Jammu and Kashmir Reservation Rules, 2005Published vide Social Welfare Department Notification SRO-294, dated 21st October, 2005In exercise of the powers conferred by section 23 of the Jammu and Kashmir Reservation Act, 2004, section 22 of J&K Persons with Disabilities Act, 1998 and all other relevant provisions of the law in this behalf, the Government hereby makes the following rules :-

1. Short title and commencement.

(1)These rules may be called the Jammu and Kashmir Reservation Rules, 2005.
(2)[ They shall come into force from the date of their publication in the Government Gazette] [Published in Government Gazette dated 21st October, 2005.].

2. Definitions.

- In these rules, unless the context otherwise requires,—
(i)"Act" mean the Jammu and Kashmir Reservation Act, 2004;
(ii)"Annexure" mean the Annexure to these rules;
(iii)"Areas adjoining the Actual Line of Control" mean the areas declared as such vide SRO-394 dated 5-9-1981 read with notification SRO-272 dated 3-7-1982 and SRO 271 dated 22-8-1988 as amended from time to time, forming Annexure - "A" to these rules;
(iv)"Available seats" means seats against which admissions are to be made in respect of a course in professional institutions, as hereinafter defined;
(v)"Backward Area" mean the villages/areas declared as socially and educationally backward vide SRO-394 dated 5-9-1981 read with notification SRO 272 dated 3-7- 1982 and SRO-271 dated 22-8-1988 as amended from time to time, forming Annexure - "B" to these rules;
(vi)"Candidates possessing outstanding proficiency in sports" mean a sports person as defined under the Jammu and Kashmir Certification of Outstanding Proficiency in Sports Rules, 1996, as amended from time to time, forming Annexure-"C" to these rules;
(vii)"Children" mean the direct decedents but shall not include grandchildren;
(viii)"Children of Defence Personnel" mean the children of those Permanent Residents of the State who are serving in Army, Navy or Air Force or having served as such and had been honourably discharged or retired and have not come to any adverse notice for any criminal or anti-national activity;
(ix)"Children of Para-military Forces and State police personnel" mean the children of those permanent Residents of the State who are members of the para-military forces or Police Service in the State or have retired from the said services and have not come to any adverse notice for any criminal or anti-national activity;
(x)"Ex-servicemen" means a permanent Resident of the State who has served in Army, Navy or Air Force and has been honourably discharged and has not come to notice for any criminal or anti-national activity;
(xi)"Form" mean the form appended to these rules;
(xii)"Rules" mean the Jammu and Kashmir Reservation Rules, 2005;
(xiii)"Select List" mean the list of the candidates finally selected by the selection authority for appointment or promotion to any particular service, category class or grade, as the case may be;
(xiv)"selection authority" mean authority competent to make selection/ promotion to the vacant posts;
(xv)"Weak and under privileged classes" mean the classes declared as such vide SRO-394 dated 5-9-1981 read with SRO-272 dated 3-7-1982 and SRO-316 dated 18-7-1984, forming Annexure -"D" to these rules; and
(xvi)the terms and expressions used in these rules, but not defined therein, shall have the same meaning as assigned to them respectively in the Jammu and Kashmir Reservation Act, 2004.

3. Exclusions.

- Notwithstanding anything contained in these rules but subject to clause (o) of section 2 of the Act, the persons and their children as specified below shall also be excluded from the category of socially and educationally backward classes, namely: -
(i)Permanent Residents of the State heading any Department or Organization in the Central Government;
(ii)Persons having enjoyed the benefit of employment in any International Organization like, U.N.O. International Monitory Fund, World Bank and other such Organizations for a period of not less than five years;
(iii)Officers of the Indian Army, Navy, Air Force and other Para-military Forces to below the rank and status of Colonel in army and other equivalent posts:
Provided that in case of his/her death in harness the rule of exclusion shall not apply.Explanation: -Where a lady belonging to a Schedule Caste, Schedule Tribe or Socially and Educationally backward classes/community, is married to an officer of any of the above-referred categories, this rule shall not apply in her case.Part -IIReservation in Appointment by Direct Recruitment

