The Rules for the Grant of Stipend to Unemployed Graduates/post Graduates Belonging to Scheduled Castes/Scheduled Tribes in Rajasthan, 1971Published vide Notification No. 20(E&E)SWD/71 /2286-90, dated 12-1-1971, published in Rajasthan Gazette Extraordinary, Part 4-C(1), dated 16-1-1971, page 349 to 356G.S.R. 103. - The Governor of Rajasthan is hereby pleased to make the following rules for the grant of stipend to unemployed persons belonging to Scheduled Castes and Scheduled Tribes in Rajasthan.

1. Title.

- These rules shall be called "the rules for the grant of stipend to unemployed graduates/post-graduates belonging to Scheduled Castes/Scheduled Tribes in Rajasthan".

2. Commencement.

- These rules shall come into force at once.

3. Definitions.

(a)"Director" means the Director of Social Welfare Department, Rajasthan, Jaipur.

(b)"Scheduled Castes/Scheduled Tribes candidates" means candidates belonging to Scheduled Castes, Scheduled Tribes as recognised in the list of Scheduled Castes/Scheduled Tribes in Rajasthan,

(c)

(i)"Resident of Rajasthan" means the candidate who has studied for the last 3 years continuously as regular candidate in any recognised institution of Rajasthan:

(ii)was born in Rajasthan and his/her father has been exclusively resident in Rajasthan for a period of 10 years after the birth of the candidate.

(iii)Is a son/daughter of an employee of the Government of Rajasthan or Rajasthan Government undertakings and Corporations, or Municipal Boards or any of the Universities in Rajasthan or the Board of Secondary Education, Rajasthan, who is permanent or has put in three years service on or before the 1st day of April of the year of application.

(iv)Is a son/daughter of an employee of the Central Government/Reserve Bank of India and other nationalised Banks. Life Insurance Corporation, who is either permanent or has put in three years continuous service provided his/her parents or Guardians have been posted in the State of Rajasthan for 12 months preceding the 1st April of the year of application.

(d)Misconduct. - The following acts will be tantamount to 'misconduct' under the Rules:-

(i)Commission of any offence under the I.P.C. involving moral turpitude.

(ii)Membership of any organisations declared unlawful by the Government.

(iii)Commission of any offence involving breach of the peace and disturbance to law and order.

4. Who is entitle for the stipend.

- [(i)(a) Only such Scheduled Castes/Tribes Graduates and Post Graduates in Arts/Science/Commerce or any other subject faculty recognised by any University-established by law who has passed such examinations in 1st or 2nd division will be eligible for such stipend at the following rates:-

1. Graduates	Rs. 150/-P.M.
2. Post-Graduate	Rs. 250/-P.M.

(b)Such stipend will be paid for a maximum period of 2 years in the said rules],

(ii)Till such time these recipients get employed, the Government will be free to utilise their services for such purpose and in such manner as the Government may deem appropriate so that they can gain experience in Government work.

(iii)It will be obligatory for the recipient of the stipend to get himself enrolled with the Employment Exchange and the Employment Cell of the Social Welfare Department:

Provided that such member is not prosecuting further studies in any University or College or other recognised institution and that he is not otherwise gainfully employed/engaged and three years have not elapsed between the passing of the last examination and the date of his application for stipend under these rules.]

(i)[ Provided that the applicant's parents are not paying Income tax. [Added by Notification No. F. 20/E & E/SWD/74/Rules/55638 dated 19-8-78.]

(ii)Provided that on other person of the family is already getting stipend-under these rules nor has applied for such stipend.]

(iv)[ A recipient of the stipend shall be allowed to avail 15 days casual leave with stipend excluding Sundays and. other Gazetted holidays observed by the Department/Institution concerned during the Calendar year. Leave in excess of 15 days may be granted for valid reasons by the District Probation and Social Welfare Officer concerned and this would be leave without stipend. A candidate shall not absent himself without prior permission of the officer incharge of the office/institution where he is deputed for utilization:] [Added and inserted by Notification No. F. 20/E & E/SWD/7H/Rules/71951 dated 29-11-76, G.S.R. 177, published in Rajasthan Gazette Part IV-C (I), dated 9-12-1976 page 536 [9-12-1976].]

