The Rajasthan Rules for Regulating the Fund for Grant of Exgratia Financial Assistance (Family Planning Acceptors) 1976Published vide Notification No. F. 5(14) F./P/72, dated 24-11-1976; Published in Rajasthan Gazette Part 4-C, dated 16-12-76, page 547-550G.S.R. 184. - In supersession of this department notification of even number, dated the 14th March, 1973, the Governor is pleased to make the following rules to provide for the grant of ex-gratia assistance in cases of post-operative complications or fatality amongst the acceptors of the Family Planning Programme:-

1. Short title and commencement.

(1)These rules may be called "Rules for regulating the Fund for grant of ex-gratia financial assistance (Family Planning acceptors) 1976".
(2)They shall come into force from the date of their publication in Rajasthan Rajpatra.

2. Constitution of the fund.

- The fund shall be constituted out of the amount collected by contribution of 50 paisa per case of sterilisation/I.U.D. Insertion out of the Central assistance given as compensation money, and the amount so collected shall be kept in a non-lapsable fund under the head "081 Family Planning (a) Other Receipts. (i) Contribution recoveries towards ex-gratia financial assistance in the case of fatality/complication". The expenditure incurred on demands out of this fund shall be provided under the head "281 Family Planning (g) Compensation. (iv) Ex-gratia financial assistance in the case of fatality/complication 1. Ex-gratia Payments (non-plan)".

3. Grant of assistance from the fund.

(1)Financial assistance out of the fund shall be payable for case of fatality/complications which may result from a tubectomy. vasectomy or I.U.C.D. insertion. An application for this assistance will be made in the form (Appendix-I), the contents of which will be verified and a recommendation regarding the admissibility of the amount of assistance will be made by the Medical Officer concerned in the matter. An application for assistance in respect of the medicines purchased for the treatment of complications shall be accompanied by Cash Memos in the name of the patient and shall be verified by the Medical Officer concerned.
(ii)Post-operation complication cases. - In cases of post-operation/I.U.D. insertion complications, arising within four weeks of the operation/I.U.D. insertion, which require further treatment, whether as indoor patients or outdoor patients, the actual amount of expenditure on the medicines purchased for treatment, as prescribed by the Medical Officer of the Family Planning Centre, Primary Health Centre or Government Hospital/Dispensary shall be paid to the acceptors. This assistance will, however, not be admissible for the treatment taken on the advice of private medical practitioners. The maximum assistance will be equal to the expenditure incurred on purchase of essential medicines for the treatment of complications only and not for tonics, etc.
(iii)Financial assistance will not be given for any expenditure incurred on the payment of consultation fee to the doctors or payment to hospitals for services rendered.
(iv)Compensation for loss of wages or absence from duty. - In case an acceptor has to remain absent from duty due to treatment of post-operation complications beyond the normal period of special casual leave admissible to him/her, ex-gratia payment at the rate of Rs. 5/- per day shall be made for the days in excess of the period of special casual leave. In case of Government servants such payment will be made if the acceptor has to avail of leave without pay.
(v)Assistance in fatality cases. - (a) If any acceptor or Sterilisation Operation/IUD Insertion dies within a period of 10 days, irrespective of the actual case of death, an amount of Rs. 5,000/- shall be paid out of this fund to the surviving spouse or, if no such spouse is living, to the natural heir after proper verification. The other cases, where any complication arises within four weeks of the date of operation/IUD Insertion, and subsequently results in death, should also be given ex-gratia grant of Rs. 5000/- on verification by the Medical Officer concerned of the death being due to complications arising out of sterilisation operation/IUD Insertion.
(b)The financial assistance in fatality cases will be sanctioned by the District Level Committee of the District concerned, consisting of the following:-
(1)Collector
(2)Chief Medical and Health Officer,
(3)Dy. Chief Medical and Health Officer (F.P.),
(4)Treasury Officer

4. Universal eligibility.

- All acceptors of Sterilisation/I.U.D. Insertion, whether Government, servants or non-Government employees or members of general public, shall be entitled to receive ex-gratia payment under these rules.

5. Time limit for making payment.

- The amount of ex-gratia assistance admissible under these rules to the eligible persons shall invariably be paid during a period of two months after the receipt of information/request for the grant by the District Authorities. The payment would be made out of the imprest for compensation money available with the Deputy Chief Medical and Health Officer (F.P.) which would be recouped from time to time from the State non-lapsable ex-gratia fund.

6. Quarterly expenditure report.

- A quarterly report will be sent to the Ministry of Health and Family Planning (Department of Family Planning), Government of India, New Delhi, by the State Family Planning Officer showing the details and amount of payments from the funds made during the quarter under report, under intimation to the State Government.

In special hard cases, not covered under these rules, the District Level Committee may sanction ex-gratia payment, as may be considered proper in the interest of the programme, but in no case exceeding Rs. 500/-.