4. Reservation in Direct Recruitment.

- Except as otherwise provided in these rules, available vacancies shall be reserved for direct recruitment in each service, class, category and grade in favour of permanent residents of the State belonging to any of the below mentioned categories which shall, as nearly as possible, constitute the percentage of available vacancies shown against each: -
(a) Scheduled Castes 8%
(b) Scheduled Tribes 10%
(c) Socially and Educationally BackwardClasses (other than Scheduled Castes and Scheduled Tribes:—(i) Weak and under privileged Classes (socialcaste)(ii)Residents of areas adjoining Line of Actual Control(ALC)(iii)Residents of backward areas 2%3%20%
(d) Ex-servicemen 6% Horizontal Reservation
(e) Physically Challenged Persons 3%
Explanation (A): —The horizontal reservation to the extent of 6% of the available vacancies shall be provided to the Ex-servicemen against such posts only where the maximum of the pay scale does not exceed Rs.10,500/-Explanation (B): -For purposes of clause (d) and (e), the horizontal reservation means the reservations which would cut across the vertical reservation (what is called interlocking reservation) and the person selected against the physically challenged quota will have to be placed in the appropriate category viz if he/she belongs to the scheduled caste category, he/she will be placed in that quota by making the necessary adjustment and similarly if he/she belongs to the open competition category, he/she will be placed in that category.Explanation (C): -For the purposes of clause (e) reservations in recruitment shall be available for physically challenged persons for services and posts specified under section 22 of the Jammu and Kashmir Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1998 to the extent specified therein. i.e;
(i) Blindness or low vision …. 1%
(ii) Hearing impairment ….. 1%
(iii) Loco motor disability orCerebral Palsy ….. 1%

5. Roster for direct recruitment

— (1) With a view to giving effect to the reservation here in before provided in this part, the appointing authority shall, in respect of each service, class, category and grade in the services and posts under the State, maintain a roster of 100 vacancies in the form given hereinafter:

(2)The roster shall be maintained as a running account from year to year and will start at the commencement of a year at the point following the point which was utilized at the end of the previous year:Provided that where the last point utilized in the preceding year was a reserved point and was treated as un-reserved for want of a suitable candidate from the reserved class, the first point to be started as aforesaid shall be the reserved point:Provided further that where, on any occasion of selection in any year, a reserved vacancy is treated as un-reserved for want of a suitable candidate from the reserved category, the succeeding un-reserved vacancy shall on the next occasion of selection in that year be treated as reserved.
(3)The roster register shall be maintained as per the details given in Annexure-E.

6. Custody and Maintenance of roster.

- The responsibility for custody, maintenance and updating the roster shall be as under: -(a)For State Cadre posts, the roster shall be maintained by the cadre controlling authority, which shall ordinarily be the administrative Department in the Government:Provided that the Administrative Department concerned may, with prior concurrence of the Social Welfare Department, authorize Head of the Department concerned to maintain roster;(b)For 'Divisional Cadre' the roster shall be maintained by the Head of the Department concerned or the appointing authority separately for each Division;(c)For District Cadre posts, the roster shall be maintained by the Head of the Department and a copy thereof shall be kept with the District Officer concerned at the District level. It shall be the duty of the Head of the Department to ensure that both the roster and its copy are verified and countersigned by himself and the Concerned District Officer, at least once in each year whether or not a recruitment process takes place during this period;(d)For services to which direct recruitment takes place through Combined Competitive Examination, the General Administration Department shall maintain a separate roster for each service and the Cadre Controlling Authority of each such service shall also maintain and update the roster for the service. Such Departments shall furnish to the General Administration Department break-up of the vacancies to be filled by direct recruitment at a selection.
(2)While the roster shall be maintained in accordance with rule 5, it shall be the responsibility of every selection agency to send a return as per the Annexure-F to the Social Welfare Department on the day it notifies the recommendation for appointment:Provided that the rosters for appointment by direct recruitment existing as on commencement of these rules shall continue to be operated in the manner prescribed.
(3)[ It shall be the duty of the Liaison Officer of the department (as provided in the Rule 26 sub-rule (3) to maintain the roster for services for which the department is the cadre controlling authority and non- maintenance of roster by the Liaison Officer shall be considered as "misconduct" as provided in Rule 3 (1) of the Jammu and Kashmir Government Employees (Conduct) Rules and for such misconduct he shall be liable for any of the penalties from (I) to (VI) as provided under rule 30 of the Jammu and Civil Services (Classification, Control and Appeal) Rules, 1956.] [Sub-rule(3) inserted by SRO 144, dated 28.5.2008.]