Provided further that the period spent on actual journeys and appearing for interviews and competitive examinations, after obtaining permission of the District Probation and Social Welfare Officer concerned, shall be treated as period on duty. No Travelling Allowance and Daily Allowance will be admissible for this purpose.[Further provided that a girl who is married for more than last a month shall not be eligible to get this stipend if her husband is gainfully employed/engaged.] [Added by Notification No. F. 20/E & E/SWD/74/Rules/55638 dated 19-8-78.]

5. Procedure.

- Any member of Scheduled Castes/Scheduled Tribes who wishes to get the stipend shall apply in writing to the Director, Social Welfare Department, Rajasthan, Jaipur [through the District Probation and Social Welfare Officer of the district concerned] [Added/inserted by Notification No. F. 20/E & E/SWD/7H/Rules/71951 dated 29-11-76, G.S.R. 177, published in Rajasthan Gazette Part IV-C (I), dated 9-12-1976 page 536 [9-12-1976].] in Form No. 1. Such form shall be accompanied by-

(i)Attested copies of the degree examination last passed.

(ii)Certification of Scheduled Castes/Tribe from First Class Magistrate.

(iii)[ Character Certificate by Head of the institution in which he/she had last received education, prescribed in Form No. 5 that he/she is not disqualified for any misconduct as defined in rule 3(d). [Substituted by Notification No. F. 20/E & E/SWD/71/10386-90 dated 12-11-73, G.R. 160, published in Rajasthan Gazette Extra Part IV-C (I), dated 14-11-1973 pages 311-12.]

(iv)A declaration as prescribed in Form No. 4 duly attested by Head of the Educational Institution last attended Gazetted Officers or M.P., M.L.A. or Chairman of Municipal Board or Pramukh of Zila Parishads or Pradhan of Panchayat Samiti.]

(v)College leaving certificate of the institution last attended.

(a)[ A certificate from a Gazetted Officer or 1st class Magistrate of the Government of Rajasthan to the effect that the parents of the applicant are not paying income tax. [Added by Notification No. F. 20/E & E/SWD/74/Rules/55638 dated 19-8-78.]

(b)An affidavit duly attested by a competent authority, to the effect that no other member of the applicant's family is receiving stipend under these rules nor has applied for a stipend under these rules.]

As soon as the application is received, it shall be entered in the register in Form No. 2 giving all details and a receipt will be given to him for having given the applications.

7.

The application so received will be scrutinized by the Director, Social Welfare Department and if necessary the candidate may also be called for interview.

8.

The Director shall issue sanction in Form No. 3.

9.

Monthly payments would be made by the District Social Welfare and Probation Officer of the District, where the candidate is residing during the last one year.

10.

For claiming payment every' month the candidate must give an application to the District Social Welfare and Probation Officer concerned in the Form No. 6 declaring that:-

(i)he was not gainfully employed during the period for which the stipend is being claimed.

(ii)he did not prosecute further studies as a regular student of University College or other institution during that period for the purpose of obtaining a degree or diploma etc.

(iii)he was not guilty of any misconduct as defined in the rules during that period. The declaration made [in prescribed form 6] [Substituted by Notification No. F. 20/E & E/SWD/71/10386-90 dated 12-11-73, G.R. 160, published in Rajasthan Gazette Extra Part IV-C (I), dated 14-11-1973 pages 311-12.] may be verified by an Gazetted Officer of the Government of M.P. or M.L.A. or Chairman, Municipal Board or Pramukh of Zila Parishads or Pradhan of Panchayat Samiti.

The District Social Welfare and Probation Officer will have the power to refuse payment if he is of the view that the candidate is no longer eligible for the stipend and he may refer the matter to the Director Social Welfare for a final decision.

12.

The amount of stipend in full or any over payment made, or the basis of false information or declaration furnished by the candidate shall be liable to be recovered as arrears of land revenue.Form No. 1Application Form
