court dated 13.10.2025 in the matter of Ashish Gautam
vs. State of M.P. ( supra) is misplaced, as the factual matrix of that case is
materially different from the present matter. Accordingly, the observations
and conclusions in that judgment cannot be invoked in support of the
petitioner's case.