7. Preparation of the Select List.

(1)The selection authority shall draw up, in order of merit, a consolidated list of all the eligible candidates irrespective of class to which they belong. The list shall show classification of the candidates category wise.
(2)The selection authority shall then prepare from out of the first list, a second list containing the names of candidates equal in number to the total number of un-reserved vacancies to be filled up, arranging them in order of merit, commencing with the first name in the first list (hereinafter called second list). If there are no reserved vacancies, then the second list shall constitute the select list subject only to the provisions of sub-rule (6) and (7).
(3)If there are reserved vacancies as well, the selection authority shall next prepare from out of the portion of the first list remaining after excluding the portion corresponding to the second list, a third list containing the names separately of as many candidates, from each of the categories, as the number of vacancies respectively reserved for them arranging the candidates from each category in order of their inter se merit (hereinafter called third list). The said third list added to the said second list shall in such case constitute the select list, subject only to the provisions of sub-rule (6) and sub-rule (7).
(4)[ If in the case of any of the aforesaid categories, the number of candidates belonging to such category in the third list falls short of the number of vacancies reserved for it, the remaining reserved vacancies for such category shall be treated as backlog and the procedure as provided under section 5 of the reservation Act shall be followed.] [Recast by SRO 144, dated 28.5.2008.]
(5)If, there are reserved vacancies alone against which selection is to be made, the selection authority shall invite applications from the members belonging only to that class for whom the said vacancies are meant. It shall then draw up a list of the candidates in order of merit, out of which shall be prepared another list containing names of the candidates equal in number to the number of the reserved vacancies arranged in order of merit commencing from the first name in the initial list mentioned above. The list so prepared shall constitute the select list for these reserved vacancies subject only to the provisions of sub-rule (6) and sub-rule (7).
(6)Notwithstanding anything to the contrary contained in sub-rules (1) to (5), the selection authority shall provide horizontal reservation to the extent specified under rule 4 to the candidates falling under the categories ex-servicemen and, physically challenged persons while preparing the roster under the said sub-rules.
(7)The list as finally settled by conforming to sub-rule (1) to (5) above shall constitute the list of candidates finally selected for appointment to any particular service, class, category or grade, as the case maybe, for which such selection is made at a time.
(8)For purposes of services to which Combined Competitive Examination is conducted, the reserved category candidates if selected against open merit vacancies may also be considered for allotment of services allocable to their respective category as per their inter-se-merit/own preference and the resultant left over vacancies in the services in open merit shall be allotted to,those reserved category candidates only, as per merit-aim-preference, against whose vacancies the reserved category candidates qualifying in the open merit are considered:Provided that physically challenged candidates shall be considered for selection in the services and against the posts identified for their respective categories in terms of Government Order No. 62-SW of 2001 dated 13.03.2001 and in accordance with their merit-cum-preference, if otherwise found suitable for selection.

8. Outstanding Sports Persons.

- Nothing contained in these rules shall bar the appointment of outstanding sports persons against the direct quota in terms of the Jammu and Kashmir (Appointment of Outstanding Sports Persons) Rules 1998, forming Annexure "G" to these rules.Part -IIIReservation in Appointment by Promotion

9. Reservation in Promotion.

- The available vacancies to the extent specified hereinafter shall be reserved in any service, class, category or grade carrying a pay scale the maximum of which does not exceed the pay scale of the post of Deputy Secretary to Government, for promotion from amongst the persons belonging to the Scheduled Castes, Scheduled Tribes and other socially and educationally backward classes:
(a)[ Where the direct recruitment to a particular post is at 25% or less the reservation shall be;
(i) Scheduled Caste 8%
(ii) Scheduled Tribe 10%
(iii) Socially and Educationally Backward Classes  
(a) Resident of Backward Area(RBA) 10%
(b) Actual Line of Control (ALC) 2%
(c) Weak & under Privilegedclass (Social Castes) 1%;
(b)Where the direct recruitment is more than 25 % the reservation shall be:
(i) Scheduled Caste (SC) 4%
(ii) Scheduled Tribe (ST) 5%
(iii) Socially and Educationally Backward Classes  
(a) Resident of Backward Area(RBA) 10%
(b) Actual Line of Control (ALC) 2%
(c) Weak & Under PrivilegedClass (Social Castes) 1%.]

10. Roster for promotion.

(1)With a view to giving effect to the reservation provided in rule 9 above, the appointing authority shall in respect of each service, class, category, or grade in which vacancies for appointment by promotion are to be filled, maintain a roster of 100 vacancies in the form indicated hereinafter: -[A. 100 points roster where direct recruitment quota regulating such service, class, category or grade is 25% or less.

(2)The manner and procedure for preparation and maintenance of the roster and updating thereof shall be the same as prescribed in rule 6 and rule 7 of these rules.

11. Preparation of select list for promotion.

(1)The selection authority shall draw up in order of seniority/merit, as the case may be, a consolidated list of all the eligible candidates irrespective of category to which they belong. The list shall show classification of the candidates category-wise.
(2)The selection authority shall then prepare from out of the first list, a second list containing the names of candidates equal in number to the total number of un-reserved vacancies to be filled up by promotion arranging them in order of merit/seniority in the feeding Cadre commencing with the first name in the first list (hereinafter called second list). If there are no reserved vacancies, then the second list shall constitute the select list subject only to the provisions of sub-rule (5).
(3)If there are reserved vacancies as well, the selection authority shall next prepare from out of the portion of the first list remaining after excluding the portion corresponding to the second list, a third list containing the names separately of as many candidates, from each of the categories, as the number of vacancies, respectively reserved for them, arranging the candidates from each category in order of their inter se merit/seniority in the feeding cadre (hereinafter called third list). The said third list added to the second list shall in such case constitute the select list, subject only to the provisions of sub-rule (5).
(4)If in the case of any of the aforesaid categories the number of eligible candidates belonging to such category in the third list fall short of the number of vacancies reserved for it, the remaining vacancies reserved for such category shall be treated as un-reserved and the selection authority shall prepare a fourth list containing the names of the candidates equal in number of remaining vacancies arranged in order of merit/seniority in the feeding cadre from out of the portion of the first list remaining after excluding the portion of the first list corresponding to the second and the third (hereinafter called fourth list). The fourth list added up to the second and the third lists shall in that event constitute the select List subject only to the provisions of sub-rule (5).
(5)The list as finally settled by conforming to sub-rules (1) to (4) above shall constitute the list of candidates finally selected for appointment by promotion to any particular service, category, class or grade, as the case may be, for which such promotion is made at a time.
(6)The placement of an officer in selection grade does not result in a vacancy and roster will not apply in such cases:Provided that the category candidates in the zone of consideration may be considered for selection grade by relaxed standards.

12. Assessment of the members of the reserved categories.

- In filling vacancies by promotion carrying the pay scale the maximum of which exceeds the pay scale specified under rule 9, the concerned selection authority shall assess the officers who are members of any reserved category by relaxed standards:Provided that no such relaxed standard shall be applied in case of officers whose integrity is doubtful.Part -IV

13. Reservation in Professional Institutions.

- Except as hereinafter provided, seats shall be reserved for Scheduled Castes, Scheduled Tribes and Socially and Educationally Backward Classes in each course of professional institutions which shall, as nearly as possible, constitute such a percentage of the available seats in that course as shown against each category or group hereinafter: -
(i) Scheduled Castes 8%
(ii) Scheduled Tribes  
(a) Gujjars and Bakerwals 6%
(b) Residents of District Leh 2%
(c) Residents of District Kargil 2%
(d) Other than (a), (b) and (c) above 1%
(iii) Socially and Educationally Backward Classes (other thanScheduled Castes and Scheduled Tribes)  
(a) Weak and Under Privileged Classes (Social Castes) 2%
(b) Residents of Area adjoining Actual Line of Control 3%
(c) Residents of Backward Areas 20%

14. Other reservation.

- In addition to the reservations specified in rule 13, the following reservation is also made in favour of the following categories of the permanent Residents of the State to the extent shown against each: -
(a) Children of Defence Personal 3%
(b) Children of Para-military Forces and State Police personnel 1%
(c) Candidates possessing outstanding proficiency in sports 2%

15. [ Distribution of seats. [Substituted by Notification No. SRO-49, dated 30.1.2018 (w.e.f 21.10.2005).]

- For the post-graduate courses in MD/MS/M. Tech. Engineering and Agricultural Sciences and similar other postgraduate courses, the seats shall be distributed as follows with the condition that the selection of candidates from the reserved categories for different streams shall be made strictly on the basis of their inter-se-merit, treating them as a single class for purpose of allotment of streams : -

16. Qualifying Marks.

- The minimum qualifying marks in the entrance examination for selection in the courses mentioned in rule 14 and 15 shall be as follows: -

- A reserved category candidate if selected against the open merit seat may be considered for allotment of discipline/stream/college allocable to him in his respective category on the basis on his merit and preference. The left over disciplines/stream/college in the open merit category shall be allotted to the reserved category candidates who get selected consequent upon the reserved category candidates getting selected in the open merit category.Explanation. - The left over discipline shall mean such number of disciplines/stream College becoming available after allotment of seat to the last open merit candidate as allocable under rules. 18. Competent Authority to issue certificate.

- The following officers shall be the Competent Authority to issue certificates under these rules: -
  Category Competent authority
(a) Scheduled Castes, Scheduled Tribes or Socially andEducationally Backward Classes:—(i) Weak and UnderPrivileged Classes (Social castes)(ii) Residents of the Areaadjoining Actual Line of Control(iii)Residents of Backwardareas Tehsildar
Provided that in respect of villages of Paddar, Marwah and Warwan Tehsil Kishtwar, District Doda, the Naib Tehsildar shall also be competent authority to issue such certificates.
(b) Children of Defence Personnel (Army, Navy and Air Force) Commanding Officer of the Unit/Zila Sainik Board.
(c) Children of Para-military Forces and State Police Personnelserving in the State DIG concerned.
(d) Candidates possessing Outstanding Proficiency in Sports(Sports Category) Secretary, Sports Council
(e) Physically Challenged Persons As prescribed in Notification SRO-414 dated 11-12-2003 (Jammuand Kashmir with Equal Opportunities, Protection of Rights andFull Participation) Rules, 2003.
(f) Ex-servicemen and children of Defence Personnel Zila Sainik Board/Commanding Officer of the Unit where servingor served.
(g) Resident of Backward Area/Area Adjoining ALC in respect ofregistered migrants of Kashmir Relief Commissioner (Migrants).
Provided that the certificates so far issued under notification SRO 126 of 1994 dated 28.06.1994 shall, subject to the conditions specified therein, be valid for purpose of these rules also,

19. Presentation of application.

(1)A person claiming benefit under these rules shall apply to the competent authority for grant of certificate in Form I, II, III. IV, V, VI or VII, as the case may be.
(2)The application shall be presented by the applicant personally or by his father or guardian or any person holding general or special power of attorney in this behalf.

20. Registration and verification.

- The Competent Authority shall, on receipt of the application: -
(i)immediately record it in a Register to be maintained by it and issue to the applicant a receipt to that effect;
(ii)scrutinize the application and conduct such enquiries as may be necessary for verification of the details of the application as also with regard to the eligibility of the applicant for the certificate claiMed by him.

21. Procedure for issuance of certificates.

- The issuance of certificates shall be governed by the procedure laid down in sections 13, 14, 15,16, 17, 18, 20, 21 and 22 of the Act and the Competent Authority shall scrutinize the application and conduct such enquires as may be necessary for verification of the details of the application as also with regard to the eligibility of the applicant for the certificate claimed by him/her keeping in view the following guidelines, namely: -
(i)A person claiming to be a member of Socially and Educationally Backward Classes shall be issued the requisite certificate only if he is not excluded under clause (0) of section 2 of the Act or rule 3 of these rules;
(ii)[ A person claiming benefit under Weak and Under Privileged class should be born in that class and not on the basis of actual practicing of the occupation by his/her parents;] [Substituted by SRO 144, dated 28.5.2008.]
(iii)A person claiming benefit for being resident of Backward Area or of Area near the Line of Actual Control must establish that he/she has resided in the area for a period not less than 15 years before the date of application and is actually residing in the said area. However, a person may not be dis-entitled from claiming this benefit only on the ground that his/her father or person on whom he/she is dependent is living in a place which is not identified as Backward Area or area near line of Actual Control on account of his employment, business or other professional or vocational reasons;
(iv)A person claiming benefit on the grounds that he/she belongs to Scheduled Tribe community shall produce an extract of Jamanbandi in respect of members of the Tribes, who own land and extract of electoral roll or Chullhabandi or ration card in respect of landless members of the Tribes. The production of identity cards or Grazing Cards issued by Forest Department or Revenue agencies in respect of landless members of Gujjar and Bakerwal Communities shall be supplementary evidence for the said purpose:
Provided that residents of village Turtuk of Leh district who claim to be Scheduled Tribes may substantiate their claim by production of sufficient and satisfactory oral or documentary evidence available with them:
(v)A person claiming to be child of a Defence personnel must establish that his/her parent is a permanent resident of the State and is serving or has served in the Army, Navy or Air Force and has honourably been discharged or retired and has not come to any adverse notice for any criminal or anti-national activity;
(vi)A person claiming to be child of para-military or State Police personnel must establish that his/her parent is a permanent Resident of the State and is actually serving in the State, or have retired from the said services, and have not come to any adverse notice for any criminal or anti-national activity;
(vii)A person claiming the benefit under the sports category must establish that he/she is an outstanding sports person in terms of the J&K Certification of Outstanding Proficiency in Sports Rules, 1996 /J&K (Appointment of Outstanding Sports Persons) Rules, 1998 as the case may be.

22. Determination of Annual Income.

- The annual income of a person claiming benefit under these rules shall be determined in the following manner: -
(i)Where a person is living with his/her parents/guardian and is dependent upon them/him, the annual income of parents/guardian from all sources shall be taken into account;
(ii)Where a person is not living with his/her parents/guardian and is not dependent upon them/him, his/her annual income from all sources including that of his/her spouse shall be taken into account:
Provided that the annual income shall be assessed by taking into account the average of the gross annual income of last three consecutive years excluding the agricultural income.
(iii)[ Any person appointed against any available vacancy on the basis of his being a resident of backward area or an area adjoining line of control shall be posted in such area as provided under sub-sections (2) and (3) of section 3 of the Act.] [Clause (iii) inserted by SRO 144, dated 28.5.2008.]

23. Issuance of Certificate.

- The Competent Authority shall within 15 days from the date of the receipt of the application for reasons to be recorded in writing either accept the application or reject it. On the acceptance of the application, the authority shall immediately issue the requisite certificate to the applicant in Form VIII, IX, X, XI, XII, XIII, XIV, as the case may be.

24. Validity and Renewal.

- The certificates issued to residents of Backward Areas or Areas near the Line of Actual Control shall be valid for a period of five years at a time and the certificates shall be renewable after following the procedure prescribed for issuance of such certificate.

25. Appeals.

(1)Any person aggrieved by an order of rejection of the Competent Authority under rule 23 may, prefer an appeal to the appellate authority under section 17 of the Act.

Part VI

Safeguards

26. Nodal Department.

(1)The Social Welfare Department shall be the Nodal Department for enforcement of these rules.
(2)The Secretary to Government in the Nodal Department shall supervise implementation of these rules through Liaison Officers to be designated for the purpose by the concerned Departments under intimation to Nodal Department.
(3)The Government shall designate an officer not below the rank of Deputy Secretary to Government in each of the Departments/Institutions as Liaison Officer for monitoring and enforcement of these rules and till such time these officers are designated, head of department/institution shall function as Liaison Officer.

27. Duties of Liaison Officer.

- The Liaison Officer shall perform following duties, namely: -
(i)ensure implementation of these rules and the Instructions issued from time to time;
(ii)conduct of bi-annual inspections of rosters maintained in the offices/departments under his charge;
(iii)ensure timely submission (before the end of the month of January of subsequent year) of annual statement showing total number of government servants in different services, classes, categories, cadres, grades, etc. appointed/recruited, promoted and selected for various courses in professional institutions in the year showing candidates from each of the reserved category so appointed/recruited, promoted and selected; and
(iv)scrutinize the proposals for de-reservation of reserved vacancies for direct recruitment before they are submitted to the Government in Social Welfare Department for their concurrence.

28. Annual Statement.

- The Nodal Department shall compile the annual statement of appointments/recruitment and promotions of all departments and lay it on table of each House of State legislature after which it shall be published in the Government Gazette by the Nodal Department.

29. Enforcement Committee.

- There shall be an 'Enforcement Committee' for enforcing and reviewing implementation of these rules which shall comprise the following, namely:-
(i) Chief Minister Chairperson
(ii) Minister for Social Welfare Vice-Chairperson
(iii) Minister of State for Social Welfare Member
(iv) Chairperson/Vice-Chairperson (Advisory Board for Dev of SCs) Member
(v) Chairperson/Vice-Chairperson (Advisory Board for Dev of Gujjarand Baker-wals) Member
(vi) Two MLAs belonging to SC Member
(vii) Two MLAs belonging to ST Member
(viii) Two MLCs nominated by the Chairman Member
(ix) Chief Secretary Member
(x) Secretary to Government, Home Department Member
(xi) Secretary to Government, Social Welfare Department Member-Secy.
(xii) Secretary to Government, Planning and Dev. Member
(xiii) Secretary to Government, Finance Member
(xiv) Secretary to Government, GAD Member
(xv) Secretary to Government, Law Department Member
(xvi) Any other person(s) whom the Government deems fit Special invitee(s)

Part VII

Miscellaneous

30. Adjustment in roster.

(1)The candidates appointed on compassionate grounds shall be adjusted in the roster against the category to which they belong.
(2)The candidates appointed under sports category shall be shown in the roster against the category to which they belong.

31. Seniority.

- As hitherto, the rosters prescribed for direct recruitment/promotion shall only be an aid to determine the entitlement of different categories with regard to the quota reserved for them and these are not for determination of seniority:Provided that the inter-se seniority of the category candidates viz-a-vis general category candidates on their appointment by direct recruitment shall be determined strictly in accordance with the order of the merit in the Select List prepared by the Selection Authority in accordance with rule 7 of these rules and rule 24 (b) of the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956:Provided also that the inter-se seniority of the category candidates vis-a-vis general category candidates in appointment by promotion shall be determined by order of the select list as per rule 11 of these rules in accordance with the merit/ seniority in the feeding cadre and Rule 24 (a) of Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956 where seniority is-the basis for promotion. However, in respect of selection posts, the seniority on promotion shall be determined on the basis of the order of merit prepared by the Selection Authority.

32. No relaxation in qualification and/or minimum number of marks.

- Where educational qualification/minimum marks have been prescribed in the Recruitment Rules regulating a service, the candidates claiming benefit under reservation shall satisfy the said qualification and also the minimum number of marks. The conditions so prescribed in the Recruitment Rules shall apply to all the candidates whether belonging to General Category or any reserved category.

33. Relaxed standards.

(1)Assessment of candidates by relaxed standards shall not mean relaxation in basic eligibility.
(2)Consideration under relaxed standards shall mean that the Selecting Authority shall fix a lower grade/benchmark for consideration of category candidates in promotions as compared to general category candidates:Provided that such relaxed standards shall not result in general inefficiency.

34. Adhoc promotion.

- The appointing Authority while making promotions under stop-gap/adhoc arrangement as provided under rules governing such promotions, shall as far as possible, make such arrangements strictly in accordance with the available roster points, with a view that at the time of regularization as per rules of such arrangements, the roster is not disturbed:Provided that if the candidates promoted on stop gap/adhoc arrangement are not found fit for regularization by the Selecting Authority for the reasons so to be recorded, such candidates shall have no claim to hold the posts substantively and shall be reverted to their original position.

35. Power to issue instructions.

- For carrying into effect the provisions of these rules, the Government shall be competent to issue such instructions as may be consistent with provisions of the Act and the rules.

36. Interpretation.

- If any question of interpretation of any of the provisions of the rules arises, the decision of the Government thereon shall be final:Provided that the Social Welfare Department shall be consulted before the decision.Explanation: —For purpose of these rules, the Government shall mean the Government in the General Administration Department.

37. Repeal.

Annexure "C"Government of Jammu and Kashmir General Admn. Dept. Government Order No. 163-Gad of 1996, Dated 22-02-1996.Consequent upon the directions of the Hon'ble High Court in Writ Petition No. 867 of 1993 titled Ankur Mahajan versus State and others and in supersession of Government Order No. 1215-GAD of 1992 dated 30-12-1992, the Government hereby makes the following rules for grant of certificate in favour of candidates possessing outstanding proficiency in sports:-

1. Short title and commencement.

(1)These rules may be called the Jammu and Kashmir Certification of Outstanding Proficiency in Sports Rules, 1996.
(2)They shall come into force with immediate effect.

2. Definitions.

- In these rules unless the context otherwise requires: -
(A)Candidates possessing Outstanding Proficiency in Sports, marts
(i)A person who has represented India at Olympic Games, Asian Games, SAARC Games, Common Wealth Games or other officially recognized Test Matches/World Cup Competition in any of the games/sports mentioned in Schedule I annexed here to; or
(ii)A person who has participated and secured one of the first three positions in the individual events or was a member of the team which obtained first or 2nd position or has participated twice or more in the same discipline in the National Championship or Junior or Senior events in any sports or games as mentioned in the Schedule I annexed to these rules for such of the courses where the prescribed qualification is 10+2:
Provided that for selection to such of the courses where prescribed qualification is Metric, participation in Sub Junior National events shall be sufficient.The events in which the proficiency is to be determined in terms of sub clause (ii) are as follows: -
(a)National School Games held under the auspices of School Games Federation of India; or
(b)Mini National Championship under respective Federations; or
(c)All India Rural Sports Tournaments under Sports Authority of India; or
(d)Women Sports Competitions under Sports Authority of India; or
(e)Federations Cups/All India Open Tournaments under respective Federations; or
(f)Vijay Hazare Tournament: or
(g)Vijay Merchant Tournament; or
(h)Ranji Trophy Tournament; or
(i)National Championship under respective Federations; or
(j)National Sub-Junior Championship under respective Federations (for courses where prescribed qualification is Matric only); or
(k)C. K. Naidoo Trophy cricket tournament (under 22).
(B)"Government" means the Government of Jammu and Kashmir.
(C)"Sports Council" means the Council established for promotion of games and sports by Govt.

3. Procedure for submitting the application.

- A person claiming benefit of having outstanding proficiency in sports or games shall apply on Form I appended to these rules along with the certificates to the Secretary, Sports Council for grant of certificate.

4. Recommendation of the Sports Council.

- The Secretary, Sports Council shall process the applications and after being satisfied that the candidate has participated ;n any of the sports/games shall grant certificate to the candidate in Form II. The applications shall be scrutinized by a Committee comprising Secretary, Sports Council, Director, Youth Services and Sports and a representative of the Department of Education.

5.

-The Government may specify, from time to time, any procedure for crosschecking the certificates so issued under the authority of Secretary, Sports Council.

6. Eligibility for claiming benefit under the Sports Category.

- Such candidates alone shall be eligible for consideration for selection to professional institutions in the State under the Sports Category who append the certificate issued under these rules with the application form submitted by him in pursuance of the advertisement notice issued by the authority competent to invite application in the State.Form 1(Refer rule 3)Application of issue of A Certificate of Outstanding Proficiency in Sports/gamesToThe Secretary,Sports Council,Jammu and Kashmir Govt.Sir,I request that a certificate of being a candidate possessing outstanding proficiency in sports may be issued in my favour. 1. Short title and commencement.

(a)These rules may be called the Jammu and Kashmir Appointment of Out-standing Sports Persons Rules, 1998.
(b)They shall come into force at once.

2. Definitions.

- In these rules, unless the context otherwise requires
(i)"Government" means the Government of Jammu and Kashmir;
(ii)[ "Outstanding sports person" means,— [Substituted vide SRO 376 dated 29.11.2004.]
(a)a person who has represented India at the Olympic Games or Winter Olympic Games; or Pre-Olympic or Asian Games/Championship; or Winter Asian Games; or SAARC Games/Championship; or Commonwealth Games/Championship; or Afro-Asian Games; SFA Games/Championship) World Cup/Championship; or other officially recognised test matches and world cup competitions in any of the Games/Sports mentioned in Annexure-I annexed to these rules.
(b)a person who has won first, second or third position in the individual or team events in National Games or Federation Cup or Senior Inter-Zonal Competitions or Senior National Championship or Senior All India Inter State Competitions officially recognised in any of the Games or Sports mentioned in Annexure-I to these rules.]
(iii)"Sports Council" means the Council established for promotion of games and sports by the Government of Jammu and Kashmir.

3. Appointment by the Government.

- Notwithstanding anything contained in the rules or orders for the time being in force, regulating the procedure for appointment to any non-gazetted service under Government, General Administration Department shall, on the recommendation of the Committee constituted under sub-rule (2) consider the appointment of any outstanding sports person, at its sole discretion, in any Department, against any vacancy in the non-gazetted cadre as under:-(i)persons possessing qualifications as 10+2 may be considered for appointment against a vacancy in the non-gazetted service;(ii)persons possessing qualifications less than as shown in clause (i) above, may be considered for appointment against Class-IV posts:Provided that a person possessing qualifications of Graduation or above may he considered for appointment against a higher post in the non-gazetted service:Provided further that the candidates are otherwise eligible for the posts under the relevant Recruitment Rules/Regulations governing the said services besides having obtained the certificate of being Outstanding Sports Person from Secretary of the Sports Council:[Provided also that only such a candidate should be considered for appointment who participated in an event/game recognized under these rules and secured a position as would qualify him to be defined as an Outstanding Sports Person during the period not exceeding five years prior to the date of issue of advertisement notice by the Secretary, J&K Sports Council for filling up the posts under these rules.] [Inserted by SRO 376, dated 29.11.2004.]
(2)For purposes of this rule the Committee shall consist of the following namely:

A Government employee possessing a certificate of being outstanding sports person shall be considered for grant of two advance increments:Provided that no such advance increment shall be granted under rules if the employee was appointed under Rule 3 of these rules or under the rules repealed hereunder:Provided further that the total number of increments so awarded to the employees shall not exceed five in his/her service career.

The appointment of an outstanding sports person under these rules shall be made only against the direct recruitment vacancies (non-gazetted) subject to availability of post.

6.

The Maximum number of appointments of outstanding sports persons against direct recruitment quota in all the services of the State during a calendar year shall not exceed 25 in any case.

7.

The benefit of appointment against direct recruitment under these rules shall be available to the candidates only once in service.

8. Repeal and saving.

(1)All rules corresponding to these rules and in force immediately before the commencement of these rules are hereby repealed.
(2)Notwithstanding such repeal, the cases which are already under process, orders issued or appointment made under the provisions of the rules so repealed, shall be deemed to have been made or taken under the corresponding provisions of these rules.Annexure IList of Games/Sports referred to in Rule 2(ii)
